BY virtue, and in pursuance of an act of Congress,
to promote the reconstruction of the State of Georgia,
approved, December 22d, 1869, of which the following
is a copy, to wit:
AN ACT to r promoto the reconstruction of tho State
of Georgia:
Be it enacted tv tie Senate and Route of fiepreten-
alive* of the United State» of America, in Congreet
attemhled. That the Governor of the State of Georgia
bo, and hereby is, authorized and directed forthwith,
by a proclamation, to summon all persons elected to
the General Assembly of said State, as appears by tho
proclamation of George G. Meade, the General Com
manding the Military District, including tho State of
Georgia, dated Jane 25th, 1868, to appear on somo day
certain, to bo namedinsaid proclamation, at Atlanta,
in said State, and, thereupon, the said General As
sembly. of said State, shall proceed to perfect its or
ganization, in conformity with the Constitntion and
laws of tho United States, according to the provisions
of this act.
Sue. 2. And bo it farther enacted, That when the
members so elected to said Senate and House of Rep
resentatives, shall be convened as aforesaid, each and
every member, and each and every person claiming
to be elected as a member of said Senate or House of
Representatives, shall, in addition to taking the oath
or oaths required by the Constitution of Georgia, also
take and subscribe, and file In the office of Secretory
of State of tho State of Georgia, ono of tho following
oaths or affirmations, namely:
”1 do solemnly swear, or affirm, as the case may be,
that I have never held tho office or exercised the du
ties of a Senator or Representative in Congress, nor
been a momber of tho Legislature of any State of the
United States, nor held any civil office created bylaw,
for the administering of *ny general law of a State or
for the administration of justice in any State, or un
der the laws of the United States, nor held any offico
in tho military or naval service of tho United States,
and thereafter engaged in insurrection or rebellion
against the United States, or gave aid or comfort to
its enemies, or rendered, except in consequence of
direct physical force, any support or aid to any insur
rection or rebellion against the United States, nor
held any offico under or given any support 4o any
Government of any kind, organized or acting in hos
tility to tho United States, or levying war against the
United States,so held mo God; or on the pains or
penalties of perjury as the case may he: or the follow
ing oath or affirmation, namely: ”1 do solemnly swear
or affirm, as the case may be, that I have been reliev
ed by an net of the Congressof the United States from
disability as provided for by Section 3d of the Four
teenth Amendment of the Constitution of the United
States, so help me God: or on the pains or penalties
of perjury, as the case may be;” which oath or affirma
tion, when so filed, shall be entered t-n record by the
Secretary of State of the Stato of Georgia, and said
oath or affirmations, or a copy of the record thereof,
duly certified by said Secretary of Stite, shall he evi
dence in all courts and places, and every person claim
ing to bo so elected, who shall refuse, or decline, or
neglect, or be unable to take one of said oaths or
affirmations above provided, shall not be admitted to
a seat in said Senate or House of Representatives or
to a participation in tho proceedings thereof, bat shall
be deemed ineligible to such seats.
Sec. 3. And bo it further enacted. That if any per
son claiming to be elected to said Senate or House »
Representatives as aforesaid, shall falsely take either
of said oaths or affirmations, as abovo provided, he
shall bo deemed guilty of porinry. and shall suffer the
pains and penalties thereof, and may bo tried, con
victed and punished therefor, by tho Circuit Coart of
the United States for the District of Georgia, in which
district said crime was committed, and the jurisdic
tion of the said court shall bo sole and exclusive for
the purpose aforesaid.
Sec. 4. And be it further enacted, That tho persons
elected as aforesaid, and entitled to composs said
Legislature, and who shall comply with tho provi
sions of this not by taking ono of tho oaths or affirma
tions above prescribed, shall thereupon proceed in
said Senate and Uonso of Representatives to which
they havo been a’ectcd respectively, to reorganize said
Senato and House of Representatives respectively, by
the election and qualification of tho proper officers o
each House. t
Sec. 5. And bo it farther enacted. That if any per
son shall by force, violence or fraud, willfully binder
or ipterrupt any person or persons elected as afore
said from taking either of tho oaths or affirmations
prescribed by tho act, or from participating ia the
proceedings of said Senato or House of Representa
tives after having taken one of said oaths or affirma
tions and otherwise complied with this act, ho shall
be deemed gnilty of a felony, and may be tried, con
victed and punished therefor, by the Circuit or Dis
trict Court of the United States for the District of
Georgia, in which district said offense shall be com
mitted, and shall be panished therefor by imprison
ment at hard labor, fqr not less than two nor more
than ten years, in the discretion of the conrt: and the
jurisdiction of said courts shall be sole and exclusive
for tho purpose aforesaid.
Sec. 6. And be it farther enacted. That it is hereby
declared that the exclusion of any person or persons
elected os aforesaid, and being otherwise qualified,
from participation in tho proceedings of said Senate
or House of Representatives, upon the ground of
race, color or previous condition of servitude, would
be illegal and revolutionary, and is hereby prohib
ited.
Sec. 7. And he it further enacted. That, upon tho
application of the Governor of Georgia, the President
of the United States shall employ soch military or na
val forces of the United States, as may be necessary
to enforce and execute the preceding provisions of this
act.
Sec. S. And be it farther enacted, That the Legis
lature shall ratify the-Fifteenth Amendment, pro
posed to the Constitution of the United States, before
Senators and Representatives from Georgia are ad
mitted to seats in Congress.
I hereby issue this, my proclamation, to sainmon
all persons, elected to tho General Assembly of the
State of Georgia, as appears by the proclamation of
George G. Meade, the General commanding the Mili
tary District including the State of Georgia, dated
June 25th, 1868, who aro qualified, to appear at Atlan
ta, in said State. on Monday. Tenth (loth) Day of Jan
uary next, whereupon such of tho said persons aB are
qualified to hold office, in accordance with the provis
ions of tho act* of Congress in such cases made and
provided, will be organized in the Senate and House
of Representatives, respectively, as the provisional
Legislature of the Stato of Georgia, for the purpose
of promoting tho reconstruction of Civil Government.
