1)iKa.lb, Mias., Sept. 8 —The taking
of testimony in the case of William
Gaily, on trial for the murder of MUs
Cornelia Chi-holm, commenced this
morning. Thirty-two witnesses were
sworn for the State, and thir y-eight for
the defenes, who, under the rule, were
excluded from the ooart rtom and sepa
rated
Mrs. Chisholm waa the first witness,
aad testified that an excited crowd of
men entered DeKtlb on the evening of
April 28,1877. It waB largely increased
on the following morning. Sinolair, the
sheriff, arrested her husband
the morning of the 29'h. He
asked to be placed under guard
at his own house, and sought an instaot
investigation of the charges against him.
Armed men kept coming aronad the
house. Soenff Sinclair oonrerssd with
them and iben talked to Chisholm.
Chisholm esid “Yon cowardly scoundrels,
von will kill me before evening, bat be
fore you do it I will mike 'some of yon
bite’he dust.”
Sinclair came to my bniband
about 11 o’clook and said “tney say you
jnnbt go to juiL” McLellan, myself, my
sons, Clay, Johnnie and Willie and
daughter Cornelia aooompanied my hus
band to jail. We wore dinging to him
to shield his body. Mr. Moeety and
Mr. Overstreet were inside the jail
with the party, and the lower floor of
the jail a as loosed behind them.
The family were up stairs and locked
in from the inside. I was sent home by
my husband on an erran 4 . I beard the
hriDg ae I cime back towards the jail
and saw old man MeLsllan fall, pierced
by several buckshot, behind the j ail
racked inside the jail and found the
stairway crowded with men.
Boaser was at the top of the stairs and
William Gully trying to break the lock
of the upper door with axes. My daugh
ter C.iceiia, eon Johnnie ar.d Mr. Over-
street were bolding the door on the in
side. My daughter’s face was bleeding.

soul, I will blow your brsir.a out if

open, and my little boy fell shot through
tbs heart. Some one inside fired and
Bosser fell dead. Two men caught
him by the heels and diaggod
him down stairs. My hueband
was bewildered at the death of Johnnie.
I and my eon Clay carried the dead boy
down stairs. Cornelia and father came
down stairs. Henry J. Gully came up
and raided his gun. I closed the grated
door at the bottom of the stairway.
My daughter clasped my huEbsni
around the neok. Gully fired throueh
the grating in the doar. Mydaughter
screamed, “I am shot.” Judge Chis
holm opened the dcor, and as he stepped

ing room with another gnn and fired
ogiln at him, and he fell. Clay and I as
sisted my husband in reaohtng home.
My daughter was bleeding in
tbo face, wfh her eyes blackened
by & blow. She was shot in the wrist,
in the ankle and the heel. She was shot
by Henry Gully, she died on the 15th
jo May. She died from the effects of her
wounds. Mrs. Chisholm produced Cor
nelia's bracelet, which was broken sn I
driven into her arm ; also five bnckshut
taken out of her body.
DkKalb, Miss., September 9—The
trial of Henry J. Gully, for the murder
of Cornelia Chisholm, is still progressing.
The State is attempting to establish a
conspiracy.

making the arrests, thinking he might
need assistance. He found Chisholm at
his home, and toid his husinest; Chisholm
laughed at it. He placed men to guard
Coi-holtn. A crowd during morning
gathered around the house. Among
them was Henry Gully. Chi.»
holm sent for him
come to the bouse. Ol his arriving,
Cbiuholm said to Gully, “You think I
killed your brother, John Gully?'’ Gully
responded: “if you did not kill him,

did not deny tbie, but only said, * T don’’
want to die just now." Witness objected
to McLellan, the Scotchman, going ae
guard to the jail, because he fear< d tome

On the cross examination, defendants
counsel attempted to show by this witness
that McLellau was distasteful to the
crowd and to the people generally, n«r
because of his being a Bspublioin, but f r
other reasons entirely different—princi
pally on account of nis bemg a bad man.
Tue State objected to further inquiry in
to the Sheriff’s ressons for apprehending
barm to McLellan and the Court sustained
the objection.
The witness stated that the keys of the
jail were twisted from his bands while
Chisholm and his family were in the jaij.
He did not see any shooting. He was at
the bnrial of John W. Gully. Several
hundred people were present. Their ac
tions caused bim to suspect senou
trouble was brewing.

DeEalb, Mias., Sept 10.—The State
at five o’clock yesterday afternoon rested
its case in the trial of Henry J. Gaily for
the murder of Cornelia Chisholm. Tbe
object of the prosecution has been to es
tablish a conspiracy on tbe part of the
defendant end others to kill Chisholm,
Gilmore and Rouenbium, and in carry
ing it into effect, Cornelia enl other par
ties were killed.
Among the declarations made after the
killing of Cnisholm going to show con
spiracy, was tbe declaration by the de
fendant, “we have done what we came
to do, and now if there is any hanging
to be done here ia my neck.” The testi
mony of the defence hoe tended to con 1
tradiot eons of the material statements
of the wilne sea for the prosecution i ■
to tbe prisoner in jail; who shot Cornelia
and Judge Chisholm; as to what parties
in tbo crowd had guns; tbe otions of the
defendant in jail during tbe firing and
the relative positions of all tbe parties.
C. C. Stewart, one of the jurymen,
has been ill eiooe tba adjournment last
night. On his aeoonnt, it has been impos
sible to proceed with the trial to-day.
It is hoped that he will recover sufficient
ly this afternoon to allow the casa ta
proceed- The defendant has a number of
witnesses to testify on other points
brought ont by tba proseoation. Argu
ment will probably begin to-morrow.

ists in tbe India office that the outbreak
in Afghanistan has assumed larger pro
portions than was at first supposed.
Tlia Battalion to Savannab.
We learn that there is a movement on
foot to endeavor to get the Second Geor
gia Battalion, or as many of the compan
ies of the corpa as can do so, to go to the
Jaeper Centennial in Savannah. The in
tention is that the oompaniea go in a
battalion under oommasd of its officers.
Tnis is a good ids a, and those moving in
tbe matter think that there will not be
any difficulties in the way under •
present liberal inducement ol tbe rail
road, and the schedule arranged for the
ocoseion. It will be necessary for at least
three oompaniea to go. Two, ths Volun
teers and the Floyd Biflrs, have deter
mined to go. It is believed that from the
remaining companies composing tbe
corps at feast one other and perhaps all
will ba able to take tbe trip. We hope
the matter will be considered. The Ma-
oon companies hope they will be joined
by the Baldwin Blues and the Painam
B.flis. The city of Savannah will be
fall of companies on ..that oecasion, and
one of the largest gatherings of volun
teer soldiery will take place that has ever
been known in that oity. Tbe Chatham
Artillery, besides en’ertaining the Rime
Light Guards, Cherokee Artillery of
Borne, and the Washington Artillery of
Caarieston, will look after the Maoon
Volunteers. Tne Montgomery B>flss, of
Charleston, will also be the guest of one
of tbe Savannah companies. Augusta
and other cities will also contribute to
the ranks of the ary pagpant.
