part of Lots v«. 152 and 153, in the 11th District of
Hill county, lying on Ches*atee River: levied oh ns
the properly of Henry Hinkle, to satisfy a fi. fa. issued
from a Justice’s Court in favnr of William Tedder, vs.
5*id Hinkle. Levy made and returned to me by a
nte, lying nnd being in the Five Thousand Acre Tract
of Land m the county and State aforesaid, on the wa
ters of Shoal Creek, containing one Hundred Ac res
more or less, known and distinguished by a late re-sur
vey in the Five Thousand Acre Tract a« aforesaid, by
No. 13, was conveyed to the petitioners for the belt* r
securing the payment of a certain Rond, made by the
said Caleb, Mjlliam Cawthon ond Adam Loony, bear
ing even date with said mortgage, anil payable to your
petitioners, for the sum of Eight Hundred and Forty
Dollars,conditioned for the payment of Four Hundred
and Twenty Dollars, in the manner following, to wit:
the sum of one Hundred and Five Dollars to he paid on
the twenty-fifth of December, Eighteen Hundred and
seventeen; tiie Anther sum of money last aforesaid, on
the twenty-fifth of December next,thereafter following;
the further sunt of money last aforesaid, on the twenty-
fifth of December next, thereafter, following, and the
further sum of money last aforesaid ; the residue, on
the 95th of December, Eighteen Hundred and twenty.
And it further appearing that there is now dueon said
Bond and mortgage, the sum oftwo Hundred and Fifty
five Dollars and thirty-five cents of the principal, with
interest thereon from the twentieth of October, Eigh
teen Hundred nnd twenty-three. On motion of coun
cil for said petitioner, It is ordered by the Court, that
unless the amount of the principal, interest and costs,
due on said Bond and mortgage be paid into the Clerk’s
office of this Court within twelve months, that the
equity of redemption in and to said mortgaged pre
mises^ thenceforth nnd forever barred and foreclosed.
And it is further ordered, that n Copy of this Rule
published once a month for six monffis in some one
of the puh’ie Gazettes of this State, or be personally
served on the said Caleb Barton, three mouths before
the expiration of this Rule.
