Important Legal Decision.—We publish
in another column an important decision by
Hon. John Erskine, Judge of -the U. 3. Dis
trict Court, Northern District of Georgia, sit
ting in Atlanta, in the case of tbe State, ol
Georgia, complainant, ns, James |Atkins, 11.

commenting on ibis decision, the Intelli
gencer remarks:
“Is it not remarkable that the Act under which the
Coart assumed jurisdiction over the parties and the
matter in controversy in thie case, ia nb other than
our old acquaintance, the “Fores Bill" of 183 *, so
much condemned at the time, as infringing upou
State Rights, and which seems now to be relied on by
the Court in behalt of a State ? We well remembnr
the passage-at-arms that took place in the Senate of
the United States between Mr. Calhoun and Mr.
Grundy, in which Ube latter proclaimed the A<yt 3
measure of 'peace. “Yes.’' replied- Mr* CalMfin*
“such peace as the hawks gives to the dove,” &e.
Thus it is that old enemies become friends sooner or
latter!”
Adjournment gP thb Fenijlh Congress.—
The Fenian Congress, recently held at Troy,
. New York, adjourned sine die on Sunday
morning, having been in session all Saturday
night. Col. W- R. Roberts was re-elected
President, P. J. Meehan President of tbe
Senate^ and J. N. Fitzgerald Speaker oft be
House. Gen. Sweeney was deposed as Sec
retary of War, but no successor has been
named. His accounts were satisfactory, but
he was believed to be incompetent. Gen.
O’Neil was appointed Inspector General of
the Irish Republican Army, and Col. Bailey
Chief Military Organizer. It is still hoped
that Gen. Sheridan will be prevailed upon to
accept the command of the forces. Another
movement on Canada will, the Fenians say,
undoubtedly be made during the fall if the
contributions are plentiful.
Important from Missouri.—Gen. Han
cock has received instructions to see that
the Conservative voters in Missouri have full
protection in the exercise of their right of
franchise, and any interference therewith,
from whatever quarter, will be apt to meet
a summary check. In addition to tbe above,
information has been received going to show
that tbe Conservatives arc taking their pro
tection into their own bands, and, as their
opponents are acting in like manner, that
fear is almost general that a conflict will be
tbe result.
The'notorious Horace Maynard, of Ten
nessee, who emigrated into that Stale a good
while ago from Massachusetts, and wto sent
to Congress several tipies, lately ^nade a

Southern Orphan’s Relief Fair.*—The la-'
dies of Baltimore on Monday night opened
their Aairat (he Maryland Jnatitutp, Balti
more, the nroceeds of which are to be ap
plied to the boildiog of an asylum in the
city of Mcbmond for the orphans of Con*
federate soldiers! The fair opened under
favorable auspices, and was well attended.

the Constitution, that taxation shall be
uniform and not partial in its applica-

tional support from that other equally well

either partially or generally. If there is a
single feature of the Constitution more ac
ceptable to all jnst minds than the rest it is
that of equality, and therefore uniformity of
taxatietoA^was^MujlNi lly intended by-the
original framers of that instrument. And if
the language of the Constitution were ambig-
ious upon this point, its spirit would forbid
the perpetration afro Aagrarrtu* outrage, not
upon justice alone, but upon plighted faith,
a form of moral obligation which has been
respected in all ages of the world.
It is thus made apparent that the invidious
legislation of Congress was prompted by the
spirit of vengeance, and - aim«d at the South
as an act of punishment, and as a means by
which the factories of the North could con
trol the cotton market and wage successful

As an additional Ulnstration of the spirit
of oppression which aotaated the last Con
gress, by taxing. products peculiar to the
Southern States, we may citei tkeiruportion
of a tax of two cents per ponnd on sugar
made from sugar cane, and excluding at the
same time from the (ax list sugar made from
maple and sorghum, which toe peculiar fo
the North, whilst the first is of Southern
production. The subjection of these two
leading staples of the South to taxation is so
clearly the, offspring of vengeance and ava
rice, and intended to operate-against one sec
tion for the advantage of the other, that it
makes it the duty of Southern planters to
test its constitutionality; and we sincerely
hope the question will be raised as early as
practicable before die Federal courts.. We
believe there is enough integrity and inde
pendence in take judiciary, of the country to
defeat the legislative swindle as soon as the
matter can be brought before .it for investi
gation.

The Congressional leader of the Republi
can party has commenced his electioneering
tour in Pennsylvania. He made his ’first
speech at Bedford gp the 4th inst., in which
he reviewed the proceedings of:the last ses
sion and laid down tbe platform of the party
of which he is the acknowledged and fear-
leu leader. His views of tbe policy to be
rsued in the restoration of tbe States are
stoically tbe same aa those reported by
turn in tbe Hough fff tatives as
Chairman of the Reconstruction Com
mittee. They are u violent in tone
and as proscriptive in purpose, with"
increased 'determination to enforce,
at the point of the bayonet, Jf necessary, the

tutional rights of tbe Southern States were
extinguished by the war,” and are therefore
•completely at the disposal of the conquerors.
Remade the broad declaration that tbe pres
ent jurisdiction of tbe Federal Government
over these State! is not derived from tbe
Constitution, but from conquest; and that
they fan possess no rights under the Copiti 1
tutiou until after such rights have been again
conferred by Congress, J*$ich is alone cm

is clearer than that when belligerents inau
gurate a war which is acknowledged to be a

agree, or as the conqueror decrees. If either
party is utterly subdued, his life, liberty, and
property are at the disposal of the .victor.,
i - Aftes disposing of this branch of his sub
ject, he proceeds to inform his audience
what Congress ought to have done before it
adjourned. We invite the attention of our
readers to this significant extract. He says:

lowing extracts from a private letter, dated
at MonticeHo Junction, Fla., Sept. 12 i
“Cholera has been playing wild at Cedar
Keys. It . made its appearance there on
Friday; on Saturday two or three died. On
Sunday nine died, and then the panic began.
Everybody (tying to get awity, and only two
mules and one wagon to do thp hauling,
and nd train until Monday. All business
; mills-were stopped, bouses were de-
, stores were closed, doors were locked
up and-n ailed up ; and on Monday every
body who had not left or tiken the dse
departed. Some sick ones, who were taken
along, were left on the road, and some were
taken sick after starting. William Stockton
was one of those left. James Gibson, a qpn
of Colonel William Gibson, of Gadsden coun
ty, a good Confederate soviet, and Mr.
Burgess vidte 'among the dead- - on
Sunday. The cholera did its work in
from five to fifteen bourn NoDoby could
stand it; all wbo were taken died. A
young man, jnst from there sa : d, ‘'They
bad no time to make their wifi a; .they could
only call on God and die.” William Stock-
ton, is a son of Col- -W. T. Stockton, of
Quincy, and I hope he will. not die. The
disease will now probably die out, as only
a few negroes atoleftthere.
“There were a few eases in Jacksonville,
I believe, on Sunday.”
Disgrace!^.—A few days ago a respecta
ble white girl of Troy, Ohio, was outraged
by a negro. Tbe negrq was subsequently ar
rested, taken before a magistrate and reeog-
nized by the injured girl, who -testified di
rectly and positively against Aim as toe per-
•petTator -of the deed, bearing on her face, too,
the marks of the terrible - struggle which she
had made, and yet the officer, from some un
accountable reason, discharged the culprit,
refusing even to ilM&n frit for his deten
tion.
Vermont Election.—The returns so far as
received from the Vermontelection, gild
Dillingham, Republican, 20,473 votes, and
Davenport, Democrat, 6,360.
Tim Madison News says that Win. Smith,
of New York, aad Charles Miller, of Ohio,
were ponvicted of highway robbery on the
testimony of negroes at the recent Morgan
Superior Court.
