PUBLIC SALE.
Blakely, Ga, Early County, January
28th, 1915.
Whereas, on June 30th, 1914, M.
T. Chipstead and Mrs. Georgia Barks
dale did execute to Mrs. Henrie Deal
five certain promissory notes as fol
lows:
Twenty-Eight Hundred Dollars
($2800.00), due December 31st, 1914;
Twenty-Six Hundred and Forty
($2640.00) Dollars, due December
31st, 1915; Twenty-Four Hundred and
Eighty ($2480.00) Dollars, due De
cember 31st, 1916; Twenty-Three Hun
dred and Twenty ($2320.00) Dollars,
due December 31st, 1917, and Twen
ty-One Hundred and Sixty ($2160.00)
Dollars, due December 31st, 1918, all
dated June 30th, 1914, and bearing in
terest at the rate of 8 per cent per
annum, and stipulating for the pay
ment of ten per cent upon the amount
due as attorney’s fees if collection
be enforced by suit.
And whereas, to secure the pay
ment of said notes M. T. Chipstead
and Mrs. Georgia Barksdale did exe
cute to Mrs. Henrie Deal a security
deed conveying the following proper
ty, towit:
South half of lot of land Number
Three Hundred and Fifteen (315) in
the 28th District of Early county,
Georgia, and known as the Reuben
Freeman place; also
Fifty (50) acres of land in a square
in the Southeast corner of lot of
land Number Three Hundred and
Thirty-Two (332) in the 28th District
of, Early County, Georgia; also
Thirty-five (35) acres of land off
of lot of land Number Three Hundred
and Ninety-Seven (397) in the 28th
District of Early county, Georgia, said
land comprising a square of tliirty
' seven and one-half acres in the
Northeast corner of said lot less two
and one-half acres in the Southwest
corner of said square; also
Two and ninety-one one-hundredths
(2 91-100) acres off lot 194 in the
28th District of Early county, Geor
gia, known as the Frank Perry place
and described as follows: Beginning
at a point sixty-one yards and one
foot North of the Southwest corner
of said lot, being ten feet East of
the West line of said lot, thence run
ning East one hundred and seven
teen (117) yards, thence North one
hundred and twenty and one-half
yards (120 1-2), thence West to with
in ten feet of said West line, thence
South to point of beginning; also
The barber shop lot on River street
in Blakely, Early county, Georgia,
more fully described in a deed from
T. J. Howell to Mrs. it. A. Chip
stead, Executrix, dated January 21,
1911, and recorded February 2, 1912,
in deed book 28, page 259, of the re
cords of Early County, Georgia. This
conveyance also includes the wall
privileges granted in said deed from
T. J. Howell to Mrs. R. A. Chip
stead, Executrix, more fully described
in said deed; also
A certain city lot on the West side
of the Public Square in the City of
Blakely, Early County, Georgia,
known as the Sam Stein Store House
and lot, and bounded as follows:
North by the First National Bank
Building, South by the property of
the estate of Mrs. B. Chancy, and
W;est by the T. J. Howell building,
now owned by T. F. Cordray; also
A certain lot, together with the
improvements thereon, located on the
South side of the Public Square in
the City of Blakely, Georgia, and
known as the George E. Chipstead
Lavery Stable property, and bounded
as follows: North by the Public
Square, East by the dispensary build
ing lot, lot of C. T. Alexander,
lot of R. H. Sheffield, and lot of Mrs.
Clara Butler; South by an alley and
west by an alley running from Public
Square to Liberty Street; also
An acre lot in the City of Blakely,
Georgia, known as the Sallie Meri
wether lot, and more fully described
in a deed from Nobie Wade and Axie
Wade to George E. Chipstead, dated
March 28, 1898, and recorded April
21, 1898, in deed Book “U,” page 45,
of the records of said county; also
An acre lot in the City of Blakely,
Georgia, known as the Dan Leadden
ham place, situated North of the Cen
tral Railroad and more fully described
in a deed from H. Q. Frazier to Dan
Leaddenham, dated December 28,
1891, and recorded January 6, 1892,
in Deed Book “R,” page 456, of the
records of said county; also
The plantation known as the Lime
Branch place, being all of lots Num
ber Seventy-One (71), and Number
Ninety (90), and all of lots Numbers
Fifty-One (51) and Fifty (50) lying
East of Lime Branch, all in the Sixth
(6th) District of Early County, Geor
gia, and containing in the aggregate
six hundred acres, more or less.
The west half of lot of Land No.
299, in the sth District of Early
County, Georgia, containing one hun
dred and twenty-five (125) acres,
more or less.
And containing the following stipu
lations:
This deed is given contemporane
ously with one of like tenor and
effect to Grace Deal, both of which
deeds shall be of equal dignity and
neither shall have priority without
reference to the date upon which the
same may be filed for record or re
corded.
It being the intention of this in
strument to pass title to said proper
ty into the said Henrie Deal.
And containing the following pow
er of sale:
Should said indebtedness, or anj
part thereof, be not paid at maturity,
we hereby, for value received, agree
that all of said indebtedness snail
become instantly due and we grant
to Henrie Deal the following irrevo
cable power, to be exercised at her
option in lieu of any proceeding sne
might take in law. In said event said
person above named (the grantee) or
his personal representative or the
transferee of said notes is hereby em
powered to advertise said property
for sale in the official organ of Early
County, stating in said advertisement
the day of sale, and after advertising
the same once a week for four week 3
in said newspaper, to expose said
property at public sale on the date
in said advertisement named, and to
sell the same to the highest and best
bidder. Said sale not to be on first
Tuesday in any month, but may be
at any time selected by the person
to whom said indebtedness may be
payable and advertised by such per
son.
The person exercising this power,
or any agent or representative of
such person, may be purchaser at
said sale; said person above named
(the grantee) or his personal repre
sentative or the transferee of said
notes need not personally conduct the
sale, nor be present at it, but may
execute all the powers in this instru
ment given by an authorized agent or
attorney.
And whereas, the note for $2800.00,
executed June 30th, 1914, and due
the 31st day of December, 1914, was
not paid at maturity and said note and
all of said indebtedness became due
and payable according to the stipula
tion above set out;
And whereas, the notice for attor
ney’s fees on all of said indebtedness
has been duly served upon M. T.
Chipstead and Mrs. Georgia Barks
dale in accordance with the stipula
tions contained in the notes thereby
becoming payable in addition to the
amount of said notes:
Now, therefore, I, Henrie Deal, in
accordance with the stipulations con
tained in the power of sale and after
the property hereinafter set out . has
been advertised for sale in the of
ficial organ of Early county once a
week for four w r eeks in said newspa
per, , expose said property, at
public sale before the court house
door in- Blakely, Ga„ on the 19th day
of February, 1915, and will sell the
same to the highest and best bidder.
The foregoing sale will be made for
the benefit of the undersigned and
Mrs. Grace Deal, with equal rights,
