ORDINANCES OF THE TOWN OF
THOMASTON, ADOPTED BY THE
TOWN COUNCIL MARCH sth, 1872.
Be it Ordained by the Town Council of the
Town of Thomaston , by the authonty in
them vested by Charter incorporating slid
Town and the Acts amenditory thereto ,
this the sth day of March , 1872
Section I.—Adj person within the Cor
porate limits of the Town of Thomaston,
Who shall be guilty of making any loud, or
unusual noise, by hollowing, or otherwise
to the disturbance of a citizen, or citizens,
or inhabitants thereof shall be fiued or im
prisoned at the discretion of the Town
Council.
Sec. 2.—Any person who shall be guilty
of using loud, profane, or vulgar language
about the streets, lot, house or public places
in said Town, shall on conviction thereof
be fined or imprisoned, or both at the dis
cretion of the Council*
Sec. 3.—Any person or persons who shall
be found so intoxicated as to be realing,
staggering, lying or wallowing about the
streets* or who shall become troublesome to
the citizens thereof, shall be arrested by the
Marshall or his deputy and confined in the
Calaboose, until he or they become sober
and shall pay a fine at the discretion of the
Council.
Seo 4 —That any peraon w’bo shall be
guilty of shooting off any fire arms or dis
charging any Combustibles, within the cor
porate limits of the Town, except the firing
of the cannon by permission of the Council,
shall be fined in asuto not less than one,
hor more than twenty dollars, at the dis
cretion of the Council: Provided, that if
any good and sufficient reason be shown for
such shooting, then such fine shall not be
imposed.
Sec s.—That any person who shall be
guilty ofquarrelingor fighting with or With
out weapons shall be arrested and brought
before the Town Council and fined, or impris
oned, or both, and bound over to appear at
the next Superior Court, at the discretion
of the Town Council,
Sec. 6. —That if any person shall within
the corporate limits of said Town, hitch or
fasten any horse, mule or ox, to any fence*
Piazza post, or shade tree, such person shall
pay a fioe of not less than fifty cents, nor
more than five dollars and the Marshall or
his deputy is hereby authorized and requir
ed to seize and bold such horse, mule or ox
until the fine and all expenses for keeping
such or animals, are paid.
Seo, 7.—That if any person or persons be
found in the Corporate limits of the Town
in idleness and without a visable means of
support, it shall be tho duty of the Marshal
or his deputy to arrest such person or per
sons and bring them before the Council for
investigation and if found guilty of Vagran
cy he or they shall be put to work on the
streets of said Town for not lees than five
nor mbte than twenty days, for each offense,
at the discretion of the Council.
Sec. B. —Vliat all persons before engaging
in the sale of spiritous ar fermented liquors
in quantities ndt less than one quart shall
pay a license often dollars, for each twelve
moths so engaged.
Sec. 9. —That all persohe before engaging
in the sale cf spiritous or fermented liquors
in quantities less than one quart shall be
required to take out a lisense for which he
shall pay one hundred dollars for each twelve
roonts.
Sec. 10.—That any person or persons who
shall sell spiritous or malt liquors in quan
tities of five gallons or upwards shall be
considered a wholesale dealer and shall pay
a licenpe fee of one hundred dollars per
annum.
Sec. 11.—That any person or persons who
shall obtain a license under either of the
forgoing Section to sell intoxicating or malt
liquors and who shall be guilty of giving,
or selling the same to any minor without a
written order from the parent, or guardian,
or to any persons apparently intoxicated at
the time, or who shall be guilty of giving, or
selling the same on the Sabbath day, shall
forfeit his, or their license.
Sec. 12.—That it shall be the duty of the
Clerk of'the Council to issue license to sell
spiritous liquors in conformity to the Stat
ute in such cases made and provided upon
thee payment of the fees prescribed in these
Ordinances and his fees for issuing the
same.
Sec. 13.—That all Circuses and Menag
eries shall pay a license of twenty-five
dollars for each day they may exhibit
within the corporate limits of the town of
Thomaston, and all side shows attached to
Circuses and Menageries, or any itinerant
exhibition or show for which a charge is
made for admittance, shall pay a license of
five dollars for each and everv day they
exhibit. And the Marshall or his Deputy
is hereby empowered to seize so much of
said property as will make the sums afore
said, in case said sum or sums be not paid
before exhibition.
Sec. 14.—That any person who shall
wantonly cut down, destroy or injure any
shade or ornamental tree within the cerpo
rate limits of said Town, shall pay a fioe
not exceeding five dollars for each tree so !
cut down, destroyed or injured.
Sec. 15.—That owners or occupants of
lots shall keen the same free from ali stag
nant waters, decaying animal matter, and
other nuisances, and upon failure to do so |
and after being notified to remove the same
by the Marshal or his Deputy, shall be
fined not less than one dollar for each and
every day he permits the same to remain.
Sic. 16. That any person or persons
who shall place any obstructions in any of
the streets, road* or side Walks, Within the
corporate limits of said town, (except for
building purposes) shall be fined at the
discretion of the Town Council. Provided,
that if such obstiuctioos be fuel or the like,
and be removed within twelve hours, then
the fine shall not be imposed.
Seo. 17.—That if any person or persons
shall allow any pile of shavings, chips,
straw or the like, in boxes, barrels,
hogsheads or orates, to remain so near any
building as so endanger the same if the
said shaving*, chips or straw should be
fired, such person so offending shall be
fined in a sum not exceeding five dollars.
Sec. 18.—That the Marshal or his Depu
ty shall have power to summon any person
or persons to assist in arresting any offend
er, or to assist in the execution of any of
the ordinances for the town ; and upon
the refusal of any person to so assist, he
shall be fined or imprisoned at the discie
tion of the Council.
Seo. 19.—That any person who shall
test the Council or any member thereof
with contempt or disrespect, while in ses
sion, shall be fined or Imprisoned at tho
discretion of the Town Council,
Seo. 20.—That any one resisting the
Marshall or his Deputy in the execution of
his duties, shall be fined or imprisoned, at
the discretion of the Town Council.
Sec. 2l.—That it shall be the duty of
each citizen residing in said town, to render
to the Marshal, on oath, the amount aod
value of all property not exempt from tax
ation by the State tax laws, which he or
she possessed in his or her own right, or in
the right of any other person, on the day
of call in each and every year; and upon
failure of any person to do so, it shall be
the duty ot the Marshal to assess a double
tax upon the property of such person. And
it shall be the duty of the Marshal to collect
all tales assessed when ordered by the
Council.
Sec. 22. — That vritnes es may be sum
moned to attend and testify before the
Town Council, which summon shall be
issued by any one of the Council, or by the
Clerk, under the authority of one of the
Council, and served by the Marshal or his
Deputy, and if any person or persons re
fuse to comply with such summons he or
she shall be arrested by the Marshal or his
Deputy, and brought before the Town
Council and fined or imprisoned at their
discretion for 6ueh failures.
Sec. 23.—That it shall be the duty of
every person or persons keeping a Billiard,
or Pool Table, or any table of game kept
for the purpose of game, or Ten Pin Alley,
or an alley of any number of pins, to obtain
from the Clerk of the Cooncil a licene for
each and every such table, or alley such
person may keep, which License it shall be
be the duty of the Clerk to issue for a peff
od of twelve months, upon receiving from the
applicant a tax of fifty dollars for each Bil
liard, or Pool Table, or such other Table,
and also a tax of fifty dollars lor each Ten
Pin Alley, or any such Alley from the per
son desiring such license and any person
neglecting, or refusing to take out a lioense
as required by the Ordinances shall for each
and every day such person shall neglect, or
refuse, be liable to a fine of one dollar per
day, or imprisoned at the discretion of the
Town Council, and all fines imposed by
virtue of the Ordinances now of force, or
may hereafter be made in said Town of
Thomaston by the Town Council thereof,
shall upon the failure of the person, or per
sons upon whom said fine, or fines may be
imposed* be oollected by the Marshal under
process of execution to be issued by the
Clerk of the Town Council.
Sec. 24. —That each and every Pedlar, or
Itenerant Trader, shall pay a tax of five
dollars for each and every day such Pedlar,
or Itenerant Trader shall oiler for sale
within the corporate limite of said town,
any goods, wares, or merchandise, not ex
empt from taxation by the laws of the State
in regard to pedling.
Sec. 25.—That any itenerant auctioneer
who may bring goods, wares, or any article
of trade within the corporate limita of said
towi shall pay a Lioense of ten dollars for
each and every day he may offer such goods
for sale, either at auction, or at private
sale ; any person failing to take out such
License, the Marshal is impowerd to seize
so much of the goods as will pay the License
and all cost.
Sec. 26 —lt is hereby ordained by the
Town Council that a capitation tax of three
dollars per annum be levied on every male
inhabitant within the corporate limits of
said town subject to street duty, for street
purposes and the Marshal is hereby empow
ert’d*nnd required to employ such force from
time to time, as may be necessary for this
purpose, provided in all cases each band
may be allowed to work out his tax, at such
pnoe per diem as the Marshal may think
just and right: Provided further, that if
any one shall refuse, or fail to comply with
the above ordinane, it shall be the duty of
the Marshal to work said delinquents on the
streets the term of six days in each year
Stc. 27.—That the keeping of Faro or
Faro Tables and betting at cards is posi
tively prohibited within the 1 mite of the
town of Tbomaston. and any person keeping
such table or tables, or betting at cards
shall be arrested the Marshal or his
Deputy, and brought before the Town
Council to be dealt wsth by a fine not to
exceed the sum of ttenty dollars, and be
bound orer to the next Superior Coart fol
lowing, ti answer for such offense against
the criminal laws of this State.
Src. 28 —That the Marshall be and he
is hereby empowered and required to arrest
any and all parties violating criminal or pe
nal laws of this State, and bring them before
the Town Council to be dealt with or be
bound over to the next Superior Court
thereafter, to answer for such oTenee com
mitted in the townof Thome.ston.
Sec. 20.—That if any person shall bring
and expose to sale a new stock of goods,
wares or merchandise, not heretofore given
in under the tax laws of said Town, shall
be subject to the same tax assessed and
collected of the regular merchants ; and if
such person shall fail to make his annual
return, be or they shall pay a tax of two
per centum npon all sales made until the
same be regularly retdrnod to the proper
officer, such sales to be returned, under
oath, at the commencement of each month,
and payment thereon made to the Marshal
or Clerk of the Coancil.
Sec. 30.—1 t shall bo the daty of tho
Marshal or his Deputy to preserve order
within the corporate limits of said town on
the Sabbath day ; to see that no games of
any kind aro engaged in, or other unlawful
amusements on that day, and to seo that
no loud talking, o? hollowing ia done on the
public streets^
Skc. 31.—That if any person who shall
have any dog or dogs, or any at imal run
ning at largo that is vicious or a naisanoe
to the inhabitants of the town, such person
or persons shall be fined at the discretion
of the Council, and shall pay a fine of ono
dollar for each day such nnisance shall
continue after notification by the Marshal
to remove the same.
Sic. 32 —That the running at large of
horse, or mule is positively prohibited
within the corporate limits of the town of
Thomafltob, also tho running at large of
cattle or any other stock, which are known
to be in any way mischievous, is positively
prohibited, and the Marshal is hereby
authorized and required to take up all such
stock and impound the same, wtrd the owner
shall be required to pay a fine of not less
than fifty oents nor more than fivo dollars
and all cost and expensesfor taking up and
impounding such mule, horse or oattle.
Sec. 33. —That any person, or persons
Who shall within the corporate limits of the
town, be gnilty of the cruel practice of
fighting Chickens with metal gnffle for
amusement, or for tho purpose of betting
on the same, Rhall be arrested by the Mar
shal and brought before the Council and
fined at the discretion of the Council.
Sec 34.—That on and after the first day
of August next, all dogs found upon the
streets of tha town of Tbomaston without a
collar to be furnished by the Clerk of the
Council, shall be taken up, or killed by the
Marshal. The Clerk shall number each
collar and keep a record of the same, and
deliver it to the person so applying upon
his paying the price of the same.
Sec. 35.— 1 t shall be the duty of the Mar
shal to collect a fine of one foliar from any
one who may begoiltj of running horses, or
mules, on any of the public streets of the
town of Tbomaston.
Sec. 36. —That it. shall not be lawful for
any person to build, have, or keep any
privies, nor dig, have, keep, or sink a well
for a privey nearer than fifteen feet of any
street, or public alley under penalty of not
exceeding twenty dollars. If not removed
within five days after a written notice given
to him, her, or them, by the Marshal, ha
shallcause it to be done at as reasonable *
cost as possible. The expenses of such re
moval and five dollars for the Marshal, shall
be paid by the owner, or occupant of the
premises, wbioh if he shall refuse; execution
shall be issued therefore against him and
the Marshal shall proceed to collect it.
Be it ordained by authority io us vested,
that the above and foregoing thirty six
sections, be and they are hereby declared
of force from this date, as the Ordinances of
the town of Thomas on, until repealed, or
amended, hereby repealing all conflicting
Ordinances.

opposes Mr. Greeley, remarks:
