The Receiver assessed tho capital stock of tho company at $102 00 per share on its six thousand shares of capital stock, as tho ad vcbtrtm or market value of the stock on the let day of April last, whereas tho com plainant alleges that said Augusta Factory, being an incorporated company, was bound only to return and pay a tax on six hundred thousand dollars, or $100 per share on its six thousand shares. On hearing the application for an in junction, the same was granted by. the presiding ■fudge, whereupon the defendants excepted.
