That a witness who only know of the existence of the contract from hearsay, might testify that. In making Ibo delivery, tho parties acted on tho oontiart, since this is no more than saying that they acted on what they claimed, or supposed to be, the contract. The testimony does not go to show there was a contract, but to eiplslo tho delivery, and is admissible as part of the ret i/ethr. •J.
