Sickles’ new order in the Carolinas, prohibiting THe County Court Law. Below is a copy of the County Court bill as it passed <he two Houses of tne General Assembly: A BILL To be entitled *• An act to alter and amerid an act, approved March llth, 1866, entitled, 'an act to or ganize a County Court, define its jurisdiction, and for other purposes." Sec. 1. The General Assembly of the State of Geor gia do enact, That, from and after the passage of this act, there shall be two terms of the County Court, which shall be held as now prescribed by law: and two additional terms, which shall be known as quarter sessions, which shall be held at times as near equi distant between the semi-annual sessions as practica ble—said time to be fixed by the County Judge, and advertised in one of the public gazettes, or at the most public places in the county, as soon as possible after the passage of this act. The said court, at its semi annual sessions, shall have the same jurisdiction as now prescribed in criminal casei, and in civil cases, where the amount involved is over fifty dollars. The jurisdiction of the court at the qurater sessions shall be confined to criminal cases, and to civil cases with out limit as to amonnt. arising out of the relation of master and servant, whether suits for wages, applica tions to enfbrce performance, or tor other purposes; also, applications for the eviction of trespassers, in truders and tenants holding over, for the partition of personal property, for the trials 6: possessor}' war- rums, or proceedings under distress wa. rants, and habeas corpus cases; the proceedings in such cases to be in conformity to existing laws, and section of the act of which this act is amendatory. It shall be the duty of the j udge of said court, when re quested in writing so to do by a majority of*the jus tices of the Inferior Court, to call extra sessions lor the delivery of the jail. And he may call extra ses sions for.the trial of the civil cases last specified; but, ft such extra sessions, tuere shall be no jury trial in civil cases unless demanded by one of the parties ti:efe:o; in which case the judge shall cause a jury of five to be immediately summoued to try the same. In all other cases the proceedings shall be the same in both semi-annual ana quarter sessions as now provi ded by law for the semi-annual sessions. Sec. 2. Be It farther enacted, That the Judge of said court shall draw juries for both semi-annual and quarter sessions, in the same manner as they are now crawn for the semi-annual sessions. The juries so drawn ‘shall serve for the term next after being drawn, and at any called sessions, which may be held previous to the next term; but the juries now drawn shall continue to serve, as now required by law, .until this law shall be carried into effecl; and all civil cases now undisposed of, in the monthly sessions, not em braced in the special cases referred to in the first sec tion of this act, shall be transferred to the semi-an nual sessions. Sec. 3. Be it further enacted, Tlut the defeudant,iu criminal cases, shall have the same right of challenge to the jury as practiced in the Superior Court in like cases. Sec. 4. Be it further enacted, That the following shall be substituted iu lieu of section G, of the act of which this is amendatory: ‘‘That the County Judge, or his clerk, shall keep a strict aocount of all fines and forfeitures; out of which he shall pay himself, and the officers of skid court, pro rata, all costs which have accrued in said court, known as insolvent costs; the remainder, if any, after such payments, and «U other moneys, except liis costs, which come to his hands, as Coun:y Judge, or to liis clerk in his official character, he shall pay over to the County Treasurer, and report receipts and disbursements to the Grand Jury of the Superior Court; Provided, that If the fines and forfeitures aro not sufficient in tho county of Muscogee to pay said insolvent costs, the same shall be paid opt of the Cuunty Treasury, or such part thereof as may be inspected and approved by the Grand Jury of the county; and provided further, that no Insolvent costa shall be allowed for more than two witnesses to the same material point iu said county. He shall also keep an index of all court con tracts, and a list of all certificates and discharges gi anted by him, which shall be subject to the inspec tion of any ona interested therein; and he shall like wise provide a seal for the said County Court, to be used when necessary by himself or the clerk and until such seal is provided the private seal of either may be used ; and shall inspect, revise, and pass upon all jail fees arising under Ins jurisdiction, before the | Kihitory, and the delegation hope, from intiina- . as they received, that their object would soon be irooiplished. Almonte has received assurances by telegraph that Uuimiitan has abandoned his intention of leaving Ufiico, and of an avowed determination to put him* Self at the head of the loyal Mexicans and fight for his crown. That the special bailiff of said court shall give bond, as now provided by law, for the faithful discharge of his duties, in the same manner as the sheriff of the county. He shall have all the power iu the execution of the duties of his office as the sheriff, and be subject to the same pains and penalties. All orders and processes shall be directed to him as well as the sheriff, and he shall have the t^ame power to sell property under execu tions or orders issuiug from said court, as the sheriff now has. Six;. 6. Be it further enacted, That the County So licitor shall be the collecting officer for said County Court. He shall Collect all linos, forieltures and bonds, and pay over the same to tue County Judge, who shall disburee them according to the provisions of this act. And should said Judge fail to pay out mouey, &a required, he may be ruled iu tbe Superior Conrt, as J ustices of the Peace may now by law be ruied. Sec 7. Be it further enacted. That the County So licitor shall take his oath of office before the County Judge, or the Justices of tbe Inferior Court. Sec. 8. Be it further enacted. That the County Judge, at any time, may hear and determine the cases of all persons charged with crimes upou accusations drawn up by the County Solicitor, without a jury ; provided, the person or persons ho accused shall, in open court, declare that he, or she, or they, waive an indictment or presentment by a grand jury, and ar raignment and trial by a petit jury, which declaration shall be entertained on the accusation, and also on the minutes of said County Court. Either party, in a civil case, may appeal from tbe judgment rendered at the quarter and special sessions in like manner as ap peals are now allowed from the seiui-annual sessions. Sec. 9. Tnat the semi-auuiial sessions of the County Court for the county of Pan.ding shall be held on the first Monday in January and July iu each year; for tbe county of Carroll, on the secoud Monday in Janu ary and July in each year; for tho county of Haralson, on the third Monday m January and Jqly in each year; for the county ol Polk, on tbe fourth Monday in January and July iu each year; for the county of Bich- morid. on the third Monday in April and October in each and every year, and iq all other counties as re quired by law. For the county of Floyd, thefall term ot the semi-annual session shall be held on the third Monday in October; semi annual terms of the county of Forsyth, shall be held on the third Monday in May and November ; Thomas county, first Moaday in March and September. That the semi-annual session of the county of Dougherty bo held on the fourth Mon days in February and August. Sec. 10. Be it further enacted, That all parts of said act, of which this is amendatory, having relation to monthly or special sessions of said court, except as heroin provided, be and the same are hereby repealed. U- Stephens issued letters of marque and reprieal to the Estelle, to capture, barn, sink or destroy any English vessels out of neutral wa ters that .>*. may encounter, and Captain Burke an nounced his intention of making the Atlantic too hot for a British ship. It is declared that the incoming Onnard steamer Is to be captured at all haxards, and to that end the Estelle has sailed directly in the track af the expected vessel.
