the 28th, the Collector of Customs seized the schooner
and the old irani claiming the latter as the property
of the Government, hnd-oharged Captain Fitzgerald
with wrecking without a license and • telling from a
Wreck derelict. Captain Fi tzgerald offered to libel the
q!4 iron, or.toput it uhore.disclalmlng any intention
to defrand the Government, or to commit a wrong
ful act. On tho' lit of September, Capt. Fitzgerald waa
arrested on a warrant issued by a U. S. Commission
er, on complaint, tor stealing from awreck and wreck
ing withont a license. After a foil and complete ex
amination before said Commissioner, be was dis
charged, there being no proof of intention to defrand
the Government, and there being no offence or pen
alty fori wrecking without a license. On the 3d of
September, Captain Fitzgerald, mate, and crew filed
a protest in the CoUeotor’a offios against the unlaw
ful seizure and detention of hla vessel and demanded
its release. On the 4th of September, be abandoned
the schooner and cargo with the crew, and gave writ-
ton notice of the same. On the 4th of September,
after the abandonment, a libel was filed in the United
8tates Court by the Aoting United States District At
torney, surging that the old iron waa "Imported” by
the schooner "Mafl;" that no entry was made yet at
the Customs, and that it was smuggled into this port
by said schooner, and the vessel and cargo was taken
possession of by the United States Marshal.
We learn' that parties who are acquainted with the
facts and who'are fully competent to judge in the
premises, assert that the whole affair on the part of
the Government authorities was not only .only illegal,
bat. Is fact, a gross outrage upon C iptain Fitzgerald.

Attempt at Robbery' by Negroes—,One
op them Shot,—Ahont four o’clock
morning the. watchman employed at the
Messrs. B. & J. La Chilean, while on duty about
premises heard a noise ip the yard, and on search
ing discovered two negroes, who had scaled the
tence ior the: purpose of-stealing. '.The watchman;
who was armed with a large horseman pistol, dis
charged H at one. of the negroes, snd & fa thought,'
from his close proximity,'that the whole of. the con
tents (nine back-shot) mast have struck him, as he
immediately ielL The watchman then went‘to the
office to reload his pistol, when the other,, negroas-
alsted by two more from the outside managed to
the negro who had been shot across the fence, and.
carried him offr" 1 The negro who was shot, must be
badly Injured,,if ho was not killed, as tl
adjacent to where he fell, and the side of the* fence
where he was carried over is all bespattered ■ with
blood. Search was made yesterday for tho parties,
hot up to last evening no cine of their whereabouts
could be ascertained. The watchlnah might.'Lave
arrested tbe negro who, remained in the. yard after
the other waa shot, but being fearful of an attack
from him and other negroes who were op the> outside
of the fence, he went to reload hla pistol, and by
this means they managed to eerupe with the wounded
negro.

ower, was seized at St. Augustine, and Captain
Fitzgerald arrested for alleged fraud. He was taken
before the United States Commissioner, when the
following facta were elicited:
On the 2*2d of August Captain Fitzgerald took on
board his schooner a quantity of old Iron from a rot
ten wreck' bn the' ocean beach near Matanzis Inlet,
ten. miles south rdf St. Augustine, which had lain
there about two years. Oathe 23d, the sohoonerTe-
turnedto St. Augaatine, and on the 24th, Captain
Fitzgerald entered the old iron at the Cos tom House
on a coastwise manifest, and obtained a clearance for
brokers, which will be found in our advertising col
umns this morning. The advent of this new first
from the West is another evidence of the growing
importance and great advantages of Savannah aa a
cotton mart. * .* ._
Tbe Selma (Ala.) Times and Messenger, noticing
the contemplated removal of Messrs. Henley Jb Co.,
to this city, says: ^ ’

another column, we can scarcely doubt that they
have acted wisely. These gentlemen are well
known here. They are gentlemen of high character,
of great energy and ot long and varied experience
Captain McConnlco will remain here. We commend
Messrs. Peters and Henley to the press and the busi
ness public of Ssvannah.”
Recovery of Stolen Goods.—Officer Oli
veira, while conveying the negro Thomae Jackson to
jail yesterday morning, learned from him the where
abouts of 8everal stolen articles which ha had stolen
at various times and dispose! of On his return from
jail officer Oliveira procured a search warrant from
Justice Hart and proceeded to dwellings and stores
in different parts of the city, and succeeded in recov
ering several silver spoons and forks, a gold pen,
several jars recently contain lug preserves, and a
merschaum pipe valued at fiity dollars. He expected
to recover some other stolen articles last night.
Daring. Borglary — Arrest of the
Thief.—About one o'clock yesterday morning the
residence of W. T. Burch, on the north eide of
Bronghton, between Bull and Drayton streets, was
burglariously entered by a negro boy named Thomas
Jackson. The negro.flrst effected an entrance from
the front piazm, through one of the windows in the
second story of the building. He then proceeded
through the parlor and dining-room, then into tbe
pantry, where he helped himself freely to ita con-
. After having satisfied his appetite, he : re
turned to the piazza and climbed up on the shed, and
entered the bed-room of Mr. Bnrch, through an open
window, the blinds being drawn together, but un
fastened. On entering the bed-room bis first pro
ceeding was to put on a suit of woolen clothing which
he took from a trunk; be then hang a coat, two poire
ol p ints and a veat.on the outside of the window, so
as to have them convenient when l eady to depart.
After securing the clothing, as he thought, he pro
ceeded to ransack the room in general, when Mr.
Bnrch'e wife was awakened by the noise snd informed
OBband that there was some person in the room.
Mrs. Bnrch then arose, struck a light, and discov
ered the negro under the bed. Mr. Burch fired at
him, bat the bell missed him. The negro then ran
into a corner, where he was captured by Mr. Burch,
who used his fist so extensively on him as to require
the services of a physician. After the capture of the
negro, a gold watoh aLd chain, besides several arti
cles of ladles'wearing, lipoareh were fonnd near the
window, and it is supposed that he was about making
his retreat when the timely alarm ot Mrs. Bnrch
canned his arrest.
Policeman Archibald, being in the vicinity at the
time and hearing the report, of the plBtol, proceeded
to the house, where he learned the facta of the case
took charge of the prisoner,

legs, which he had rolled op In order to make a bet
ter fit or (ogive him more agility in case of pursuit.
A bunch of keys of various Blzes was also fonnd in
issession. The money bad been taken from Mr.
Burch’s pocket, and several of the keys Le recognised
as his own, having missed them some time since,
when this negro boy waa in his employment. A pre
vious robbery had been committed in the same boose
a short time since,' which the negro alleges to have
been done i>y him, having yesterday informed the
policeman where some ot-the articles previously
stolen conld be fonnd.
It is evident that this negro, though young in j ears,
is old in crime, and must be a part and parcel of the
band cf negro thieves who now infest our city.
A robbery was committed a short time slice, in
which -the thief effected an entrance by ascending to
the top.ofthe building, audthn going down through

heretofore reported ashore, has gone to pieces. The
crew were saved.
San Francisco, September 9—The schr A J Burr
waa sank off Farmlone Island. The crew waa saved
in her small boats, after having endured great hard
ships. The Italian bark arregnedillo went ashore
below the Cliff House, and was abandoned to the un
derwriters. she was insured in Genoa.
