There is
the people.
to telegraph Hayes that fraud has
a sickening fear upon
They fear that the de
cay that has made our Executive a
shame and our Congress a corrupt
job has all the while been honey
combing the Supreme Court.
Certainly the spectacle presented
last week of three Justices trailing
their ermine through the vilest lilth
of the political arena filled the nation
with shame and amazement.
We had fondly hoped that at least
our courts had remained uucoi rupted.
We put behind ns the fact that one
of this tribunal had been picked up
by a tainted administration from. the
lobby to pack the court in the legal-
•'t ender case in the interest of the rail
roads he represented; and lie hoped
with true confidence, that a better
association had served to elevate and
purify the man. His gown seems to
have favored his decay, and security
in-concealment always deadens the
conscience.
It was not altogether weak in us
to believe that these Judges would
bo found on a higher level than that
of partisan feeling. We have been
trained and educated to an admira
tion of courts of an English speaking
people, that, through all ages and un
der all circumstances, have stood
calm and steadfast as a rock-bound
barrier protecting bays from the vio
lence of the ocean. It was not too
much for us to believe that pride of
position, if. not pride of character,
with a past of nearly a century of
such learning and impartial justice
that had "made the third arm of our
republic one of love and respect,
would save us from the unseemly
spectacle of three Judges soiling
their ermine in a vulgar fight fur po
litical power.
Through all the conflicts of the
past between usurping power and the
people the courts of England have
been impartial tribunals, and in all
doubtful cjuestions resolved the doubt
in favor of liberty ^ It remainded
for three indecent old men of the
won, or Morton can hobble out as if
decay was without pain, is no place
to which the honest people can ap
peal for their rights.
At a camp-meeting last Summer,
a venerable sister began the hymn:
“ My soul he on thy guard, Ten thou
sand foes arise.” She began in shrill
quavers, but it was pitched just nine
teen octaves too high. “ Ten thou
sand, ten thousand,” she schreechcd,
and stopped. “ Start her at 5,000,’’
cried a converted auctioneer, who
was present.

only republic on earth to violate this
happy past and degrade their high
court in the estimation of the people.
We have been taught that fraud
vitiates. This tribunal, with the sanc
tion of three judges, holds frand to he
a foundation for the electoral expres
sion of a State, provided it can stand
ten days. There is punishment for
all crime and a remedy for all wrong
save that of stealing the vote of a
State. No Governor can arrest no
Legislature, repeal no court, can
punish, in the very States in which
the wrong is. done, so as to secure a
recognition from a tribunal expressly
created for the purpose of such re
cognition. This is not law, it is re
volution ; and the dullest brain in the
land can see through the trick that it
is an insult to call a technicality. The
shameless scoundrels, undf r guidance
from Washington, held the State on
the point of their bayonets until they
secured the electoral vote, and then
threw it off, and this with such un
masked insolence and audacity that
one of t Loir own agents, General
Barlow, turned, sickened, away, and
their own Republican conrt sought
with all haste to apply a remedy.
It is the duty of the Democratic
Senators, the members of tho House
and the two Judges who have shown
a regard for justice, to at once return
to their several places and break up
this infamous returning board. We
want to get hack to an arena where
the equities can he considered. We
want to get where we can make these
bondholders and monopolists, tho
corrupt officials and infamous con
spirators, feel that they are trifling
with a dangerous element. This
thing is sapping the foundations of
self-government, is destroying cons
fldence in tlie ballot aud a faith in our
courts.
There is no* rfae id asserting that
when Louisiana is reached it will be
loiind too offensive f r this national
returning board of rogues to Bwallow.
As well expect chastity in a brothel,
honesty in a den of thieves,'or shame
from a charlatan. The tribunal from
which Garfield can emerge with lib
