1 his case in which much interest
centres came up for a hearing Friday
and most of the day and several hours
in the night were consumed by the
court in its investigation. It is a suit
brought by Mrs. Hickson to recover
of Col. Mobley a large body of land
now in his possession, which her com
plaint alleges was fraudulently ob
tained. Messrs Hatcher & Peabody
and A. A. Dozier appeared for the
complainant and Messrs Smith
& Russell, John Peabody aad
W. A. Little appeared for the
defense. The suit is against Col. J.
M. Mobley, R. B. Mobley, Wui.
Griggs, R. A. Russell and Geo. H.
Bryan, who it is alleged conspired to
defraud Mrs. Hickson of the large
estate left her by her husband who
died 1864.
The complainant introduced a mas*
of testimony and examined at length
a number of witnesses. The defense

introduced no testimony but demun
ed to the case as made out by the
complainant. After exhaustive evi¬
dence by counsel on both sides the
demurrer was sustained and the com
plaint dismissed. In giving his de¬
cision Tudge Simmons stated that he
had allowed to the complainant the
widest latitude and that nothing to
sustain the charge of fraud had been
proven. That there was no evidence
to show that Col. Mobley had de¬
frauded Mrs. Hickson, nor enough
even to base the presumption
fraud upon his part. That if a jury
should find a verdict against him un¬
der the evidence educed, he would
grant a new trial without argument.
It is understood that the cate will
be taken to the supr le court.
