Twice in modern times a President
of the United States has been stricken
while in office and for some time has
been physically unable to carry . out
the duties of his office. There is con
siderable discussion in Washington that
this next session of the 84th Congress
may see some legislation setting out
by law under what exact conditions a
president may deem to be unable to
discharge the powers and duties of his
office.
For weeks President Woodrow Wil
son was critically ill during the last
days of his second term, and yet he
never relinquished his authority.
While President Eisenhower is well
on the road to recovery, it may be
many weeks before he is physically
able to even be in his office at the
White House, or carry out his duties
as he did prior to his illness,
The constitution provides that all
executive power shall be vested in a
president. Further, that the President
shall take care that the laws be
faithfully executed. There is no ques
tion but that the President can dele
gate some authority to underlings,
while he is physically able to revoke
that authority. But there are many
laws which require the President's
personal attention. He must person
ally sign all laws, treaties, and many
other documents. There is little ques
tion but that he has authority to dele
gate power to others in signing sec
ondary documents, which either by
law or tradition he has signed in the
past.
The constitution, Article 12, reads:
“In case of removal of the President
from office, or his death, resignation
or inability to discharge the powers
and duties of the said office, the same
shall devolve upon the vice president,
and the Congress may by law provide
for the case of removal, death, resig
nation or inability of both the Presi
dent and Vice President, declaring what
foflicer shall then act as President, and
such officer shall act accordingly until
the disability is removed or a presi
dent shall be elected.”
The trouble is that the Congress
has never passed a law, nor has the
Supreme Court ruled on what consti
tutes “inability to discharge the pow
ers and duties of the said office.”
' There is no question but that the
Congress, in its wisdom, can ease up
some of the tremendous volume of
personal duties which devolve upon
the President. One would be in the
field of private relief bills whichmow
must be signed by the president. Hun
dreds are passed each session.
President Eisenhower, throughout
his lifetime, has been accustomed to
idelenm authority, that is to give or
ders and have them carried out by
men whom he had trusted. He has
iadopud that plan since he became
president, but the multitudinous pile
up of paper work, of seeing visitors,
of private correspondence. of receiving
visiting VIPs, and of social duties
continues to press upon his time and
his strength
For the constitution provides that
he “shall” receive ambassadors and
public ministers; that he “shall” com
mission all the officers of the United
States; that he “shall” be the com
mander-in-chief of the Army and
Navy: that he “shall” have the power
to make treaties, by and with the
advice of the senate.
