bill just passed by Congress, provides
that Alabama shall become a State under the
bogus Constitution voted down by the peo
pie. provided that the Legislature organised
under the bogus C institution aforesaid, shall
assemble before the Constitution goes into
power, and before the State is admitted, and
give the assent of the Stale to the ratification
of tue fourteenth amendment.* This law pre
sumes that a State may adopt a constitution
by voting it down; that a Legislature may
organize under a constitution not in force,
and that Alabama may ratify an amendment
to the Federal Conatitation before being ad
mitted to tbe Union, and this is what the
Radicals call reconstruction.

over the mocal depravity of the harbitious

The mail Ashburh was a most dangerous
character, ignorant, energetio, vainaed unscru-
pulom,cruel, malignant and vindictive—abusive
and insalting td ‘ ih# whites, he was arbitrary
and overbearing to the blacks whom he endeav
ored to role in the most absolute and dictato
rial manner. We are informed that his rela-

States soldiers were very inharmonious. On
the Saturday previous to his death he had at
tempted to marshal his black clans in Colum
bus. Having lost his prestige, he was enabled
to muster but a few hundred idle vagabonds of
the worst class. The Sun informs us that:
‘Late in the afternoon this motley crew,
stimulated by his counsel and the harangue of
his strikers,' Edwards, Maull and others, pro
ceeded in procession to offer indignity to a
respectable and highly respected colored citi
zen. But for the timely interference of the
soldiers of the garrison, a bloody riot would
have ensued, of the ending of which, no man
could tell. On Monday afternoon reports were
rife that he had been engaged hi angry alter
cation with members of the garrison on account
of their action of Saturday. On Monday night
an immense assemblage of negroes were con
vened in Temperance HalL This crowd was
harangued for nearly four hours in a violent
and incendiary manner by Turner, the mulatto,
a member of the late Convention. Before the
adjournment of the meeting, Ashburn had
succeeded in getting up a disagreement between
Turner and himself, aud before the morning,
upon which he was to start on a crusade in
the neighboring counties, he was stretched a
*tiff and horrilne corpse in the negro brothel
where he lived.”
The Sun discards the idea that the murder
was committed by Conservative white men, and
Ashburn’s most intimate friends freely expresses
the opinion that he did not fall by the hands
of those on whom it is attempted by some of
the negro witnesses to fix the responsibility.
The Sun says:
In behalf of those who are sought to be
implicated in this transaction, we enter a most
solemn and decided disclaimer. They do not
desire to shirk the moet searching investigation
that eivil or military authority may demand.”
The Sun closes its editorial on the subject
with the following wise and well expressed ad
monition;
One word to our fellow white men. This
unfortunate occurrence will be put down to the
discredit of tbe honest people of the entire
South. Even now it is being flashed in a dis
torted form from one end of the North to the
other. Congress will be fired by comments of
the Radical press, and the terrible pictures of
the scene gotten up by “‘special artists.’^ .
“We should bear in mind the truth eliminated
from the pages of history, that though the dog-

rk, are weapons which can strike terror to
the seuls of tyrants, the people who have sanc
tioned their use have always been slaves.

matter, with thousands of others in that sec
tion, he thought some disposition should be
made of the case, although, he said, he knew
there would be no decision rendered, at least

Court rested the whole responsibility.
Judge Field rather intimated that no one had
authority to say there would be no decision at
present.
One of the Justices suggested that they
would hear au argument ou the case if both
Judge, Black and Mr. Carpenter (Who ap
pearad against McCardle) desired. The lat
ter said be would be jready at any lime it

sented. Judge Block retorted they didn’t

was the King of Dahomey, or the Sultan, or
