in the Code, a substantial compliance with
which is declared sufficient, only required
the offense charged to be stated.
An Act to alter and amend Sections 4596
and 4597 Of the Code of Georgia.
See. 1. Be it enacted, dm:., That any
affidavit made or warrant issued for the
arrest of any offender against the penal
laws of this State, shall state as nearly
as practicable, the following facts, to-wit:
The offense, the county in which the

any Juries of the several Courts in this
State.

An Act to legalize marriages between
first Cousins which have been contract
ed since 11th December, 1863.
Sec. 1. Be it enacted, &c., That all first
cousins who have heretofore intermarried
since the 11th day of December, 1863,
are hereby relieved from any penalties
they may have incurred under the laws
of this State, and that such marriages are
hereby declared legal.
Sec. 2. Repeals conflicting laws.
An Act to repeal all laws heretofore
passed by the Genera! Assembly of the
State of Georgia, prohibiting the dis
tillation of Corn, Wheat, Potatoes, Rye,
Peas, <f-c., into Spirituous Liquors.
Sec. 1. Be it enacted, dkc., That all
Acts and parts of Acts heretofore passed
by the General Assembly of the State of
Georgia, prohibiting the distillation of
corn, wheat, potatoes, and all ether kinds
of grain or material out of which spiri
tuous liquors are made, be and the same
are hereby repealed.
Sec. 2 Repeals conflicting laws.
An Act to ratify certain acts of Execu
tors, Administrators, Trustees and
Guardians, and of Judicial and Minis
terial officers, and for other purposes
therein named.
Sec. 1. The General Assembly of the
State of Georgia do enact, That all the
nets and sales of Executors, Administra
tors, Trustees and Guardians, and of Ju
dicial and Ministerial officers, had, done
nnd performed and made bona fide in
pursuance of and under color of law,
since the 19th day of January, A. D.,
1861, or in pursuance of any judgment,
decree or order of a Court of competent
jurisdiction of this State, be and the
same are hereby ratified and confirmed,
subject, however, to the right of appeal
and supersedeas according to law: Provi
ded, that in cases in which judgments or
deerces have been rendered in Courts of
Record iu this State since the 10th day
of January, A. D., 1861, the party against
whom such judgment has been rendered,
shall be entitled to a new trial or appeal,
on affidavit that he was unavoidably ab
sent from tho Court at the time of the
rendition of the judgment: Provided,
the Court shall be satisfied from all the
facts which may be submitted by affidavit
by both parties, that such good and meri
torious defence exists, and that such
application for new trial or appeal shall
be made within twelve months after the
passage of this act.
Sec. 2. Repeals conflicting laws.
An Act to compel Rail Road, Steamboat
and Express Companies to furnish par
ties receipts for articles delivered, and
proscribe the penalty for refusal.
Sec. 1. Be it enactctl, <bc., That from
and after the passage of this Act, when
ever any person shall deliver any article,
thing, commodity, or property of any
description, to any Rail Road, Steamboat
or Express Company in this State, for
transportation, it shall be the duty of
such Company, upon demand, to furnish
the party so delivering, a good and valid
receipt for the same, with proper revenue
stamps attached thereto, and 6aid receipt
shall specify the weight of said article,
thiog, commodity or property thus deliv
ered, whenever the value can be estima
ted by weight, and i« all cases where the
value cannot be estimated, the receipt
shall give a general description of said
article, thing, commodity or property,
and shall also specify as near as practica
ble the quantity or ralue thereof, and
•bo the place of destination.
Sec. 2, Any agsut or officer of any
Rail Road, Steamboat or Express Com
pany violating the provisioas of this Act,
shall be deemed and considered guilty of
• high misdemeanor, and upoa conviction
thereof, shall be fined or imprisoned or
both in the discretion of the Court, the

to fill vacancies by the appointment of
Trustees in certain cases.
Sec. 1 Be it enacted, <fcc., That when
ever the office of Trustee in any incorpo
rated Company shall become vacant, or
may have become vacant, by death resig
nation, or otherwise, and the same for
any cause cannot be filled under the pro
visions of such charter of incorporation,
the Judge of the Superior or Inferior
Courts of the counties or Judicial Dis
tricts in which said incorporation may he
situated, shall have power to fill such
vacancies upon petition to said Judge of
either of said Courts, showing the cir
cumstances which render the appointment
of a Trustee or Trustees necessary and
proper.
A Comic Singer Sold at Auction.
On Friday afternoon a novel sale by
public auction took place within the
rooms of Messrs. Hutchinson & Dixon,
West Nile street, Glasgow. For several
days placards may have been observed in
the city, announcing the coming sale of
the services of Mr. James Taylor, describ
ed as “ The Champion Comic of Great
Britain.” On certain conditions for four
months, from Nov. next, to the highest
bidder, engaging to sing twice every law
ful evening in any establishment and in
any town to which he might be sent.—
The novelty of the affair doubtless excited
a good deal of curiosity amongst Mr.
Taylor’s professional brethren in the city,
who, on Friday afternoon, crowded into
“ the mart ” as the hour of sale approach
ed. At five o’clock Mr. Hutchinson
moved himself into a chair which was
placed on the top of the table, and
was soon afterwards supported on the
right by Mr. Taylor, for whom similar
accommodation in this elevated position
had been provided. The gentlemen who
were expected to become bidders stood or
were seated in front of the auctioneer.—
Many of them were smoking cigars, and
aa array of champagne which studded a
green baize covered table gave promise of
pleasure yet to come. Mr. Hutchinson
opened the proceedings by explaining the
circumstances under which he came to
occupy the chair; but before advancing
to the real business of the day he caused
the champagne to be handed round, while
the company smoked and chatted, chaffed
Mr. Taylor in a quiet way, and quaffed
his health with fraternal fervor. Thus
comfortably circumstanced the bidding
began. The first offer made was XI00,
immediately increase to XI10 ; but it was
