been delivered at the Masonio Hall last night, by
the H _n. Nelson Tilt, was postponed until to-night at

Testimony. Argument*, &c.
The Superior Court room was filled before ten
o'clock yesterday morning by a crowd who anxloaalj
awaited to hear the testimony in the caao of the po
liceman James Grady, indicted for the murder o
policemen Foley end McNichola.
At ten o’clock the Judge announced that all jurors
who had been objected to or had gone off on a voir
dire could go until Monday morning at ten o’clock.
Shortly alter ten o’clock, everything being ready,
an attempt was made to get the tweltth juror. Twelve
of tbe tales answered to their names, and the .twelfth
(Mr. John Lorch) was rouud to be a competent j uror.
The jury is as follows: J. B. Vereeu, F. Durden, W.
Olarke, A. Waller, F. S. Ferry, Louia Houen-teln, J.
Ebstein, Benjamin Franklin, David Adams, K. A.
Wayne, 8. M. Lafflteau and John Lorch.
The Balicitor Genera’ then read the indictment
against the accused, an l said that he expected to
prove that the accused did on tbo Tth of April, 16G8.

the accused was first to be tried, and to which be
p eau not gailty.
TESTIMONY FOB THE STATE
Policeman Gailoglay was the first witneaa called,
and being duly sworn, testified as follows:

The Solicitor General contended Ibatas what wae

Mr. Hurtridge supported bis objection, saying that

Mr. Hnrirld<e before mtroduol^ teatiamny for the
defense, stated at some length what the defense In

reason to beer on each fact aud 'circumstance,

sound mind; end that whether the accused bare mal

vict him.
Mr. Lsri 3. Hart was called to prove some deposi
tions taken before him. Mr. Hart did not answer,

Hartridge read the return of the commissioner ap
pointed by the court to get the drpwitlon of Mr. Wm.
J. Neville. The return stated that Neville could not
be found. Mr. Neville testified before tbe coroner’s
inquest, and the Bench of Magistrates, stated Mr.
Hartridge, and as be could not be fouud, the Prison
er was entitlea to the evidence of Neville as given be
fore the magistrates, and in support of bis argument
quoted a number of authorities, pending which the
court took a recess until foar o’clock.
At four o’clock the court opened, a large crowd
being in attendance.
Mr. Hartridge resumed hia argument in support of
his motion to introduce the tes.im^ny of Mr. Neville,
given before the committing magistrates
General H. U. Jackson aigied la support of tbe

for about ten minutes.
The Solicitor General followed General Jackson,
and contended that the authorities quoted by the
counsel of tbe accused would not bold good in this

tbe attendance of the witness, whose deposition they
wished to Introduce; that they must prove before intro,
duciug the deposition—first, that the witnesi is dead
aud secondly, that he is not iu tbe jurisdiction of this
court, sad atsetted that the counsel had not proved
either point.

Mr. L.vi 8. Hart sworn—I was one uf the Banch of
Magistrates that examiued Grady; the deposition was
shown the Witneaa, who testified that tt was iu his
hand-writing; that tue testimony was as given by
Neville; 1 was also prcseul at the corocer’s luquesi;
the testimony of both iu these depositions is as de
livered.
The depositions of W. J. Neville as taken down at
Ihe Coroner’s Inquest and the Bench of Magistrates

Marshall Bone Company, a yoang bat rising Are or

and Golf Railroad, one ot tha best locations for such
a purpose we ever saw.
The day was‘a delightful one, warm, bat, on the

The train left it half pest eight, with a select petty
on board. Moat of the officers end members of the
Company were there, with their families, and many

the free dlspoeal of the guests.
Tho Savannah string band was employed to fur
uleh music, and in leas than half au hour dancing
on tho green commenced. It did not fairly cease till
the cars whistled at night.
There were provisions in plenty and in sdrplua. We
had fifty invitations to diae, but fortuue placed us
iu the bauds of Mra. Geo. Helmboidt and Mra James
Burke,.whore under vining honeysuckle, iu tbe cool
shade, with a good breeze blowing heroes us, we par
took of a most sumptuous repisu Others were en
tertained at their kable, and Mr. J. Fernaudez, who
had a profusion of good things to eat and drink, was
hospitable as usual.
President White, Foreman Godfrey, Assistant Fore
man Kobider, Treasurer Fernandez, and alt tbe
officu-rs and committee, were most assiluou* in their
attentions to guests, aud thair exertions for the en
joyment of the whole party. Henry Gwinn aud
Madame Gwinn were unceaslag in their labors in
every capacity. Wp'remember especially tne coffee
and the fresh iced milk.
Tbe party retired early, with some reluctance. Not
an unpleasant incident occurred during tbe day—no
drunkenness, brawling or fighting. This is credit
able to the nramen of the company,.and to tbe whole
party of pic-nlckera. We did not see a dissatisfied
parson on the train as we came in, but tbe entire
crowd of passengers voted the pic-nic a great success,
and were rejoiced that they did not miss it.

The minimum of municipal offending waa reached
yesterday and the 0.1”*, it woold seem by the re
cord of tbe Mayor’s Court “have no delights to pass
away the time except to spy their shadows in the
sun” and keep cool as best they can.
E. A. Skrine was charged with a violation of eity
ordinance in peddling jewelry without a license in
the market; the com waa not made out. the' accused
hiving a ring and wishing to realize fifty cents for
the same with which to purchase medicine offered it
tor sale. This not being a violation of the ordinance
recited, the case was dismissed.
Henry MHler, colored, was op for disorderly con
duct, in that he had obtained leave to have' a private
part; until 1 o’clock A. M., and refused to close tho
same at tnat hoar whefi ordered by tbe officer. The
case appeared to hinge on the misapprehension
on tbe part of Miller Who understood that 2 o’clock
was the hour when the Hall should cease to roll,-there
was no disorder complained of, aud alter an
monition from Hia Honor Henry was set at liberty.
INFORMATION DOCKET.
The firm of Richardson & Barnard was placed upon
the docket, charged with a violation of city ordi
nance in two counts1st selling hay wilhont tha
same being weighed by tbe city-woigbar; 2d ob
jecting to have their flay weighed by tnat officer aud
having the same weighed by their clerk. Messrs. R.
St B. produced a permit from His Honor allowing a
portion of A cargo of bay which had been bought for
shipment into the interior, to pass without being
weighed by the weighers oi hay. The city weigher
weighed 200 bales a portion of ihe same cargo, des
tined for consumption and sale to dealers in the city.
The construction placed upon tne ordinance by tbe
Mayor quashed the information and the case was
dismissed.
One whole boar was spent in the court and to tbe
credit of the law and order loving people of Savannah,
it may proudly be said no money went into the City
Treasury from tbe hoar’s proceedings.
