Rdsawat and Smash-up.—A horse at
tached to a floe buggy ran away yesterday on Aber-
corn street. Turning suddenly into South Broad
street, the bag;y struck against a tree box, smashing
it to pieces and in jarlog the buggy considerably.
A Tall Stalk of Rice.—A stalk of rice
vas brongat to onr office yesterday from the planta
tion of Jfr. B. Bourquia, on the Little Ogeechce
Tim, which measures clear of root six feet seven
and a hair inches to the top of the ear. The stalk is
Urge in proportion and sufficiently strong to sap-
port the ear which, when mature, would, perhaps,
add an inch or two to its height.
We learn tnat the rice crops on the Ogeechee rivers
promise an excellent yield this seasou.
Writ of Habeas Corpus Issued.—Upon the
petition of Dolly Sheftall, through her counsel, B.
Wayne Bussell, Esq, she claiming that she is illegal
ly confined in the county jail for assault and battery,
hiving offered bail. Judge Fleming yesterday after
noon issued a writ of habeas corpus returnable at
twelre o’clock M. to-day.
Ordinary of Chatham County.—Yesterday
Nr. Henry S. Wetmore, Ordinary elect of Chatham
county, qualified before Justice L M. Marsh, and
gave bond in the sum of one thousand dollars. Dr. J*
J. Waring and Messrs. Alex. M. Wilson and Frank S
Hesseltine aecurlty. Mr. Wetmore then took charge
of the Ordinary’* office, giving Judge O’Byrne, la a
Ordinary, a receipt for all books, papers, &c., of tha
office.
We learn that the other officers will qualify to-day

Song,” ia the lecture room of the Trinity (Methodist)
Ohnrch, at 8 o’clock to-night. The proceeds whl be
devoted to the education of indigent girls. The
object Is most praiseworthy and the lecture shoald be
well attended.

jc Mancipation,
Below We publish a decision by Bis Hdnof Judge
Wearing; founded on the following facts; Isaac Perry,
a citizen of Bryan county, made his wDl June 1,1865,
anddied Jane 17,1885, and by said will left to Jane
Perry, a peiBon of color and a former faithful servant,
the bulk of his properly. The complainants, Little-
berry Daniels and his wife, filed their bill In equity
to compel the executor to account to them as dis
tributees at law of the said lease Perry, for the pro
perty so devised and bequeathed to Jane Perry, al
ledging that the devisee, Jane Perry, could not take
the property, inasmuch as she was a slave at the time
of the making df the will and the death of the testator,
and that the devise was therefore noli and void. To
this bill a demurrer was filed, and. the decision below
instates the domurr.r:

The single question mode by the Demurrer in this
cose is has the Legatee and Devisee, Jane Perry, le
gal capacity to take under the will? It la contended
lUat the has not, because at the time the will was ex
ecuted, and at the time of Testator’s death the said
Jane Perry was a slave. The will was exeenUd Jane
i, 1865, and Testator died June 17. 1865.
It is not, In my judgment, necessary to decide it
Jane Perry had been legaUy and constitutionally made
free. In regard to that there may be a difference of
opinion* but-no one con doubt that in point of fact
she was free. The Federal Government had so de
clared, and made good the declaration by tbs power
of the bayonet. The Convention of tho State of
Georgia alterwarda recognized emancipation aa an
existing fact. It did not undertake itself to imanci-
pate, so that emancipation takes its date not from the
ordinance of the Convention, hot from the day that
Federal power prevailed over the length and breadth
of the Confederacy. Jane Perry waa then a free per
son, both when the will waa executed and when the
Testator died, and as each bad capacity to taka under
the will. The Demnrrer is sustained.

Stephen Sbelly, a North Carolina negro, who had
been in this city about three weeks, doing nothing
in partlcnlar.as be Bays, only a little chicken trading,
was arrcs.ed for stealing money from Charles Sum
mers, an old country negro. Charles made his state
ment la his peculiar country lingo, some parts of
which provoked, laughter lrom tne spectators, and
caused even the'ofilcera of the Court to relax their
usual stem appearance. From the rambling though
evident y earnest evidehce given byhlm, we gathered
that defendant was une of those nuisances who hang
around boat landings and other places to pick op
their unsophisticated brethren from the Interior. Ue
flrjt hailed Charles to know if he wanted to bay
some bacon, promising to sell It to him cheap, and
thereupon InvUgled him into a bsokyaid, where he
went to work at some Sleight-of-hand tricks with a
leather strap, ending in the simple counlrymaa
showing all the money he had about him, which Ste
phen grabbed and made off with, closely fjllowel by
bis victim, who called “catch thief,’’ lill he was
atopped. Defendant attempted an explanation, which
waa a very lame one, ratner c mflrming nls guilr.and
the Mayor imposed a fine of twenty dollars or thirty
days labor ou the streets.
William Anderson and Anthony Lovell, two ne
groes, appeared to answer to the charge of having
railroad iron in their possession, anoposed to have
been stolen. A policeman arrested them about nine
o'clock on Saturday night, just above Exchange
Dock. Oae man who was in the boat with them, bid
gat ont on tne dock and ran off when he aaw the offi
cer coming. Each one said that they had been hired
by some man, whom they did not know, to take this
iron from a fist near Miller's foundry up to Exchange
Dock. They were committed until farther investi
gation could be had by the agent of the railroad from
which it is supposed the Iron wss stolen.
Allen Williams, colored, waa ordered to pay a fine
of three doUars, or serve ten days on the public
works, for being drunk and lying in the street at half
past eleven o’clock on Saturday night.
Sam Johnson, a herculean negro, gut so much bad
liquor on board Saturday night that he spread him-
selt all across the street, and it teqnlred the utmost
exertions of a policeman and two cltiz3ns to get him
to the barracks. He waa sentenced to four dollars or
twelve (leys work on the streets.
The next name called waa that of Lizzie Cambell, In
answer to which a young mulatto walked up with a
very fl ranting and defiant manner. She waa charged
with cursing and abasing another girl at nine o'clock
on Sunday night. The prosecutrix and another one
testified to the effeoco, bat defendant brought ap a
witness to prove tnat the first provocation waa given
by the prosecutrix. The evidence showed that it waa
a sort of pot and kettle affair, and his Honor seemed
at one time inclined to dismiss the whole affair, with
an admonition to all parties, bnt It was proved that
defendant usad very profane and abusive language
after befog arrested, much to the annoyance of ladles
passing along the streets, and also to families sitting
at their windows. She was 1st off with a fins of eigh>
dollars, In default of payment to be sent to the
jail for twenty days. This girl is from Charleston,
and though bat a short time la the city, has already
become notorious for her Impudent conduct and pro
fane language.
A negro named Mingo Haywood was charged by
Jerry Webb, a brother African, with attempting to
shoot him in the street at 8 o’clock ou Sunday morn
ing. Jerry swore to a state of facts which showed a
very bad-neert In Mingo, In which he was corrobo
rated byrm negro woman and hoy. When Mingo vflH
asked what he had to say in his defence, he made a
statement In a very earnest manner, saying that
Jerry advanced on him with a rook, and struck him
twice in the breast. He declared solemaly that hia
finger was not near the trigger of the pistol, and be
had not the slightest idea how It ooold have gone off
ao near Jerry’s head aa to bom the side of his fooe.
He said also that the pistol belonged to bla- little
brother and was only accidental y io his pocket, and
moreover it had nothing bnt powder in It. Perhaps
this was all true, but when he was searched at the
barracks a package of powder and another of balls
or the siz s to fit the pistol, were fonad In his pockets.
His employer testified to his good character, and
ha got off with the light fine of four dollars.
Savannah Hebrew Collegiate Institute.
The second annuil session of this institution will
commence on the first Monday In October and con
tinue until the last Friday in July nex'.
The Institute being Intended for tbe education of
the youth Of both sexes, the departments, as at
present organized, are as folows: A High School for
Boya; an Academy lor Girls. In the school, pnpils
are prepared either for the requirements of com
mercial life, or for the more advanced classes of a
collegiate course. In the Aeademy, pupils will ac
quire a finished English education, together wtth a
practical knowledge of such of the modern languages
aa may be deemed advisable; in both departments,
the stady or Hebrew, will, In the education of Jewish
chlldrent, form a principal feature.
In the education of the moral sentiments, the In
stitute proposes, that no sectarian creed shall form a
tare in the general system of education, bnt the at
tention of the pupils will be directed to the grander
and sublimer truths held In common by all reli
gions sects, To Jewish children, however, thorough
instruction In the tenets of Judaism, will be imparted
at sptctalbonra. In the discipline of the school, the
Council and Facility are of the opinion that persua
sion being more powerful than fear, kindness with
decision will exert a more salntaty influence than
corporeal punishment. They mast, however, reserve
the right of dismissing any pnpll who, by continued
bad conduct, might so la,ure the discipline, aa to
seriously affect the interests of the Institata. |
In order to Increase the otefnlnesa of the Inst.tnta,
by affording to parents residing ont of the city or
State an opportunity of having their children thor
oughly educated, the Council have made arrange
ments with the Bev. B. Fisher, teacher of Hebrew
and Theology, whereby he will take charge of a lim
ited number of children at his own home. Under
the care of the Bev. Mr. Fisher the morals and gen
eral conduct of the children wlD receive especial at
tention. while every means will be adopted to secara
their personal comfort.

no white person nett, otherwise this outrage would
not have occurred. We have been Informed of
several similar occurrences, hut these insolent
wretches always await an opportunity when no white
man is near. Instead of the thousand and one so-
called negro ministers dabbling to Radical politics
they had better devote their span time to civilizing
their semi-barbarlous followers, and thereby save
them from the retribution that otherwise is sore to
come upon them before many ye&rt.

Financial.—The plethora of money has continued
to such a degree that the introduction of new leans
and the requirements lor harvest purposes have made
no impression upon the loanable cspltsL The state
of the money market Indicates great contraction of
commercial enterprise, and it is feared that tho effects
of the disutroas panic yesr of 1866 were too deeply
seated to be completely effaced this year, even If the
most abundant wheat harvest ever known be safely
secured.
Cotton.—The cotton market opened on Friday, the
commencement of the official week ending tbe 9th
July, with a check to foe previous downward move
ment of prices, wnlch gradually hardened as the week
progressed, great efforts having been made by holders
to bolster np the vatne or cotton; nevertheless, they
only succeeded to the extent of >fd $1 to. The un
dercurrent, however, bad not improved, snd the
market closed lifeless and weak. Middling uplands
lljqd and mlddltug Orleans 11)4d ft ft. 'me aggre
gate sales were 70,85(1 bales, and the stock decreased
21,310 bales.
The cotton market during the official week ending
the 16tb Jnty was to a very unsatltfoctory state, bay-

considerable degree of apprehension respecting tbe
future course of tbe trade. Quotations were reduoed
