and mortgage deed, that, on the 16th dav
of October, in the year 1805, Simpson P.
Price, of tlie county of Twiggs, made and
executed to the plaintiff, E.J. Collins, his
certain deed of mortgage of that said date,
oonveyiag to said plain tiff lot of land No.
22, lying te the 22d district of originally
Wilkinson, now Pulaski county, lor the
securing tho payment of three hales of cot
ton, weighing each 600 pounds, on or before
December 25, 1860, and all expenses in
curred in collecting tlie same—tlie said
Simpson P. Price also giving a note for the
same, bearing even date with said mort
gage. It also appearing that said Price has
paid on said note nnd mortgage tlie follow
ing amounts, to wit: Dec. 25,1866, 433 lbs.
of cotton; June 18,1867, $35 55; but the
bulance due thereon has wholly failed and
refused to pay.
It is ordered, that tlie said defendant,
Simpson P. Price, pay into this Court, by
the first day of the October term, ls7Q,
thereof, the principal, interest and cost, and
counsels’ fees due on said note and mort
gage, and that in default, the said mortgage
be foreclosed, and the equity of redemption
thereon be forever barred iu terms or the
statute.
And it is forther ordered, that this rule
be published once a month for four months
previous to the next term of this Court, or
served on the defendant, or his special agent
or attorney, at least four mouths previous
to the next term of this Court
