Court of Ordinary, 1831.
I T appearing to the Court, that Abraham B. Carter,
late of said county, deceased, in his life time, to
gether with John T. Carter and Charles Ritchie, exe
cuted his obligation to James Forsyth benringdato the
I3i|, day of March, 1830, conditioned to make unto the
said latncs Forsyth, his heirs and nssigns, a good and
sufficient title to Ian No. one hundred and fifty-two, in
tho nineteenth District of the second section in the
then last Band l.ottcry, drawn by the said Abrahani
B. Carter; and it appearing to the Court that the said
Abraham B. Carter died without executing titles to said
land in conformityto his said obligation, which is now
herein to tho Court shewn, and it appearing to the
Court that the consideration money for said land has
been raid. It is on motion ordered, that John T. Car
ter, administrator of tho estate of the said Abraham B.
Carter, it i make and execute titles to said land agreea
bly to said Bond and obligation, unless cause be shewn
on or before the July Term of this Court next, and that
a copy of this will he published fur three months agree
ably to the law, in such cases made and provided.

RULE NISI.
To the Hon. the Superior Court of said county.
T HE petition of Charles Ilulsey respectfully shows,
that heretofore, to wit: on the eighteenth day of
March, eighteen hundred and thirty, the said Frede
rick A. Brown and Jubez Lewis, made, executed and
delivered to your petitioner,their certain deed of mort
gage, bearing date the day and year aforesaid, and
which is here in Court ready to be shown, which deed
of mortgage convoyed a certain tract or parcel of land,
situate, lying and being in said county of Hull, known
as Lot No. ninety-six, in the ninth District of said coun
ty, which tract or Lot of land was mortgaged by the
said Frederick A. & Jabez, for the better securing to your
petitioner the payment of a certain promissory note
made and delivered to your petitioner, by the said Fre
derick A. k Jabez, on the day and year aforesaid, for the
sum of three hundred dollars, and due on the twenty
fifth day of December, eighteen hundred and thirty,
together with a certain other note described in raid
mortgage, and which is not yet due, and which said
first mentioned note is herewith shown to the Court:
and your petitioner further shows that the whole
amount of principal and interest un said note, i* now
due and unpaid. Wherefore he prays, that unless the
said Frederick A and Jnbcz, pny into the Clerk's Of
fice of this Court, the amount of the principal, interest
and cost due thereon, within six mouths from this date,
that the equity ofredemption in, and to the said mort
gaged premises, thenceforth and forever be foreclosed.
Therefore on motion of Council for the plaintiff, it is or
dered by the Court, that the said Frederick A. Brown
and Jabez Lewis, pay into fhe Clerk's office of this
Cnmt the amount ot the principal and mlerest due on
said note, with all coat A, on or before
the expiration of eix months, otherwise tho equity of
redemption in and to the said mortgaged premises, be
forever barred nnd foreclosed; and that a copy of this
rule and petition be published once a month for six
mouths in one of the public Gazettes of this stato, or
that the defendants ho personally served therewith,
three months before tho next sitting of this Court.
