''Policeman Smith immediately ar rested him, and being informed that another man had been seen with him, Policeman Smith- gave the prisoner in charge of Policeman Dowdin and went in pursuit of his accomplice, who was arrested under the platform of the auction store, evidently endeavoring to make his way to the bluff. Both tho prisoners, who are Germans, were conveyed to the Police Barracks, where they gave their names as Jacob Rosenbaum and Beer Goldman. From the barracks they were taken to Justice Staley’s office. While on the way, when near the comer of South Broad and Abercorn streets, Rosenbaum succeeded in making his escape from Policeman Dowdin by drawing his arms out o a light coat he had on, which he left in possession of Policeman Dowdin, while he proceeded at full speed up York street lane, pursued by Policemen Dowdin and Smith, the latter of whom left his prisoner stand- ing and went in pursuit of the fugitive. While ruu ning up the lane Policeman Dowdin fired at the prisoner, the ball taking effect in his left hand. This, however, did not stop his speed, as he kept running until he got near the comer of Bull and York street lane, when Policeman Smith came up with him and tripped him up. Mr. Smith then went back and got his prisoner where he left him standing. They were both carried before Justice Staley, who committed them both to jail for the offence of larceny, Mrs. Witty having prosecuted them. When Rosenbaum was arrested be had ten dollars of the money in his hand, and the other nine dollars was picked up on the platform where he had dropped. it. A gold watch, which was probably stolen, was also found in his pos vi< fare. Il j case of James and Edward Barnwell, charged -. iti» ibe murder of Thomas C Abbott, on Sunday list, was examined before Justices Russell, Connell •ml Hirt yesterday morning, at the office of the luriuar. tn the Court Houee There were a few persons > «.ave their testimony in the case who were no prejent a. the Coroner's Inquest. Tlie evidence given t > iLe new witnesses was corroborative of the test! ;ij »ny given before the Coroner’s Jury, with the excep- ti that it wa9 shown that one of the Earnwells had Jlcd at the boarding bouse of Abbott early on Sun- lay Li-jriuDg and desired to sec him. Miss Laura V. > ‘liver also, on being cross examined, gave a little more Testimony than she had given before the Coroner’s Jury, as follows Thought Mr Barnwell's conduct towards Abbott, hen he came after him, to be in perfect friendship; il^o stated that Abbott's temperament was not very asty. She saw him carry a knife, and thought he t that. he generally at night, and might or other persons, but no particular person or irried it from, the . jibed the street:* 1 molested by negro hat he carried purpose. His feelings towards James Barnwell •v-n? not so friendly as towards Edward Barn well. as the former had spoken disrespectfully of Abbott's family residing in Effingham county. 1 i.jd a conversation with Mr Abbott on Saturday a!."lit :t difficulty which occurred between himself and lames Barnwell in the streets. Mr. Abbott lold me, u Saturday evening, that he had waylaid James Barnwell while he was on his way to work on Saturday' ruing, and politely asked him why he had talked in a disrespectful manner about his (Abbott's) family ; luinwcll denied having said anything about them, * hereupon Abbott struck Barnwell on the arm, and a ma:i named Card ell then came up, and Barnwell went off without returning the blow' ; Abbott then used some abusive language io Barnwell as he walked off, wailing him a coward, &c. Mr Barnw T ell’s manner, judging from the tone of his voice, when he came to the house on Sunday, was so perfectly friendly that I was about to invite him into the house. The time that elapsed from Abbott’s leaving my piazza, until he got to where he was shot could not have been more than two minutes. The time consumed was just sufficient to hare carried them, walking fust, to the corner where he was shot. After telling me that he (Abbott.) had called Barnwell a cow ard, £c., I remarked, “Mr Abbott, don't you know it is wrong to strike a man iu the streets," to which he re- K W Box, S C plied, that he knew it was wrong to strike Barnwell on IAMB Peivslez, S ( :iie street, but that he (Barnwell) had spoken so dis- j F W P’dton, do respectful of hi*? family that bad he not resented it ™ TT ' people would call him t Abbottl a coward, and that that ••as the only way to revenge himself, to fight Mr. Barnwell with his hands and nor with weapons, and mat was the reason why he struck him. He said he did not wish to kill Barnwell, but just to whip him . r the offence given. I have often heard Abbott say that he w-.uld whijyjamea Barnwell, but that he did u t intend to use a weapon on him ; I never knew of ne instance where Abbott laid in wait for Barnwell , Abbott and Barnwell were in the habit of visiting my Superior Court —There was but one case tried be fore Hie Superior Court yesterday—that ot Helen Simon vs Francis Simon—libel for divorce. The jury rendered a second and final verdict, as follows: We, the jury, find that sufficient proof has been referred to our consideration to authorize a total divorce between the parties in this case—that is to say, a divorce a vinculo ma.tr(/nonit, upon legal principles. Messrs. Norwood and Lester appeared as counsel for libellant. The Grand Jury found the following true bills: State vs. John Hull, colored—breaking and entering, with intent to steal, and burglary. State vs. Albert Footman, colored—simple larceny. ft G, Smeift V, K KtcLct, t B Ktrita, LH Le vitt, fL] In a diamond, B, 3 Llppuun, R kdlmcliil- eon, Lovffil ft L, Lathrop ft Co.
