J.—Whero a bill was filed to enjoin a jndgmont at law and praying for a now trial, and it appeared by the answer that an affidavit of illegality had boon previously adju dicated upon which tho questions involved in this bill were involved, or might have been em braced therein. Held, There was no error in the court refusing the injunction. ITeld again. That the verdict of the jury, that tho defendant in execution was in posses sion of tho land levied on at the commencement of this suit, and that tho notes, the foundation of tho suit, were given for the land, rendered on tho trial of tho affidavit of illegality, was an odjndioation of tho rights and equities of tho parties under tho relief aet of 1868. J.—Where a married woman separates from her husband and institutes suit for permanent alimony, and tho husband in re sponse sots np by way of cross bill a prayer for the reformation of nn ante-nuptial settlement sot np by her in the bill, and by consent of par ties tho conrt reforms tho instrument, and de crees permanent alimony to the wife with coun sel fees: Held, That tho wifo, in the fact of her sepa- tion and tho inslitntion of such suit, was scu juri», and by tho decree for permanent alimony was barred of dower or fntnre interest in the estate of her knsband at his death, under sec tion 442 of the Code, and the decree in the premises was binding upon all parties until it was sot aside. J.—Whero the plaintiff in an action of ejectment, pnt in evidence a perfect paper title from tho StAte to himself, and the defendant relied npon n statutory title under claim of right, and there was conflicting evi dence ns to the time of advorso possession, and the defendant himself was the witness un- dor the nt of 18G6 : Held, That the question of his credibility was n question exclusively with tho jury, and whero tho facts of the caso show that substan tial jnstieo has been done, thongh the charge of tho court may have contained some error, this court will not interforo to set aside the ver diet. Judgment affirmed. Note.—McCay, J., did not preside in this caso. Hawkins & Burke, for plaintiff in error. Lyon Sc Irvin, for defendants. M. M. Smith et al. vs. W. A. Magoarioh et al. Injunction from Dougherty. Lochbane, O. J.—Whero, under an act of the Legislature, a now county was organized, and tho voters required by ballot, under the usual superintendents of such elections, to lo cate the county site, and in casting their bal lots vnrions places were designated, which the commissioners, appointed by the Legislature, together with the Ordinary elect, from their contiguity to each other nnd a common under standing among the people as to what was meant, held to be one and the same thing, and consolidated tho various votes, which, by addi tion together, gave a majority over the centre of tho oounty, which was also voted for; and such commit stonera proceeded,under the aet, to layout town lots and offer them for sale; and other citizens dissatisfied with their judgment brought a bill of injunction to enjoin such com missioners, and the court below grantod tho in junction upon the hearing of the various affida vits pro and con touching the premises. Several witnesses testified that theso various places were not the same, and a much larger number testifying that they were : Held, Under the facts in this case, that a conrt of eqnity had jurisdiction at tho instance of citizens of the connty to enjoin the com missioners from doing what they alleged to be an illegal act, which rosnlted to their injury as tax-payers and property holders of the connty. Held, again. Under the facts in this ease, that tho question of location upon the part of the commissioners, being a question of dispnied fact, «re ennnot say that the Jndge violated the discretion vested m him by law in granting the injunction: and we therefore affirm the judg ment with the following modification and direc tion, to-wit: that tho place selected by the commissioners and located by them, shall remain as now located, as the place for the transaction of county business by tho officers of said coun ty, who may make such arrangements in con nection with the commissioners for the holding of courts at that place as may to them seem proper until the final hearing of this case.
