BRUNO TFEIFFER; AN ORDINANCE. An Ordinance to provide for the repair of wharf lots and the erection of suitable pavements iu the City of Darien. Sec. 1 Ee it ordained that within —months af ter notice is given, as heretolore prescribed, it shall be the duty of all owners of wharves and wharf lots, in the city of Darien, to place and keep and wharves and lots at thefexpense of their respective owners thereof, in good order, so as to prevent tne said earth and rubbish from washing into the river, through or from said respective wharves and lots in conformity with instructions of the City Surueyor ot said eity> who shall give his attention whenever notified so to do. Sec. 2. Bo it further ordaiued, that it shall he the duty of the owners of all improved lots in the City of Darien, to contract and keep iu repair at the expenee of the owners of each lot respectively upon Broad street, from Walker's store, at the h ad of said street ou both sides of said street to Eppings’ old office, pavemeuts of brick or smooth stoue of— feet in width, well and substantially laid, and upon all other streets in said city it shall be the duty of each owner of an improved lot to place down iu front thereof iu a substantial and workmanlike mannera pavement, of wood, of the width feet and each person, the owner of such lot or lots, shall in putting down the pavements hereintofore required be bound to conform to the levels and inclinations marked and prescribed by' the city surveyor, whose duty it shall be to giadc and stake down the place to he paved both on the line of the lots and the limits hereintofore deter mined on the str et, driving a stake at every 10 feet of the line and the said surveror shall attend within 5 days alter he is requested to do so. Sec. 3, Be it further ordaiu and that the Marshal of said city shall give written notice to the owner or'owners of said wharves and wharf lots aud to the owners of ail improved lets in said city of Darien of the requireuieuts of this ordinance and when it is impossible to notify such owners bo done by publication in the Darien Timber Ga zetkk for thirty days, and any one or more of the above described persons who shail fail or refuse to comply with the requirements ot said ordi notice within— months shall be liable to a fine not to exceed —— dollars to be enforced before the police court of the said city of 1 alien for each day oi such neglect or refusal, and execution shall issue against the property of such delinquent per son or persons in the same manner as iu other cases for the violation of the ordinances of said city. Sec. 4. Be if further ordained that in addition to the penalties prescribed in the preceeding sec tion upon the failure or refusal of any wharf own er or owners to put his or their wharf or wharves iu good order, or oil like iailure or refusal of the o-.vner or owners of any improved lot or lots to construct and keep in repair suitable pavements iron s oisucii lot or lots of the character here tofore prov ded lor, it shall be the duty of the marshall to give thirty days notice in writing to all such diligent wharf or lot owners, requiring him or them to put in repair their wharf or wharves or to pave iu iront of his or their im proved lot or lots which notice shall be served personally, but it such service shall be impossible by reason of non-residence oi the person or per sons to whom the same is directed, then it shail he his duty to publis h said notice for thirty days, in the newspaper in which the city advertising is done and alter the expiration of said notice it ska 11 be the duty of the Chairman ot the Board of County Commissioners, as Layer of said city, to require the Marshall thereof to enter upon and put in order or pave and put iu repair the proper ty of such delinquent wharf or lot owner in the manner heretofore prescribed at his or their ex pense, and iu the name and'behalf of the citv au thorities of I arien, to bring an action at law against the owner or owners of the property so repaired as aforesaid. The Pilot will notifiy the officer who will board and inspect her.
