I reside in Carroll. I was at Mr. Duk63’

or Wednesday. Mr. Dnkes was there at the
time. I went there on the Sunday, before.
I stayed there four days.. iTha accused was
tbere at his father’s when I reached, there.
He was tbere in the bouse on Sunday night,
ftnow where he slept.- I slept with him.
He was there Monday night. He slept with
me. We slept in the house . there. His
’ mother and father, and some of his asters,

Cross-examined by Vho. Judge Advocate—
i am a. man of family. I reside about forty-
three miles from Duke’s house. I rode there.
I hid no business only to go on a visit. It
took me about a'day and a piece to get there.
I don’t recollect exactly what sort of weather
we had at the time. I left home on-Satur-
day. I don’t remember whether it- rained
on Saturday or Monday while I was travel
ing I got there about two hours by sua or
little more than that. There was no person
with me on my journey. When I arrived at
the house, I found the family there., William
Duke was at home whea l arrived’. Be was
sitting before tbe fire. The weather wasn’t
cold. On Monday I was at the blacksmith
shop nearly all day. His negro men ; and
one of Dnke’s brothers were there. His fa-,
ther came - home from Columbus the day L,
got there. He was there on Monday too. I
was there a part of the day and at' tbe house
part of the day. I don’t know exactly what
time I retired' io bed—they did’nt have aDy
time-piece. I judge it was somewhere be
tween 9 ancf 10 o’clock. I think there were
three beds in the room in which I. slept.
The bed in which I slept was ia the back
r irt o'f’the room. It was a pretty large, room.
think there are three doors to it.' Thw
front door faced tbe big road, south, I think.
Tbe bed was to tke fight in referencelto the
front door ;'I don’t know whether the bed.
was against tbe wall or not ; I did not notice;
it was at the end of the house when I enter

other beds were in the other end of the room,
