At a quarter past ten o’clock yttterday tne oa«e of
the State vs. Jams* Grad;, alias Bartley, alias etc.,
indicted (or having on the 7th of April, 18M, shot and
killed policemen Foley and MoNlchola, was called in
the Superior Court.
The accused and hie counsel, Hon. Jallan Hertridge
and General H. R. Jackson, were present and an
nounced that they were ready to proceed. There
was a large crowd in attendance. Gredy te about five
feet nine inches in height, dark complexion, low fore
head, black hair, blub-h-grey eyee, dark, heavy mous
tache, and has a somewhat forbidding coantenanca.
Col. A. W. Stone was present to assist the 80 icitor
General In the prosecution.
By eleven o’clock eight jurors, as follows, were
sworn and the panel of forty eight exhlusted: J £.
Vereen, F. Durden, W. Clarke, A. Waller, F. 8. Perry,
Louis Hohenstein, J. Epeteln, and Benjamin Frank-
O her talesmen were drawn, who were to be
present at one o'clock, and the witnesses were dis
missed until fonr o’clock.
The court met at one and a half o’clock and
Messrs. David Adams and R. A. Wayne were selected
as jurors from the talea collected.
At fonr o’clock four of ano’her tales answered to
their names and Mr. S. M. Liffitean was sworu.
Those of the talas who were not found were eenl
for. One by one they were picked up, brought In,
questioned, found uot to suit and dismissed. This
continued until twenty minutes pest five when
another talea was drawn.
Thos. H. Lyons, who did not appear when
moned in the morning was brought In at hall past
live o’clock and fined f26 and ordered to pay the coat
of attachment. A few minutes before six two men
were brought in neither of whom suited and they
were dismissed; after which in a moment another
as brought in and found incompetent.
Shortly afier six o'clock another tales was drawn
and the bailiffs sent out. Throe or the tales were
shortly brought in and found tuc impeteut, one hav
ing a “fever,’’ didn’t know whether be was or was
not opposed to capital punishment, in iact knew
nothing.
At half-past six the Judge said be “saw no use in
trying any more to-day’* to get the juryman, and said
that the Court must adjourn until Id a. in. to-day.
Mr. Hartrldge, for the defendant, asked that the
jury be allowed to go borne.
The Judge stated that the matter rested with the
Solicitor General.
The Solicitor General objacted, on the ground that
It was an unsafe precedent
It was decided to allow the eleven jurymen to get
supper and breakfast at a hotel.

Lathbop & Spivey’s Bankinu Hocse.—
The Iron Safe or Vault at the banking bouse

Exohange, has been alluded to by us before, bat at
the time we were unable to give a lull description of

the establishment of Messrs. Herr.ng A Co., is fire
and burglar proof, weighs twelve thousand pounds,
and ia a wonderful and curious piece of mechanism.
The fire proof part consists of the outside casting,
which is six inches thick. The lock—“the Yale
patent combination cock’’—can only be unfastened
by a person who ia thoroughly acquainted with it.
For instance— the cashier tur:.s the knob attached to
a dial plate, aud plan* a combination of certain
figures thereon, and while it is set at these points
locks the safe, and theu by again turning the knob
destroys the combination. Any other person might
try during their lifetime, aud perhaps never light
upou the same combination. It has also been de
monstrated that this lock cannot be broken; and, as
when fastened, there are springs which fill up the
key holes and force out anything that might beat
tempted to be placed therein, there is no chance to
use powder upon them. This outer door is secured
by nine large bolts, which are ail locked at a single
turn of the key.
The inside is made of crystalized iron, five times
harder than steel, and so manufactured that it can
not be cut or drilled. The whole Interior is con
structed of lronthrei inches thick. To make it com
plete burglar proof, two combination locks aie placed
ou this dour, the bolts of which are cylindr.cal, and
which, should the door be drilled, would only turn
round, if touched, aud in that way offer effectual re
sistance to any cutting tools. The sides and back are
also composed of Iron of tbe same thtcknes3.
Messrs. Lathrop A Spivey are reliable and ex
perienced gentlemen, and will do a large business.

It waa our good fortune yesterday to do one oil 01 ■*?«! <

influences of the sea breeze, and an escape from the
monotony of city lie at this doll season, in a fishing
excursion on Wilmington river.
At 8 a. m. the yacht Amltie, belonging to Captain
Threadcraft, of Thunderbolt, teft that piece and pro
ceeded down Wilmington River aad, alter a pleasant
run* anchored on the fishing g'ound, off Tnrner’a
Rocks, when, with awning spread, the diiciplea of
old Iziak commenced their pishatoriai work. The
first blood was drawn by Medico, in the thane of a
fine trout, when ibe exercises commenced. The
rest or th6 party attending well to their work,
the ptscadors by 1 p. m. hid hooked and landed
some two hundred fine trout, whitiog, Ac., and
cilled off f ,x refreshment. Meantime the mariner
having baiti d a shark book brought to the surface a
shark, which, after a hard buttle, was shipped on
board.
On the return to Thunderbolt, during a heavy
squal, the rudder-heed broke, and »ttie Amltie
was beached for repairs. This wai toon ac-

caatile men, steered the boat with ropes
to her anchorage. The shark was taken
a*bore, and dissected by MeJiio. It meas
ured eight test in length; circumference of

head, twenty-six poauds. The stomach, uu-
like its prototypes’, waa empty, woioh was
attributed to tbe impoverished state of
the surroundiog country. However, iu view of 'dis
covering an uuexploded torpedo or a mittjr of jewel-
like that with which tbe Dodge of Venice was
wont to wed tbe Adriatic—the Medico made a search
iog examination, but with no good result.
The party returned to towu highly pleased with
their trip, and stroDgly recommend tnu healthful
exercise, under the auspices of Gom. Threadcraft, to
all who desire to escape from the heat 01 the city aud
from offices withou r . work.

perience we wish to relate. Yesterday about two
o’clock as we were going home to dinner, we saw
little Tommy Jones who was up a Pride ol India tree

picked him up. and after a while Tommy came too
and walked home, he did not live far from the spot,

advance on yesterday’s figures. Upon the receipt o[
news from Liverpool, showing an active and buoyant
market, nolders had still more confidence, asking
higher prices, which buyers had to pay. There has
been moie doing to-djy iu the stat>lo than for a long
time, the sales amounting to 353 bales, l’ha market
closed firm with an advanc;ng tendency.
We quote middling at 30c, closing prices—1
daring the day having been made at lower r$les, and
prices generally ruled very irregular.
The sales to-day have been as follows: 3 bales at
