It apnearing to the Court by the petition
of E. J. Collins, accompanied by the note
and mortgage deed, that, on the 10th day
of October, in the year 1805, Simpson P.
Price, of the county of Ttfiggs, made and
executed to the plnintiff, E. J. Collius, his
certain deed of mortgage of that said (late,
conveying to said plaintiff lot of hind No.
22, lying in the 22d district of originally
Wilkinson, now Pulaski county, for the
securing the payment of three bales of cot
ton. weighing each 500 pounds, on or before
December 25, 1860, and all expenses in
curred iu collecting the same—the said
Simpson P. Price also giving a note for the
same, bearing even date with said niort
gage. It also apiiearing that said Price lias
paid on said note and mortgage the follow
ing amounts, to wit: Dec. 25, 1866, 433 lbs.
of cotton; June 18, 1867, $35 55; but the
balance due thereon has wholly failed and
refused to pay.
It is ordered, tliat tho said defendant,
Simpsou P. Price, pay into this Court, by
tiie first day of the October term, 1870,
thereof, the principal, interest and cost, and
counsels’ fees due on said note and mort
gage, and that in default, the said mortgage
be foreclosed, and the equity of redemption
thereon be forever barred iu terms of the
statute.
And it is fiirthcr ordered, that this rule
be published once a month for four months
previous to the next term of this Court, or
served on the defendant, or his special agent
or attorney, at least four months previous
to the next term of this Court
