Court met pursuant to adjournment-
The testimony of Mrs. J. B. Moore
of Edward Shepherd was read id their near
ing by the Judge Advocate. •mbmiHu;
Moore made the following.correotion«,to-
wit: Instead of saying occarfon^I meant
to say that my sister, Mrs. -Kuhscey, levari
ably sent for some member of ihn famtry to
come and stay with her when the doctor was
absent. I meant to say that we were not de
lighted to hear of the death of Radicals, but
only such men as Ashbum, who was trying
to excite negroes to insurrection and deeds
of violence against their former owners.

The night of A.’s murder, I was staying at
Colonel Shepherd’s. Col. Shepherd’s family
—no one else—was staying in the honsewilh
me; my sister was there; I know whether
Dr. K. was at home that bight; I-had a sick
headache, and was awake nearly hll night;
did not hear any one come in or go out of
the house that night; three other members of
the family were sick also that night—Mrs.
Moote, Dr. Kirfcscey’s baby and Eddie Sbep-
. herd; Eddie had tuotbaclie. Dr. K.’s baby
the croup, Mrs. Moore a nervous headache;
I occupied the room with Mrs. Moore.

What time of night did the family eat sup
per that night ?
Answer—Some time afeer dark. It was in
the latter part of March; don’t remember the
day of the month, nor what time dark comes
in the latter part of March; it comes earlier
in March than in July; don’t know what time
of night it was; Col. Shepherd and bis fam
ily,'Dr. K.. myself and Bister Mattie were
present at supper that night; Edward Shep
herd and Mrs. Moore were there; Mrs. Moore
took some coffee—so did I—nothing else;
don’t remember of Eddie's tating anything
at table; they were all there bnt him; don’t
remember what Dr. K. eat for supper
After supper I went into Mrs. Moore’s
room ; I s'e -p with Mrs. Moore ; I retired
very.late that night, having a sick headache;
when very sick I sometimes lie down on the
bed ; on that night 1 think Ilaid down about
II o’clock, but did not go to sleep tili near
day ; Mrs. Moore and 'myself slept on the
same bed it was nearly day when she went
to sleep ; she went to sleep before I did—not
very loag before ; she had been to sleep once
and waked up again ;-it Was nearly day be
fore she went to sleep:; cannot teU exactly
when she went to sleep first; It was some
time after I went to bed, about 2j Hours, I
think ; she did not sleep very long ; when
she woke she called Wooddie to go to Dr.
E's room to get medicine for her ; Wooddie
was in the next room to ours ; after Wood-
die came back with the medicine she sat on.

as two hours ; about an ‘hour, I reckon ;
Wooddie then went to her room ; did not
see her anymore that night; before A.’s
death 1 had been staying at Col. Shepherd’s
three months; during this time Dr. E was
not oat often at night ; recollect no instance;
he had calts trom patients at night occasion
ally ; he went very often; he was then out
at night.
I was innocent in saying that he was not
out at night during the three months; do not
remember whether his calls at night were
frequent or not; remember no call in partic-
nlai; do not think I am mistaken when I
said be had calls at night; Mrs. Shepherd
was usually at home; she would have known
if the doctor had been called to patients at
night; Edward was usually there at night;
he would have known it; Mrs. Moore was
usually there; she also would have known it;
I believe Dr. K. sometimes went out at night
to attend the meetings of the Masonic frater
nity; do not remember that he went at night
to- attend the Democratic Clnb; he
usually went in his buggy at Dighl. I heard
of A.’s death next morning ; was at Colonel
Shepherd’s in the second'room on the right
hand of the hail; Mrs. Moore’s room; don’t
remember who told me; I think a servant
came in and told Mrs. Moore: Miss Wooddie
Was off studying; don’t know where she was;
don’t remember now wtetber it was before
or after breakfast. I have not talked with
Mrs. Moore in the last 24 hours of where-
Miss Wooddie was at that time; have not
read any of Mrs. Moore’s testimony; not
heard it read, or anybody speak of it. Mrs.
Moore, Mrs. Shepherd, Miss Wooddie and
myself are slaying at the same house.
Since the Court adjourned yesterday I have
heard no conversation about what Mrs.
Moore or Miss Wooddie stated in their
testimony; have heard a good deal of talk
about how Mias Wooddie acted in the court
room; heard nothing of what she or Mrs.
Moore said in their testimony. When I first
heard of A.’s death, Edward Shepherd was
at school, I believe; don’t remember wbat
time the family took dinner—about 1 o'clock;
don’t remember whether or not Miss Wood
die was at dinner that day; I first saw her
some time dating the day wo heard of Ash-
barn’s death.
When they first commanced making the
arrests of the young men belonging to the
Democratic Club 1 first heard it discussed
about where Dr. E. was when A. was killed;
when they arrested Dr. E. and put him in
the Court House,, then we located where he
was that night; found he was home; don’t
remember whan-the doctor was arrested;
when I say the young men of the Demo
cratic Club, I mean all who were arrested
and belonged to the Club; I am net acquaint
ed with any of them except Dr. E; I heard
that those arrested belonged to the Demo
cratic Club. .

Section 1 Be it ordained by the Ma^6r and Alder
men of the city of Savannah and the hamlets thereof,
in Council assembled, and It ia hereby ordained by
the authorltyiof the same, that from and immediate
ly after the passing of this Ordinance, it shall not be
lawful f jr any peison to tie or cause to be tied any
boil, cow, ox, calf, or other description of cattle, to
any tree, fence, stake or other fastening* in any street
or otherpnbltoplaca in said city where; under exist
ing Ordinance or Ordinances, each animals are pro
hibited from running at large, or m the Military Pa*
rade Ground (now Forsyth Place extended).
Section 2. And be It further ordained by the au
thority aforesaid. That no bull, cow or calf, or other
descripflon of cattle, shall be petmlttod to enter the
enclosure of or he at large in the Military Parade
Ground (now Forsyth PI ape extended^, and that any
person violating any partoi this or the preceding Sec
tion, shall, on conviction, be fined in a sum »ot ex
ceeding five dollars for every soch offence; and it
shall, moreover, be the duty of the omcers and pri
vates of the Police lorce to impound every such ani
mal so tied or going at large as aforesaid, and ibe
same proceedings shall be had, and the same roles
sh«ll govern, as are prescribed in other cases of Im
pounding cattle running at large,

vannah, iu Council assembled, do hereby ordain:
That trom and after the passage of ibis ordinance the
rutes of fare for the conveyance of any passenger and
hie or her baggage from any point in said city to any
other point lu the same, by any c»b, hack, carnage,
omnibus, or other vehicle, ebail be fifty cents ami no
more; provided always that where the baggage or
any passenger shall exceed one hundred pounds In
weight an extra charge of not more than twenty-five
cents for each addilloosl piece sbaU be allowed, and
may be received for conv.yiog suen excsss of bag
gage; and provided also, that only one-self said rates
ihiUba allowed for carrying cbUdren under twelve

To authorize C. Y. Hutchins to erect one bnildiog on

plan and in the manner in this Ordinance Epoch

Section 1st. The Mayor and Aldeimen of the city of
Savann-ih, in Council assembled, do hereby ordain,
That permission is hereby given to 0. V. Hutchins
to put up and erect on the ?ot So. thirty-one (31), ua1-
houn Waid, city of Savannah, a building of the plan,
dimensions and materials herein mentioned, that is
to say : said building to have a front of not more
than twenty-five feet oy thirty-five feet depth, with a
height of thirty-two feet from tha foundation to the
roof, including a brick basemenc; the first and
second floors of each building miy be framed in lum
ber, ana the spaces between the timbers, except the
usual oj enings, shall ba tilled with brics ; the exte
rior of such building shall bj covered with strong
m, rtar finished with hydraulic cement, and the roof
shall be covered with tin.
Section sd, And it ia farther ordained, by the au
thority aforesaid, >That on complying with the fore
going requirements in regard to snch building the
said O. V. Hutchins shall not be liable or subject to
any penalty prescribed by any Ordinance ot said city
against the.erection of buildings within the fire limit
of said city.

AN ORDINANCE
To prevent the encroachment, by vessels lying at
certain Cotton Presses In Savannah, upon the
lines of anv other adjacent Presses.
Section 1. The Mayor and Aldermen of the city 01
Savannah, in Council assembled, do hereby ordain,
That hereafter no vessels lying, loading, or discharg
ing at the wharf of either of the Cotton Presses
known as Demund's Lower Cotton Press, or the Cot
ton Press known as the Tyler Cotton Press, shall be
permitted to encroach by bowsprit or other part ol
the vessel on the line of the wharf of the other Press
at which said vessel may not belying, loading or dis
charging, without the consent of the agent or own
ers of such other Pres*, and that it is hereby made
the duty of the Harbor Master to prevent any sneb
encroachment without consent os aforesaid; and that
for a violation of any of the provisions of this ordi
nance, the party in fonlt, whether snch party be own
ers or agents or any such Press, or the Harbor Mas
ter, shall be liable to a penally of not more than
thirty dollars for every day's or part of a day’s de
fault.

tbe Board of Health, a list of the said Board for
1858 is published for information of cuizens and
householders, and attention is colled to tbe following
extracts from City Ordinance ;

(2.) It 3hall be the daty of said Board to visit and
inspect each and every lot, euclosute and yard in
their respective wards, and where any tilth or un
wholesome collections may be found, the same to
have immediately removed by information to tbe
Marshal or City Scavenger, whose auty it shall be to
Immediately attend to such iniormation, and to have
the owner or occnptcr of soch lot, cucloauie or yard,
summoned before ihe next council therealter. to an-
ewer for such neglect. And any person who shall
refuse admittance to any member of ssid Board t«
visit and inspect such lot, enclosure or yard shall, on
conviction thereof be Sued a sum not exceeding
thirty dollars.
(3 j It shall be the duty of said Board to report all
flltu or unwholesome collections that may be found
in any street, lane or wnarf, to the Mayor, whose
daty it sbaU be to hava the same immediately re
moved by the proper officer.
