of E. J. Collins, accompanied by the note
and mortgage deed, that, on the lGtli day
of October, in the year 1865, Sim|ison P.
Price, of the county of Tw iggs, made and
executed to the plaintiff, E. J. Collins, bis
certain deed of mortgage of that said date,
conveying to said jilaintiff lot of land No.
22, lying in the 22d district of originally
Wilkinson, now Pulaski county, for the
securing the |iaymcnt of three bales of cot
ton, weighing each 500 pounds, on or ix-fore
December 25, 1866, nnd all expenses in
curred in collecting tlie same—tlie said
Simpson P. Price also giving a note for the
same, bearing even date with said mort
gage. It also appearing that said Price has
paid on said note and mortgage the follow
ing amounts, to wit: Dec. 25, iB6O, 433 lbs.
of cotton; June 18, 1867, $35 55; but the
hulance due thereon has wholly failed and
refused to pay.
It is ordered, that the said defendant,
Simpson P. Prifc, pay into this Court, by
the first day of tlie'October term, U7O,
thereof, the principal, interest and cost, and
counsels’ fees due on said note and mort
gage, and that in default, the said mortgage
tic foreclosed, and tlie equity of redemption
thereon be forever barred in terms or the
statute.
