John W. Pearce and Isaac W. Brooks, (accom-
.panied by the note ami Mortgage deed) that on the
seventeenth day cf May, eighteen hundred an i
sixty-two, the defendant made aud delivered to
the Plaintiffs Ins promissory note, bearing date
the day nuJ year aforesaid, whereby the defendant
promised on or before the first day of January next
following, the date of said note, to pay the plain
tiffs or bearer, one hundred and forty-two dollars
aud ten emits, $142.10, for value received, and that
afterwards, on the day and year aforesaid, the de
fendant, the b"tter to secure the payment of said
note, executed and delivered to jhe plaintiffs his
deed of mortgage, whereby the said defendant
mortgaged to the plaintiffs all the tract or parcel
of land l ying and being in the tenth district of orig
inally Baker now Mitchell county ; containing one
and one-half acres, the same being a part of lot No.
397, three hundred and ninety-seven, commencing
at tlie fourth acre from the town survey of Camilla,
running due East along South street, one aud one-
half acres in width, and ono acre South ; and it
further appearing that said note remains unpaid,
it is therefore ordered that the said defendant do
pay into Court on or before the first day of the next
term thereof the principal, interest and cost, due on
said note, or show cause to the contrary, if any he
has or can. and that, on the failure ot said defen
dant so to do, the equity of redemption in and to
said mortgaged premises be forever thereafter bar
red and toreclosed.
And it is further ordered, that this rule be pub
lished ::i tlie Confederate Union once a month for
three months previous to the nest term of this
to the next term of this Court.
