the Herald has denominated at 'it rcflecteare
upon the Ordinary of ttb cowßy, the Uar
ald. aad all cnaaectcd WittiKT MUM
Sects conacrted with It V We shall Atman..
In the issue of Jane 1, the Nmnt IbRKMH
published the following article, under the
caption of “Legal Advertising
-•It has been customary tnun lime imme
morial. for the Ordinary to publish his noti
ons A the official organ of the SticriA. that
the advertisements of both may appear and
be filed in the clerk’s office tageiher. The
fimißoiA Home Jocrsai. basal present the
largest citcularien of any paper that Ims ev
er been published in this county. It is
therefore right and proper that
lives and agents of estate*, aad state and
county officiate, in fast hte to those fnrwhom
they act, should give all partite the benefit
of this extensive ofretiiwßon. many of tteevn
as will he seen by reference te our columns
to-day am doing thte.”
Now, as to the troth of the Aw aramion
in the above that “it has been caatnmary
from time immemorial for the ordinary to
publish his notices in the official organ of
the sheriff.’’ For the proof of this we
woold point to the majorin' of journals in
tliis, or any state. Side by side with the
advertisements of the sheriff in asarly every
instance, appear those of the ordinary.
Ther- may he exceptions, hut the majority
dearly shows that it is a custom. Even Or
dinary Thornton recognised that fact, for.
years ago, wher approached by tbe praam;
proprietor of this paper he offered as a ana
son for not giving the ,lotrvi. twe adver
tising of his office that he must follow the
sheriff, and the sheriff’s organ was at that
time the Herald.
The Legislature of Georgia reoggniyewi
that tbe official organ wts that paper in
which the sheriffs notices were pubHuheri,
In section 198 of the code of INS! -rH
which section was passed by the Icgistaum
oT 1880—we find that notices of local tails
“shall be published once in the newspape r
in which the sheriffs sales are advertised.”
This plainly shows that the legislature con
sidered the sheriffs paper the affinal organ of
the county, and the spirit of the law is cer
; jaialy that lygol advertisements should tv
1 Had it not been the inteaiim and Mm
spirit of the body which enacted this law
tlmt legal advertisements should follow the
sheriff, the act woultebave read “in the pa
per iu which the ordinary's notices, or the
bailiff's notiora, appear.” But (bay dwi not
consider either of these officers Js the con
trolling officer of a county. The matron
pursued in the past by most ootmarics and
tmiliffs waspreceden’ enough for them that
tlie slieriff controlled the official advertising
and it was hut natural for them to dictate
that an official notice of any contemplated
local law should he published in the official
local journal. These are the facts. W -
leave our readers to judge if there has been w
misrepresentation of facts bv the Howe Joint -
nal in the first assertion made in the ongi
j nal article.
To tliis portion of the article tlie ordinarv'
seems to have t*kcn exceptions, and in *u
article to the Herald Ik- claimed that he had
here assailed by the Hove .lorr.NAi, and
wislied to reply to that allegod attack. Tins
paper thereupon disclaimed any attack upon
: tlie Ordinary of Greene comity, or anyone
■ else, and in its explanation stated that the
article was intended simply for the purpose
I of giving information to these interested in
advertising legal notices, and urging oar
claims as a medium for rcaoteng the people.
This was a plain business announcement.
The Home Jontsai. is published as a busi
ness investment r.e propose togivevalne
received for all money received: and propose
to push our business as faraspossitile wit hin
the range of fair and honorable dealing. In
the conduct of tins journal we havw no
friends to reward or enemies to punish We
have urged and shall always urge the merits
! of our paper as a home visitor and as a me
dium through which advertisers—of no mat
ter what class—can reach the people. It was
this legitimate application for business tliat I
induced tlie proprietor of the Hove Jon*- i
nal to apply for tlie legal advertising of the i
county years ago; it is this same principle of
legitimate application for patronage that
leads him uow to call upon merchants anti
solicit advertising If to make an lamest
and honoratiie livelihood: to give value re
i ceived for mouev received: to urge his howi
i ness before the people be any indication <*f
! cupidity or lack of intelligence, we surmise i
tliat tlie editors of the Herald will find that
ninety-nine out of every hundred, wlm are
trying to make an honest livelihood, are ao- i
United by motives of cupidity, and inspired,
hv minds lacking in intelligence. The Her- j
aid may be published U|muj a principle hit!:- i
erto unheard of in journalistic circles: it may

doing a legitimate business: it may he a ]
aafety-valve through which the surplus in- j
teiligence of its editors may find an escape:
and a medium through winch to vent their
spleen and venom against private ciUßen*
and (H-raoual rights.
The allusiou* of the Herald to tlie pro
prietor of this |mper as an individual shall
receive no notice from us. The vulgar and
indecent language used is beneath the dig
nity of a gculle-uan, unworthy of any jour- i
naliai, aud could only l.sve U-en conceived
