F Shultz (white) sworn.—I heard a quarrel in the
atoro between Gib and McLean just after eight o’clock,
about ten cents; I went in and made them go out; be
fore going out Gib struck McLean; McLean then went
mto tbe next room and got a small pistol and came
into the yard and fired; I took hold of McLean and he
fired again; than I took the pistol from him, and
thought everything was settled, till about twenty min
utes after, T heard a report ot a pistol and ruahfd into
the room that McLean went into to get hispistoU-I
then saw the negro at the window with his arm
through it, and a pistol in his hand; I wont to him and
told him to Stotii 1 then turned to McLean and he wsb
about to drop; 7io was shot in the back; alter being
shot be went Uite the next room and sat in ajchatr by
the'fire;‘l tliougbl the fire |too hot; I brought him in
tho room and put him on the lounge, where be diod at
nine o’clock. ■
Lt. Howard testified as to a conversation with the
pris-mer, in which he acknowledged the shooting, but
said Khe deceased had fired on him twice; ha said the
pistol was at home; and he sent for it and exhibited it
to the jury; it was a Smith k Weston.
After hearing all the evidence in the cars, the jury
retired a short time and agreed upon the following
verdict : “That tho deceased, Augustus McLean,
came to his death by a pistol shot at the handa of Gib
bon Stevens, the same being done wilfully.
The deceased had been in the employ of Mr Shultz
for some two years prior to the war, and when it broke
out be entered the Confederate Navy, and continued
in it until the close, wlienhe waa taken prisoner some
where in NorthOnrolind and paroled. Since his
turn, and np to bis death, he has been in the employ
or Mr. Shultz, and we lorm he was a faithful and up
right man, and never sought a quarrel with any per
