O N reading nnd filing the petilinn of tho Trustees
of the University of Georgia, for the use of the
Central Bank of Georgia, it appeara that Caleb Barton,
heretofore, to wit ■ On the Twenty-eighth day of May
Eighteen Hundred and sixteen, made, execuiod and
delivered to flic petitioners, his entirs Deed of Mort
gage, bearing dale tho dny and year aforesaid, by
which mortgage a certain Lot or nereel of Land, situ
ate, lying and living in tho Five Thousand Acre Tract
ofl.and tn the rminty and State aforesaid, on the wa
ters of Shoal Creek, enntoining one Hundred Acres,
more or less, known and distinguished by a lute re-sur
vey in the Five Thousand Acre Tract as aforesaid, by
No. 13, was conveyed to tho petitioners for the b-ttrr
scouring the payment of a certain Bond, made by the
said Caleb, M illiani Cawthon and Adam Loony, bear
ing even date with said moitgage, and payable to vour
petitioners, lor the sum of Eight Hundred and Forty
Dollars,conditioned (ortho pav-nent of Four Hundred
and Twenty Dollars, in the manner (ollnwing, to wt*:
the sum of nne Hundred and Five Dollars to be paid on
Ihe twentv-fifth of December, Eighteen Hundred and
seventeen; toe further sum of money list aforesaid, on
the Iwcnty-fiftbof December next, thereafter following;
the further aura of money last aforesaid, on the tw enty-
fifth of December next, thereafter, following, and the
further sum of money last aforesaid ; the residue, on
the 25th of Decemhe-, Eighteen Hundred and twenty.
And it further appearing that there i* now due nn said
Bond und mortgage, the sum oftivo llundrrdand Fifty
five Dollars nnd fiirty-five cents of the principal, with
interest thereon from the twentieth of October, Eigh
teen Hundred nnd twenty-three. On motion ofcoun.
cil for said petitioner, Ilia ordered by the Court, that
unless Ihe a iiountof the principal, interest and costs,
due on said Bond and mortgage be paid into the Clerk’s
