When the com» mission shall have been thus organiz ed, it shall uot he in the power of «ithairhoix8eto-d^sc4vj^.the-aamc. to withdraw any of its members, but if any such Senator or members shall die or become physically unable to perform the duties required by tills act, the fact of such death or physi cal inability shall be by said com mission, before it shall proceed fur ther, communicated to the Senate or Honse of Representatives, as the case may be, which botty shall immediate ly and without debate proceed by viva voce vote to fill the place so va cated,, and the person so appointed shall take and subscribe the oath hereinbefore prescribed, and become a member of said commission; and in like manner if any of said Justices of the Supreme Court die or become physically incapable of performing the duties required by this act, the other of said justices, members of the commission, shall immediately ap pointanother Justice of said com-/ mission, and in such appointment re gard shall he had to the impartiality and freedom from bias, sought by the original appointment of said comnrssion, who shall there upon immediately .take' and sub scribe the oath hereinbefore pre scribed and becanm a member of said commission to- fill the vacancy oc- cassioned. All the certificates and papers purporting to be certificates of the electoral votes of each State, shall be opened in the alphabetical order ofthe States as provided in section first of this act, and when there shall he more than one such certificate or paper as certificates and papers from such State, shall be opetied, excepting duplicates of the same return, they shall be read by the tellers, and thereupon the Presi dent of the Senate shall call for ob jections, if any. When all such ns so made to any certificate, paperfrom a State shall.have lived and read, all such cer- votes and papers so objected same, together with such objections, shall be forthwith submitted to said commission which shall proceed to consider the same with tho same pow ers, if any, now possessed for that purpose by the two houses, acting separately or together, and by a ma jority of votes, decide whether any and what votes from sneli State are the votes provided for by the Consti tution of the United States, and how many and what persons were duly appointed electors in such State; and may therein take into view such peti tions, depositions, and gather papers, if any, as by the Constitution and now existing laws may be competent and pertinent in such consideration, which decision shall be made in writing, stating briefly the ground thereof and signed by the members of said’ commission agreeing therein: whereupon the two houses shall again meet and such decision shall he read and entered upon the. journal of each hquse, and the counting - of votes shall proceed in conformity therewith, unless upon objection made thereto in writing by at least five Senators ‘and five members of the I-Iousa of Representatives, the tw6> houses shall separately concur in ordering otherwise, in which case such con current order shall’ govern.
