Base Ball —The Alert Club of Charleston
bar challenged the Forest City Club to play a match
game of base ball. The challenge has been accepted,

chants of this city have raised a purse, and purchased
a silver goblet, which will be presented to the crew
of the winning boat in the coming regatta. The gob

THE ARGUMENTS. ^
The Court met at ten o’clock, and by half-past ten
the wheels of the law were in foil motion, and the

menced bis argument.
Ha admitted that the St\te had proved the homi
cide, bat asserted thu it had not proved that It was
done through malice ; that it had cot shown what
occurred previous to the shooting, by whit circum
stances the prisoner was surrounded, nor what dan
ger he wej in from the crowd that pressed on him,
nor what danger he feared from that crowd, among
which were the men wbo had previously advanced in
a threatening manner upon him in the bar-1oom, and
also followed him out Into the street. He then read
the law In regard to killing done In self-defence, and
contended that the prisoner labored under the im
pression that ho.waa being attacked,and shot the men,
as be believed. In self-defence; and also contended
that ths state of tbo prisoner's mind was such at the
time of the snooting, from the cff.cts of l.quor, that
ne could not, under the law, be held cuspoaribfofor
bis actions. In support of this he read from Ray’s
Medical Jurisprudence what were the effe

Mr. Uartrldge then showed by the evidence that
this was cue coudl’ion of the prisoner on the night
of the homicide; that he pseeed through all the
stages above described to ihe last, when he became
like a mauiac, and wasinot responsible for bis tf'
lions; that to commit a murder required reason, and
as It was clearly shown that the accused was at the
time insane from drink, he could not be convicted of
murder.
Mr. Hartridge spoke for abont an hour, sup
posing every argument with authorities, and pre‘
seuted the testimony In such a clear and forcible
meaner that the audience were convinced that there
was not any violence on the part of the accused, and
that at the time of the shooting he was not Ui his
right mind. There was a disposition to appland Mr.
Hartridge at the conclusion of his speech, and but
for the officers of the Court checking the disposition,
the old bmldiug would have reaonnded with the
cheers and applause of the crowd, each and every
one of whom had listened delightedly to hie sound
arguments and eloquent language.
We have heard many spetches In criminal ca*.es

assert that this effort ot Mr. Hartridge excelled any wo
have ever listened lo.
General Henry R. Jackson, associate counsel, fol-
owed Mr. Hartridge, c jmmeuciug his argnment at
eleven and a half o’clock and closing at twenty min
utes to two.
In bis u-ual chaste and eloquent language be ar

were moved to tears.
At the close of General Jackson’s speech, the Solic-
itor-Geueral opened his argument on the part of the
State, speaking abont twenty mlnntes. He contended
that the State had proved all the facta necessary to
convict the accused of murder; that the counsel for
the accused had failed In their efforts to prove that
there was no malice, and that the prisoner was of on-
sound mind at the time of the shooting, andconse-
qaentiy the prisoner was gnilty.
Colonel 8tone, who bad been employed to assist in
the prosecution, was Lot present Saturday, sending
word that he was indisposed.
The Judgo charged the Jury, and a little before three
’clock, the case wa9 given to them.
WAITING FOB THE VERDICT.
Wiien the jury retired, most of the crowd also xetlred
to get dinner, and about half-past three began to re
assemble, and at four o'clock the court room was
again crowded.
Shortly before five O’clock, the jury announced that
they had agreed upon a verdict, whereupon the court
was opened, the jury marched in, and amid breath
less silence, the verdict wa3 ieid by the Solicitor-
General, as follows:

It la alleged farther that five distinct charges have
been preferred, an being of a serious character* lm
plying that Col. Hulbart has used the power confer
red upon him. and funds eatnuted to him only for his
personal aggrandizement.
It Is farther alleged that more than one threat pf
exposure against Colonel Halbert has been made In
Savannah unless the aggrieved persons were compen
sated for their labor, and that these complaints are
not made by one or a dozen persons ttiat his brought
tils matter to a crisis, bat that Urn complaint Is gen
eral, and will most likely be searched Into and CoL
Hulbert brought to account for his alleged malfea
sances.
Neither, it is alleged, are the charges preferred by
tho e politically opposed to him, bat by men of his
own stripe, and who, until this affair, caused them to
rebel, were bis obedient laborers.
The charges alleged are serloni, and should the ex
pected investigation take place, many matters on
which the public desire tome Intelligence, will le
ventilated, uuleas the examination is conducted with
in dosed doors.
Fire.—Saturday evening, »i 9 o'clock, an
alarm of fire was cried (not sounded./, and our ra-
portei found it to proceed from a uegro tenement on
Sooth Broad street lane, between Drayton and Ab.r-

The audience and the prisoner received the verdict
in a maoner which clear<y showed that it was In fr:-
cardan ce with what was expected.
The jury, we learn, agreed to bring in a verdict of
manslaughter very soon after leaving the court ro.m,
but could not agree then recommending him to
mercy.
The jury was then dismissed until ten a. m , to
day, tbe court adjourned until that time, the crowd
dispersed, and the prisoner was carried to jail.
A nolle prosequi will most probably be entered by
tbe Solicitor General to-day In the indictment for
killing Foley.

I was born In Cass county, Georgia, on the 24th of
Match, 1840; my parents removed from that cuonty
to Western Ark ansae, five years alter I waa boro, and

children, with no relations within twelve hundred
miles; two years after my parent’s death, my uncle
came and carried us children to Polk county, Tennea-

Father Hymn’s Address at the Catholic

We received on Thursday last the following com
munication in regard to a point taken by Father
Ryan In bis address on edocxtion at the Catb-
ello pic-nlc on Wednesday last. The commu
nication would have been published before but tor
tbe heavy press of local mailer:

Your reporter in your yesterday's Issue says of
Fsther Ryan’s discourse at the pic-lnc on Wednet-
day:
*The topic was education, and the first point of
the speaker was the superiority of the denomina
tional schools over those supported by the State. He
instaaced Prussia, where tbe free school system;
under State direction, had lurDished us a model, aa
the hot-bed of infidelity.**
I am a personal admirer of Father Ryan, the dis
tinguished scholar, the illustrious poet, and the
high-toned and patriotic geotlemaa, aud lam not
presumptions enough to enter with him into a gener
al discourse about education, but as for as Prussia la
concerned, he is certainly misinformed, and injus
tice to my native country, I beg leave to correct the
erroneous views in tbe above expres> ion. If general
education constitutes infidelity, then I grant Prussia
la tbe most infidel country in tbe world, became from
tbe lowest peasant, the meanest day laborer, aud the
most wretched beggar in the street, up to tbe highest
classes, there is not one person over tbe age of eight
years who cannot read and write, as every child In
Prussia, from its sixth to Us fourteenth year, is
compelled to visit school; bat the Government protects
every religion equally, and the tcholera are also daily
ustructed in religious knowledge by the paetors and
priests Of their own denominations. The same reli
gious principle Prussia enforces In her mighty army’
aa all soldiers off from duty, under their proper of
ficers, ate marched to the churches of the different
denominations on every Sunday to bear Divine ser
vice. and every sight at tat-too all the different
gaards fall under arms for prayer. 1
On tbe other hand, if history speaks truth, “the
hot bed of infidelity” furnishes France, the most
powerful Roman Ualhollo country in Europe, and
where the lower classes are uneducated and.unlu-
structed. To substantiate my assertions, 1 will only
point to a few French writers cut of thousands, and
to a single historical feet: First, we behold the prince
of all infideis and athiests, Voltaire,who Bang his doc.
trines and writing like firebrands all over tbe globe;
in our own days we have E- Renan wbo, only two
years ago published his, “The Life of Jesus.’’ But
the crown to all we find in the first French revolu
tion, when that ustkn dethroned God Almighty and
elected a "Goddess of R$fcson.” a sacrilege which
finds not Its parallel in the history of the world.
