From the Atlanta Sun. THE ACT TO CREATE A COUNTY COURT FOR EACH COJNTYr- The Legislature, at its late session, passed an act to create a County Court for each county in the State (with a few exceptions.) The County Judge must he a resi dent of the county one year before the appointment, and must be twenty-five years old, and must be appointed by the Governor and confirmed by the Senate; term of office four years, to continue till his successor is appointed and qualified. Jlis sqlaiy, in each county, is to be fixed by the Grand Jury at the Sig Term of the 'Supe rior Court, v, >h shall be levied by the Ordinary, to be collected with other taxes. It is not necessary that the Judge should be a lawyer. The Court shall have jurisdiction in all civil cases, matters of contract and of tort, (except where, by the Con stitution, exclusive jurisdiction is giv en to the Superior Courts), where the principal sum in cases of contract, and the damage claimed in cases of tort, does not exceed one hundred dollars, but where the principal so claimed, or damage, is more than fifty dollars, there may be an appeal to the Superi or Court. Any person desiring to bring claim within the jurisdiction of the County Judge, may do so by remitting, or releasing, so much of his claim as will bring it within the same. The Judge shall have jurisdiction over Ids county, and may hold his courts at the court-house, or any other place in said county. All suits in civil matters shall com mence by a summons, to be issued and signed by the Judge, stating the nature of plaintiffs demand, as in sum mons of magistrates, and command ing the defendant to appear at a cer tain time and place in the countv, which shall lie the trial or judgement term. The case may be continued for Biq same ground and on same terms as in the .Superior Courts, for a pe riod not exceeding ten days. Said summons shall hear date 15 days be fore trial, and be served 10 days be fore the same time, if the principal sum or damage does not exceed fifty dollars, and shall bear date 50 days be fore said term of judgement, and be served 15 days before the same, if the principal sum of damage exceeds fifty dollars, and is not more than one lum-, dred and al'ars. The County Judge may appoint an officer to servo all the processes and writs issued by him, and execute all orders issued by him taxing tig sgme bond and security required at Con stables, not to exceed two hundred dollars; and. he shall take the oath re quired of Constables. If either party is dissatisfied with the judgement of the County Judge, and the principal sum, or damage,-claimed, exceeds fifty, dollars, he may enter an appeal to the Superior Court within so ir days, and the Judge shall transmit the same, and all papers connected w ith the case, to the Clerk of the Superior Court, at least five days before the next term. Where the principal sum does not ex oeed fifty dollars, either party may sue out a certiorari , winch may be disposed of by the Judge of the Supe rior Court in vacation, or at the regu lar term. An execution shall be issued by the County Judge us soon as judgment is entered, unless an appeal is taken or certiorari sued out. The County Judge shall bave power to procure testimony from witnesses in his county, to compel the produc tion of paper and procure testimony by interrogatories and commission, as Judges of-the Superior Courts. r l he Judge shad have jurisdiction to hear and determine all applications lor evictions and intruders, tenants holding over, or the partition of per sonal property, for the trial of posses sory warrants, to issue and dispose of distress warrants—to issue attach ments, garnishments, to foreclose mortgages, of personal property, liens, to attest deeds and other contracts of registry,-to administer oath* of all sorts, to exercise the same power as was giv en to the officer known as the County Judge, by the act of 1865and in 1866. in relation to attesting, approving, enforcing, and setting aside Court con tracts, as described in Invin’s Code. Ihe costs in civil cases shall be the same as in Justices’ Courts, and for othei matters, the fees and costs shall be the same as are provided in Sec tion 813 of Irwin’s Code, and if no provision is made under said section, then such fees and costs as shall be assessed lor his services by a Judge of the Superior Court. Said County Judge shall also have jurisdiction and authority as Justices of the Peace, to issue criminal warrants against all persons accused of crimes and misdemeanors. In cases which appear to be felonies, they shall com mit the party to jail for safe keeping, unless the case be bailable by a Jus tice of the 1 ©ace, when the accused may, upon complying with the law, be bound over to appear before the prop er court—ln cases which do not ap pear to be felonies, the Comity Judges shall have full authority to hear, "de termine, sentence, decide and adjudi cate upon the same; unless the party accused shall, in writing demand au in dictment by the Grand Jury. In that case, the judge shall requre good bond and security. If no such bond or security is given, then the Judge shall commit to jail for safe keeping. If an indictment is found by said Grand Jury, the Jucfge of the Superior Court, may if he chooses so to do, order said indictment to be re turned, with all the papers, to the County Judge, to be disposed of by him after ten days’ notice to the party accused and the prosecutor. If pat ties accused shall demand a jury to try their case, instead of the County Judge, then th(\case shall be pQ£tponed,gintil a jury can be summoned lor such trial. The costs in this court shall be as sessed as follows ; In all cases begun not tried, §2 shall be paid (by the par ty adjudged liable) to the County Judge, and the same sum to the bailiff in all cases tried by the County Judge, or by him and a jury, the costs to be paid by the party held liable shall be $3, aud the sum of $2. to- the hulifT shall, however, when he shall summon a jury, or serve subpamas for witness es, have for each juror 20 cents and each subpoena 10 cents. All of the costs assessed for the County Judge shall be paid over by him to* the County Treasurer as fast as received, and an account given of the same at each term of the Court to (lie, Grand Jury. If said county Judge Shall use any of said costs, or fail to turn over the same, he shall be liable, criminally. All sales to be made by the Bglilf of the County Judge shall be at the Court House of the “county, or at a Militia Court Ground, as the County Judge may designate, having due re gard to the .interests of parties ; first giving the usual notice given by Con stables, or, when, the County Judge may so require, give notice by adver tisement in a newspaper having a gen eral circulation in the county. All laws of the State of Georgia, applicable to civil proceedings before Justices of the Peace, not inconsis tent with the provisions of this act, and which can be applied to the civil proceedings before the County Judge, are ipada apart of this act. "Said County Judge may, in criminal cases when he deems it necessary, di rect his criminal warrants, orders anJ proceedings of all sorts, to the [Sheriff of the county, to his own Bailiff or any lawful Constable of the county. The several County Judges shall keep their offices, and all papers and other things belonging thereto, at the county site, and the Court House, un less impracticable from any cause, and notice of wdierQ-s:fol office is located shall be given 1 y pi.blic&lj'm foyiAhe space of two weeks in a public gazette, having general circulation in tlicrespee t’ve counties, or by notice of the same, at three or more of the most public places in the county in the discretion of the County Judge. That offices shall be kept open every day, except Sundays, and public holidays, and days and times when the County Judge is absent from the coitnty site, holding his courts in other places in the coun ty, which in his discretion, he is al lowed to do. Said County Judge shall discharge all the duties formerly devolving on the Justices of the Inferior Court, as to count) business, except in those coun ties where, by local laws, other pro vision has been made bv the Legisla t,ure of this State. This act goes into effect in each county upon the recommendation of the Grand Jury, and not otherwise. The following counties are except, -cd from the operation of this law, viz: Haralson, Pickens, Pike, Cobb, Dawson, Forsyth, White, Montgome ry, Telfair, Clinch, Coffee, Irwin, Sumter, Wilkinson, Gilmer, Appling, Fannin, Jefferson, Colquitt, Worth, Mitchell, Emanuel, Johnson, Glass cock, Fayette, Union, Franklin, Chat ham, Tattnall, Harris, Chattooga, Wil cox, Talbot, Ware, Bartow, Cher okee, DeKalb, Banks, Pierce, Towns, and Milton, being, 40 in all, leaving ninety counties in which a court can be established by the Grand Juries. There is an error in the above syn opsis of the County Court bill in rela tion to the salary and fees of the Judge. The ‘Sun says: lie is entitled to fees in all civil cases, but is required by the law to pay over to the County Treasurer all fees collected in criminal cases; and the grand jury is required to fix a sala ry or compensation for his services in attending to the criminal business of his court, and levy a tax on the conn, ty to meet such compensation.
