The circum stantial testimony against them is very strong, but perhaps a conviction would be difficult without a re sort to negro testimony. Some negroes saw the transaction, and are the only direct witnesses. They were admlted to testify before the coroner's court- Under our State laws they would be Inadmissible, as the deceased and the defendants are white persons; but under tbe Civil Rights bill of Congress, perhaps they may be allowed to testify. The defen dants are in custody. The planters in this region‘ are suffering from su perabundance of rain. As I write the heavens are lowering and sultry, with more showers yet in re serve. The cotton seeds, many of them old Beads, are coming up badly, and affairs do not promise well for the future. The proceedings in tho case of John O’Mahony, late Head Centre, are still in progress at the headquarters in Union square. The terrible crash in the fortunes of O’Mahony, says the New York World, has com pletely humbled that august Individual and rendered fiscated. Such property has, therefore, been restored upon proof that proceedings against ft had been dis missed iu the United States Courts. The records of the office do not show whether par ties to whom such property has been restored were connected with tho army of the so-called Confederate States, or whether they gave aid or comfort to the re bellion. General Howard says the estate of William Aiken, in South Carolina, was restored by order of. Major-General Sickles, commanding the Department. Three estates were surrendered for the reason they were not actually ubaudoned. Of the remainder some were given because very few freedmen wore resident upon them, and those could be more advantageously located elsewhere. The others were restored after mutually satisfactory agreements had been entered into between the freedmeh and the former owners. All of these pieces of property were embraced in General- Sherman's Field Order No. 15, and the au thority for the action taken by the Bureau in respect to them was derived from tho instructions of the Pre sident, contained in General Orders No. 145, from tha War Department, bearing date October 9,1865. The property held under the Act of July, 1862, and the abandoned property actually allotted to resident freed men, comprised but a small portion of tbe entire amount which the Bureau has held in its possession. In August, 1865, an application was received from B. B. Lake, of Tennessee, a former soldier of the rebel army, who had received a special pardon. His pro perty was clearly abandoned, and his application was not granted. An appeal was made to the President, and on the 17th of August was received at the Bureau with the following endorsement: Executive Office, August 16, 1803. Respectfully returned to the Commissioner's Bu reau. . R. Fox. The records of this office show that B. B. Lake was specially parduned by the President on the 27th ult., and waB thereby restored to all rights of properly ex cept as to slaves.
