Pressed with other matters, wc adopt
tho remarks of the Tim’s ts Planter, rel
ative to the correspondence between the
Governor and Col. Swayno. As part of
the history of the times, we print it in
full, next week. We hope to seo Hiram
Giant forced to sustain or punish his
lawless Marshal. Yea or Nay, Useless.
Gar. Smith find the Military.
The prompt atcion taken by Governor
Smith in a recent correspondence with
Col. P. T. Swaine, commanding the 11.
S. troops, at Atlanta, relating to military
inteifereuce iu Warren couuty, will meet
the hearty approval of every good man
in Georgia.
It is known that the notorious Chap.
Norris, whose conduct toward our neigh
hors in Warren county, since tho war,
has won for him an immortality of infa
my, was, a few days ago, arrested in At
lanta on a Bench wariant, issued by
Judge Andrews, on a grave criminal
charge. It seems that one U. S. Mar
shal, Wm. S myth, made requisition up
on a temporary Commander of the Post,
for troops to preserve the aforesaid Chap
Norris from violence ; although legally
imprisoned, and iu the custody of the
civil authorities of the State—upon
which requisition the troops were sent
to Warrenton.
This extraordinary proceeding could
not bo passed over without Executive
notice, and heuce the Govornor, in the
correspondence mentioned seeks to know
Loin Col. Swaine how it happened that
tlie presence of U. S. soldiers became
necessary among the good people of War
ten county, and at whose instance they
were placed there.
To this inquiry Col. Swaine replies,
giving the facts above recited, und stat
ing that tho steps wus taken during his
temporary absence. The Governor then
promptly requested tho withdrawal of
these troops. He says: “I am not
aware ol the existence of any law au
thorizing him (Marshal Smyth) to make,
or you to comply, with such requisition.
A most significant fact, and one which
throws light upon this whole transaction
is, that no steps seem to havo been taken
to ascertain cither the ability or the wil
lingness of the civil authorities to pro
lect Norris Although I was in the city
•if Atlanta, almost within a stouo’s throw
• the office of Marshal Smyth, at the
time the requisition was made, and the
Iroops were sent, it seemed to have been
considered unnecessay to communicate
with any oue, upon the subject. It is
my duty as Governor ol the State to take
care that the laws be enforced, and to
koo to it that not only Norris, but all
ether citizens of Georgia have the pro
tection of the laws. It is hardly neces
sary for me to add that the interference
of the military in this case, is without
warrant of law or fact, aud can bo fol
lowed by no good consequences.’’
This reasonable demand of the Gov
ernor was at once complied with, and the
military were promptly removed from
AVarrenton, and Norris, though certainly
without claims upon the good offices of
it people whom lie has slandered and
wronged, is yet iu tho hands of the law,
which will protect him with jealous
care, until he is called upon to sutler the
just penalty which the law visits upon
Lis crimes.
In the meantime our people will have
t ccasion to see that in the present Exec
utive vje have an officer who not only
“ knows their rights; but knowing, dares
maintain.” For this he deserves the
thanks of all the people—who will re
member wbat ho does for their gooe—
and especially in teaching the military
power that it is and must be subordinate
to the civil.
CONGRESSIONAL.
Washington, May 22. —The follow
ing is the verbiage of the amnesty hill :
“Be it enacted by the ' Senate and House
of Representatives of the United States
of America in Congress assembled, (two
thirds of each iiouse concurring therein,)
That nil political disabilities imposed by
the 3d section of the 14th article of
amendments of the Constitution of the
United Stutcs aro hereby removed from
all persons whomsoever, except Sena
tors and Representatives of tho 30th and
37th Congresses, officers in the judicial,
military aud naval service of the United
States, and heads of departments and
foreign ministers of the United States.”
Tne Civil Rights bill passed the Sen
ate this morning, and is now on the
Speaker’s table in the House. There
are some fifty or sixty bills in order al
ready ahead of it, and as it takes a two
thirds vote of the House to take a bill
from the Speaker’s tablo out of the reg
ular order, there is no possible show fur
its passage this session. It cannot be
reached by the (into of adjournment, and
the necessary two-thirds vote to take it
out of its regular order cannot be ob
tained. The bill as it passed the Sen
ate reads: i « j

conviction thereof, be fiued not less than
five hundred nor more than five thou
sand dollars for each offense ; and the
person or corporation so offending shall
be liable to the citizen thereby injured
in damages, to be recovered in action ol
debt.
Sec. 2. That the offences under this
act, and actions to recover damages, may
be prosecuted before any Terri lot ial Dis
trict or Circuit Court of the United
States having jurisdiction of crimes at
the place where the offence was charged
to have been committed, with a right of
appeal, or to have recourse to a writ of
error in any case to the Supreme Court
of the United States.”
A bill which passed the Senate this
morning extends the power to suspend
habeas corpus to March 4, 1873.
Only Sumner aud Nyo voted nay on
amnesty.

A Pitiful Condition.— lt is a sad thing
to pass through life only half alive. Yet
there aro thousand* whose habitual con
dition is one of languor and debility.
They complain of no specific disease;
