The Court sat at 10 a. m.
Judge Beuniug was introduced to assist
the defence.
The testimony of the previous day was
read.
The Judge Advocate Tead the following:
Counsel lor tbe prisoners asked the Com
mission to give “orders” to Cuptain Mills,
who had in charge the testimony taken at
the Coroner’s inquest, to forward the same
to be used upon the trial now proceeding.

TESTIMONY OP AMANDA PATTERSON.
My name is Amanda Patterson; I have
lived in Columbus, Georgia, about six years;
I knew Asbburn; 1 occupied one of the
rooms; it was the second from tbe front;
A9hburo occupied tbe third room; I was in
my room the night Asbburn was killed; there
came a crowd of men to the door; they asked
the door to be opened, and Haunah said I
can't open my door this time of uight for
any person; she asked who it was, and tboy
said it was Mary Tillinghurst; she then asked
what they wauted.and they said they wanted
to see Amanda; she said they could uot see
Amanda; they then asked to see Haonah,
but she said they could uot see her, and
then they said they would burst the door
open; they then burst tbe door and came io;
when they came in one of them asked Han
nah who was io, and she said unbody except
me and her; they then weut to Ashburn’s
door and told him to open the door; he did
not do it, aDd then they commenced shoot
ing; there was no light iu any of tbe rooms
when they broke in, except what light they
brought with them; I did not see the persons
who fired at A.; I was in the front room; I
saw B innelt there that nigbi; there were no
females in the house that night but me and
Hannah Flournoy; I couid not tell how many
persons were in the front room; there were
not so many in the middle room; I was in
the middle room when they came in; there
was no body in there with me at tbe time blit
Hanuuh Flournoy; I saw Cbipley, Kirkscey,
Hudson, Barber, Betts and Duke there that
night,

They uad on masked faces. I saw one of
them without a mask; I did not know who
be was; he was a stranger to me. Bedell
lost his mask; it dropped off his face when
he wept out the front door; we had no con
versation at that time, only, as he went out
the door, he told iqu if I told who he was,
he would kill me; it took place ut night; it
was on Monday night; I do not know the
day of the month; it was between twelve
o’clock; 1 had a conversation with
Cllipley, JtLltliacey and Barber; that conver-
nation took place up over Spears'; I went
there to see Or. Moses; they were not in bis
office; they were in soother; I was spoke to
by Barber; Barber and Cbipley said to me,
“We are coming around to kill old A.,” and
I stid, “Don’t while 1 Jive here;” this was on
Tuesday, previous to the killing; they told
me if I told what they said, they would bill
me; I told them they did not kaow how to
gel iu; they said they knew how the house
was fixed; X heard Bedell and Barber speak
about killing him at another time; it-was on
the street; 1 think’it was on the Wednesday
before; it was on Broad street; Barber said
to Bedell, “We-are going to. kill old.A.”; I
had talked to Bedell a few times, but not
often; I have seen him since the killiug at
my house; he did not_say much of anything;
I did Dot stay more than about balf an hour;
there were some persons present when be
was there; he wanted me to go to his room;
he did not give me any reason why 1 should
go with hioi; I did not make him any pro
mise; be told me where bis room was; I was
sick at that time, and he asked me if I
would come when I got well. I don’t re
member haviDg any conversation with any
person except Bennett; he came to the house
and wanted me' to go away; I asked him
what he wanted me to go away for, aud h
said if I didn’t go the Ku-Klux would
me; he said if the Yankees carried us off to
prison we would die; he said he did not
want io swear anything against the men; he
said Mr. Bowers and Bedell were to furnish
the money if we wottld go away; I did not
want to go with Bedell because I was afraid
he wanted to get me down there and kill me,
lor fear I might tell something on him. \
CROSS EXAMINED BY MB. STEPHENS.
I was present at the Coroner’s inquest; I
did testify at tbe examination that 1 did uot
know them* I know Mr. McClandless; I
saw him that bight after the • death of Ash-
burn; he did not come Into m; bouse; I saw
him standing out on the stage; I never had
any conversation jvith him us to tbe persons
in the party immediately after the killing of
Asbburn; I did not speak to him that night;
l did not tell him that I did not know any
of them; I saw Ashburn’s son there that
night after his fattier was killed; be did not
ask me anything about tbe parties ; I was in
the room with him where the body was ; he
did not ask me auything about them there ;
there were some more men in the room when
Kirkscey and Cbipley aad Barber told file
they were going to kill Ashburn, but I did
not know any of them; it was not in Dr. Mo-
sea’ office I had that conversation with them;
1 do not know what day itwas that I was first-
arrested; it must be six or seven weeks since
1 was arrested; Capt. Mills bad me arrested.
1 was sent to Fort Pulaski; I was treated
mighiy 'well there; I was put in a room by
mytelt; it was a tolerable large room; Capt.
Cook Yisited me there; he never spoke to me
about this affair; tbe assassination of Ash
burn was first spoken to me about by Whit,
ley; be asked tue what I knew about the
murder; he told me twonld be iu prison
until I told about it; he did not "VAYme what
he could prove by other parties; lie new.
told me that he knew Kirkscey and Bedell,
and Ohipley, and Duke were there; he never
mentioned their names until I told him they
were there; it was. not long after my arrest
before I told him they • were there; I saw
Whitley before I came to Atlanta; 1 saw him
at Fort Pulaski; it has been near four weeks
since I came to Atlanta; he never toid me he
■would give me anything a day; I did not tell
the guard that Whitley told me he wonld
give me a certain amount of money; it was
three o'clock in the. evening wheu I heard
Bedell and Barber speak about Killing Ash-
bum; there was nobody with me a<j the timd,
but there were more men in the room; I do
not know who they were; when: I heard

My name is W. H. Stephens. I am twen
ty-two years old. I reside in Columbus,
Georgia. I have resided there about eight
years. 1 am acquainted with Dr. Kirkscey.
I have known him about seven or eight
mouths. I bad a conversation with him
about three weeks before tbe killing. I met
him on tbe street below the Court House.
He stopped me and called me to bis buggy.
He asked me could I keep a secret. I told
him of course I could; aud he said there was
a party getting up to go to a certain place,
at a Certain time, aud if I would join it he
would give me fifty dollars. I refused his
money and walked away. He then called
me back and told me, as I would uot join his
parly, to keep the secret. I was arrested ou
Tuesday, though all the rest of the party
were arrested ou Monday. When he stw
me in the Court House he told me to come
into the “Bull Pen.” I don’t remember
wbat day of the montb it was. I did not
pay any attention, because I knew I was in
nocent, aud was not dreaming aboat being
brought up as a witness. I can’t say hew
long it was after the killing of A. when I was
arrested, but it was about three weeks before
tbe election.
Cross-Examined, by Mr. Stephens—I don’t
remember what time it was I was first ar
rested; I know who was first arrested; I
know when I was first arrested; I was carried
to Fort Pulaski; I was released after my first
arrest on my bonds; I can’t tell how loug be
fore the election it was when I was at the
court house; I was arrested the second time
14th May aud carried to Fort Pulaski; Bar
ber was arrested at the same, time; 1 found
him in the court house when I got there; I
was put in a cell at Fort Pulaski; It was
about 4 by 6, and about 15 feet deep; X was
in class confinement; Captain Reed, Mayor
Whitley, and Captain Cook visited me there;
I was not told wbat I was arrested for; I was
asked if I knew anything about the Asbburn
affair; that was shortly after X got to Fort
Pulaski; I told them I knew nothing; nobody
udopted any course to compel me to answer;
I got Government rations, and was confined
to a cell; I was not told that I would be
kept iu close confinement until I did tell; I
never made any disclosure there; I made it
at McPheison Barrack;; I might have said
some tew words about it, but X did not make
any confession; I was removed from tbe first
cell 1 was put in; I was put into another cell
on the opposite side; there was no change io
my personal condition ; I think the
reason I was changed was, that they
wanted to pat one of the freedmen in the
cell I was in; I was not put in an en
closed box; mere was no restraint put
over my person—my limbs; I received
two letters with my mother’s name sighed
to them; X wonld not be positive who de
livered them to me—it was either Whitley
or Capt. Reed. I did not get a letter telling
me that Kirkscey, Cbipley, Bedell, and the
others bad confessed; I did not get a letter
from anybody telling me that their money
would save them, aud 1 should take care of
myself; with the exception that the officers
were taking mv letters and brought them to
me, of course I could not get tnem other
wise; I did not make any affidavit before
any person in Savannah or Fort Pulaski; X
made one here beloxo Major wuiUoy and
another person; the substance of that was
wbat I have spoken here; I considered that
affidavit binding; I did not ask anybody if
an affidavit made before a Quartermaster
was binding; I asked Jim Barber do you
know anything about law; he said “no;” X
merely asked him it a man made an affida
vit without going before a court of justice,
would it be binding; he said no; I did not
say to him then, “then Jim all right’’ nor
nothing to that effect; i don’t know whether
any person ever heard me speak to Dr.
Kirkscey or he to me; he is a rich man and
X am a poor man.
Re-direct Examination—When I was

il live at Columbus. I was at Mr. Chaffin's
store on the Thursday after Asbburn was
killed. I saw Dr. Kirkscey, Bedell, and
Chipley. They spoke to me, aud asked me
if 1 beard Bennett say that he was behind
the door that night or not. I told them I
beard him. say he was. Then Dr. Kirkscey
said il I knew that, the Ku-Klux would fix
him. ,He-asked me if Mr.' Bostwick was
going to arrest anybody, and if he was to let
him know. 1 told him I would. 'It 1 was
Kirkscey who first made the remark about
tbe Ku K'ux. Dr. Kirkscey touched one of
the crowd to Slop him while they were talk
ing. He touched Bedell. Bedell was say
ing to me to find out whether Geu. Meade
was coming down here or not, and to let him
know. Mr. Bostwick first spoke to me about
swearing in'the case, Mr. Moses threatened
me if I swore in tbe ease—young lawyer
Moses. He said to me, “ If they want yon
(ora witness don’t you do it; or if you'do,
these men will kill yon; and if they don't do
it, 1 will.” I don’t know his Dame. 1 know
his father. He is a lawyer. They are part
ners in the same law office. I don’t know
what his father’s name is. There are no
lawyers in Columbus named Moses but these
two that I know of.
CROSS-EXAMINED BY MB. STEPHENS,
The conversation took place at Mr. Chaf
fin's store; it was about an hour by sun; the
store is ou tbe right baud side going down ;
X have been sworn in this case before; I
swore that B. stwick offered me S100 if I
would swear wbat Barber and George Batts
said lo Hinry Kimbrough; I did not take
tbe money; X didn’t tell Mr. Bostick that
George Ashburn, son of deceased, offered
me $150 if I wonld swear wbat George Belts
and Jim Batber were swearing; X told him I
did not care about the money, X just wanted
the right thiug; I did not expect it, but said
if he had a mind to give it, he could do it;
Mr. Bostick did not offer me $100; I came
here on Tuesday; I was sent here by Cap
tain Mills; as I was passing by he called me,
and told me not to get out of the way, that
he wanted me lo go to Atlanta; it was Mr.
Bostick told Captain Mills about me; Mr.
Bostick is tbe man that issued tbe warrants
for the arrest of those parties, so they say;
these questions asked me to-day were read
over to me before—once; they were read by
Bostick; young Asbburu did not offer me
the money; I did not tell Mr. Williams that
he did, <fce.; be did cot offer it lo me; he told
me I would get that much; I told her so,
but I did Dot swear it. [Laughter.] He
did not ask me to swear, but to
stand to my word; that I would get it.

have asked me some questions that he did
uot ask me; Mr. Moses did not get me to
swear anything; he did not draw iip a,paper,
and.get me to swear to it; be just drew up
what X told him; he read it for me after he
wrote it; I cannot read; X was not aware
that I was swearing lo that paper; bis lather
gave me a three dollar bill for telling him
wbat he wrote down; Mrs. Williams sent
me to him.

which, upon a vote being takeu, was lost.

TESTIMONY OF SALLY BEDELL.
I live in Columbus; I was at Norab Win
ters’; I saw Mr. Wiggins and Mr. Wood
there that night. [Identified Wiggins and
Wood ] I dOD’t know exactly wbat time of
the night it was; it was after supper; Wig
gins had a masquerade suit; he didn’t say
what he was going to d 0 with it; he said
there were thirty of them going oqt that
night; be said to Aunt Norab Winters; when
first left the house they said they were going
down to Temperance Hall to the speaking
that was there thatnight; Mr. Wiggins came
back after they went to the speaking and
went to bed; it was after the speaking was at
the hall; I don’t know wbat tim e it was; the
mask suit was laying on the chair when he
went to bed; he went to bed in N’orah’sroom;
I saw him again that night after he went to
bed; I don’t know what time it was; he was
in the room when I saw him; he was in bed;
I saw him come in from out-doors; I don’t,

say, they will do in spite of men and hell;"

not;” be was a drunken maD, and I did not
pay much attention to him at all; it was on
Monday evening, in the neighborhood of
sonset; it was next morning I heard of Ash-
born being killed.

was a Republican. I don’t think he is a
very aciive politician; I was not very active
in politics, but was most determined in prin
ciples; I supposed Mr. Barber to be about

in a condition to know what he was doing,
according to my judgment.

I did not have to help him out of the Wagon.
