Question—Do you swear yon did not tell
Foatfer Chapman that Ashburn was going
to report you, and that you were going to

Answer—1 swear I tolk him that Ashbnru
said be was going to report me, but I did uot
tell him that I was going to kill Ashburn,
swear to that.
Question—Did you, or did you not, make
the same statement to Van Marcus the same
even'mg ?
Answer—I told him the same thing relative
to having strnck A. that I had already told
to Chapman.
Question—Was that the time you passed
by Cook's saloon ?
Answer—Yes.
Question—Was there a political meeting
held in Columbus that Dight ?
Answer—I beard there was, but I am not
positive as to that.
Mr. Stephens was abont to press the-ques
tion when it was objected to by Den. Mar
shall. The question was withdrawn by Mr.
Stephens.
Question—Do you know whenthe A. was
at a public meeting that night or not ?
Answer—I do not. The majority of those
having influence in Columbus were of his
party; I mean a majority of voters.
Question—Is it, or not, in your knowl
edge, that tbere was strong opposition to A.,
existing on account of his own ?
Answer—I never heard of it.
Question—Do you know a Mr Bennett ?
Answer—1 do, sir.
Question—Did he live in the same house in
Which Mr. Ashbnru lived ?
Auswer—I don't know. I did not see him
in the room that night. If he bad been there,
he had plenty opportunities for secreting
b.mself. I never spoke to Bennett in my

ber, 1863, at Brandy Station, Virgiaia,. for

Y ork, JaDuary 8th, 1866, for three years. I
was first arrested between three and four
weeks ago; I was not then aware that it was
for this matter I was arrested; I became
aware of it only when I was brought here; I
was first told of it by Mr. Whitley; I don’t
know that it was he who had me arrested; I
don’t know who had me arrested. I did not
receive a letter from any person since my
arTest; I did not. receive a written statement
from any person; I did not tell private Price,
of Company C, 16th Infantry, that I bad re
ceived any such statement; I don't know any
such a man, and 1 have never made such a.
statement to anybody. Major Whitley told
me first that I was arrested for connection
with this-transaction; I was not aware of it
before. He told me that if I knew anything
abont toe affair, L bad; better make a full
confession of it. He said it was my
duty, and proved to . ine that the evidence
against me was soffioient- He did hot bold
out any inducements to me whatever; he did
not mention any certain fact for me to testify
to. I spoke to him three or four times be
fore be said anything about tbe affair t.o me.
He made no statement to me about testifying
against anybody, but told me to state what
I knew about the matter. He told me, after
I made the confession to him, that I would
not be punished. I don't remember ibat he
made that statement to me before I made my
confession to him. I knew I could not be
placed on tbe stand and at tbe same time be
tried. I did not know that I would save
myself by making the statement I made, be
cause I did not think that my evidence would
be sufficient—I mean by the word “suffi
cient,” that my evidence might not convict
of itself. The first impression I labored un
der when I made the statement was, that it
was my dnty to do so, and on that account
I made it openly and frankly, not looking ,
forward to anything in the future.
Question—Did not Whitney tell you that he.
would guarantee you protection from all harm'
on the part of the Government ? -
Answer—He never said a woi-3*about the
Government harming me.
Qaegtioj^^ffitStP 1 * ie te ll you that he would

Answer—He told me be would guarantee md
protection. Whitley did not have any positive
control of me since my arrest, so far as I know.
I don’t know whether he had the power tq ad
mit to see me or not. There was no person
came to see me to have an interview With inf.
did have an interview with other persons be-
les W'hitely. I had an interview awhile with
1 era! Dunn and Governor Brown at the Ad
's office. I was taken there by a sentry.

the day.... j don’t know whether Whitley dame
when h* pleased, or had to get permission.—
Answer—No, 6ir.
By the Court—Had yon made

first sergeant ? >*
Answer—Yes, air. '
A diagram of the house in which Ashburn
was killed was here handed to the witness,
when he was aBked if it was a correot one
Tbe reply was in the affirmative.
By the Court—During your conversa
tions with tbe accused, (ChipleyJ after
the murder of A.,'was there anything said
to reference to said murder ? If ao. state it
Witness—There was not, sir.
By Mr. Stephens—Did Chipley say any
thing more man “good morning’’ at the
time you spoke tp him after the death of
Asbbnrn 1 j
Witness—Not as I recollect, lair.
This concluded the testimony of this wit
ness, and though there has been but very
little said on the subject, the 'truth is, he
did not look at all well, and even since
yesterday he had undergone a considerable
alteration.
TESTIMONY OF GKOBOE F. BETTS.
The examination of this party was next
taken up, and we must say that we regret
we have not space to give it to our readers.
It is, however, euougu to say that it differed
but little in substance from that of the pre
ceding witness. Both knew their business
well. We give, however, the following as a
brief synopsis, and will only add that if the
witnesses had spoken louder we could do
much better :
I was first arrested on the 1st of May; af
ter my arrest I was taken to Fort Pulaski; I
was put io charge of Captain Cook; I never
saw Mr. Whitley before till 1 got to the fort;
I have spoken to Mr. Bedell; he has a lot, 1
suppose, where he lived; I don’t know
whether it was bis or not; Mr. Duke had on
black clothes that night; tbe moon had just
gone down; I knew them when masked, be
cause I spoke to them ; I spoke to them when
we went to the house; they did not tell me
their names; Duke was not masked when I
first saw him; I don’t know whether he put
on a mask after or not; I think all the rest
weie masked; I knew them from their
talk, because I was raised up with them;
I did not know Mr. Bedell as well as
myself; I never beard him speak except
that he would shoot when he pleased on his
lot; I heard him talk, but not to me; I don’t
know who was present; I don’t think I heard
him speak often enough to be familar enough
to know his voice under a mask; I would not
say the same of Dr. Kirkscey ; I would know
him no sooner by his voice; I don’t recollect
how long I have known him—some time; I
was not raised with him; I didn’t say I was
raised with all of them, but with the biggest
part of them; I knew him some eight or nine
months, I recko n; I can’t tell how long I have
known Mr. Wood; I hare known him longer
than Kirkscey. I could swear to the best of
my knowledge that I could recognize his voice;
I don’t recollect how Wood was dressed that
night; Hudson said on our way to the house
from the vacant lot, let us give him h—11; I
knew them very well; I dont know whether
Mr. Whitley had charge of me at Fort Pu
laski or not ; I did not make any disclosures
to him at. that place; he did not make
any effort to get me to make any disclosure
—not particularly; I knew that if Iwoulddis-
cover against other parties that I would be
protected; he told me; I know bis business
from what I heard; his bnsiness is. as Gov
ernment Deteotive or agent, or something of
some kind ; I don’t recollect that he told me
that if I did not make a disclosure I would
be hung; I don’t recollect him saying to me
that the other men were men of property,
and that they would allow me to be hung,
and I had bettar save my own neck. Mr.
Daniel was under .arrest here; I never bad
any friend to come and see me; I don’t think
Whitley told of the arrest of other parties;
he did not take me and show me where Mr.
Daniel was, so as I could see him; I knew
where he was; Whitley did not tell me that
Kirkscey and Chipley had bonded Daniel
out, and would leave me to be hung; I be
lieve he told-me that Kirkscey and Chipley
had said that their money would save thein;
I-beiieve he told me that if I would eome
out and tell-everything I would not be
hurt; he did hot tell me in the presence of
my father that the baiter was round my
neck; Mr. Whitley waain the room when
my father was with me.
