this city and this state, residing in the
City of Gainesville, such Ist to be
taken from the permanent qualifica
tion book: this list shall be published
at least ten days before the election
and no person shall be allowed to vote
whose name does not appear on .such
list, unless he produces and exhibits
to the Managers of the election a cer
tificate signed by the Clerk of Coun
cil, County Registrar, that his name
was omitted from said list by acci
dent or mistake.
Section 77. The Mayor and Coun
cil of the City of Gainesville shall
prepare and deliver to the Managers
of the said election an official ballot,
which shall have written or printed
thereon on separate lines the words,
“FOR THE NEW CHARTER” and
“AGAINST THE NEW CHARTER”,
and those desiring to vote for the new
charter shall erase the words “against
the new charter”, and those desiring
to vote against the new charter shall
erase the words "for the new char
ter”, and no ballot shall be counted
which has neither erased.
Section 78. As soon as practica
ble after the polls are closed the May
or ami Council shall meet and the
managers of the election shall bring
in the returns and the returns shall be
canvassed by the Mayor and Council,
and the result declared, and if a ma
jority of the votes cast shall be for
the new charter, then this Act shall
take effect and become the charter of
the City of Gainesville from that date,
and if a majority of the voters shall
be against the new charter, the May
or and Council shall so declare, and
the present charter of the City of
Gainesville shall continue in force.
Section 79. If this Act shall take
effect and any section or provision
thereof shall be» declared invalid for
any reason, the remainder of the Act
shall remain operative.
Amendments.
Amendments to this charter may
be submitted to the registered electors
of the city by a two-thirds vote of the
City Managers at the next regular
municipal election, if one shall occur
not less than sixty days nor more
than one hundred twenty days after
the passage by the City Managers;
otherwise, the City Managers shall
provide for the submission of the
amendments at a special election to
be called ami held within the time
aforesaid. If such proposed amend
ment be approved by two-thirds of
the registered electors voting there
on at said election, it shall become a
part of the charter at the time fixed
therein.
The said City Managers shall have
as full ami complete power of submit
ting amendments to this charter as
the'General Assembly of Georgia has
in enacting special acts relating to
municipalities.
