THE CITY COURT.
Last week we penned hastily,
jnst at the hour of going to press,
a paragraph in relation to the cost
ofjthe late session of the citycourt,
which has called forth a somewhat
extended criticism from our friend
G. W. A., who is as learned in law
•e he is vigorous in expression and
indifferent as to his choice of Eng
lish. We have ifo reason what
ever for magnifying the advantages
of the city court, and readily con
cede that no money will accrue to
the county treasury from fines im
posed by it. Under the provisions
of a local act for this militia dis
trict (714th) one half the amount
of the fines imposed, in cases for
telling whiskey, goes to the in
former, and half to the school
fund. Two of the prisoners con
victed at the recent session were
prosecuted under this local act. —
One of these cases, that of Geo.
Hubbard, was left out of our re
pott, by the printer who set it up.
The fine in each case was >550, and
we arc informed that both have
paid, so the school fund, if not the
country treasury, is increased that
much, that is $25 from each case.
We concede that the fines paid in
other cases will be absorbed by
claims for insolvent costs. Yet we
are not prepared to recede from the
general proposition that the busi
ness transacted by the courts will
result in a clear gain in cash to the
county Treasury. We will take
G. W. A.'s own statement of the
cost and debit the account
with $237.00. On the
other side we place the amount
saved by turning out 5 prisoners
Instead of keeping them in jail un
til April Court, at $lO a month
each, sloo.oo* To this we add one
day's service of the grand Jury, in
cluding bailiffs, in investigating
the cases tried, $48.00 ; two day’s
service of traverse Juries to try
the cases, $96.00. Sheriff Clerk
and two bailiffs attending Superior
court two days, s24.oo—total $268.-
00. Net saving, $268,00 less
$237,00, equals $31.00.
But it may be claimed that the
trial of cases would not necessari
ally have taken two days in the
Superior court. On the other hand
it should be considered that this
calculation is made on the basis of
the first term, and that at future
terms the business of the court
will be largely increased, and the
saving of time and expense m the
Superior court will be proportion
ately larger. And again when
prisoners are brought out of jail
and tried at May term, there will be
a saving of 5 months jail fees, in
stead of two, as at this term. In
other words the saving in jail fees
on five'prisoners, tried and dis
charged from jail at May term, in
stead of being held until Oct. terir
of the Superior Court, would be
$250.00.
But any estimate of the actual
cost or saving to the county by
neans of this court must be in a
measure speculative. It is an ex
periment and must be tried to de
termine its merits. We are in
formed that a similar court has
done well in Coweta. If it shall
•ncceed in breaking up the commis
rion of the numerous petty crimes
which our Superior courts have
been unable to reach, it wiU piove
a blessing to society, whatever it
may cost in dollars and cents.

it will not occupy you more than

day to consult the witness, two

That is about the size of G. A.’s
a.gumeut about the Judge’s salary.
But it may be that what he has
written on that branch of his sub
ject “is all in his eye.”

ment to Carroll’s excellent Sheriff:
“A straight-up little man wiin !

kor. This was jim Hewitt, the fa- ’
mous sheriff of Carroll county, j

desperate man. He had old
man Barker, and cut Bonner Bar
ker’s throat, long before th.e final
act in the tragedy. This you rem
ember well. He shot Bonner down
in the presence of his young wife,
who attempted to throw herself be
tween the slayer and her husband.
It was thought Smith would never
Ire arrested. He had fled the coun
try and w*as near the Alabama line
iu the midst of his relatives. But
Jim was pn his track. For eight
een days the hunt went pn. At
last Jim located him. He studied
out the paths of the fugitive
through the woods, and from
Thursday morning until Saturday
night, he lay in wait for him. On
Saturday night Jim was hid in the
woods by a lonely which he
knew Smith would cross. About
midnight he heard the murderer
coming, walking cautiously over
the frozen ground. Jim kicked off
his rubbers, dropped his overcoat,
drew his pistol, and, as Smith’s
form loomed before him, the little
man rose and said: ‘Smith you must
come with me.' It was a big
chance to take, but Smith knew
his man and submitted without a
word. Laying his hand on his col
lar, Jim led the slayer out of the
heart of night to prison.”
“Lt is a remarkable fact," my
informant went on to say. “that
there has never been a burglary
from the house in Carroll county
since the county was made* And
there has never been an indictment
drawn in eight years that Jim Hew
itt has not brought the man into
court.”
The Constitution's informant
probabably meant to say H there
has never been a burglary of a
DWELLING house.”
