Waatixa, J.—This was a bill filed by the oompiainanla against tbo defendants, aa the S urchaacr of certain specified tracts of land at heriff'a sale nnder a fi. fa. against the defend ant, N. F. Walker, praying for an injunction to restrain them from prosecuting their respective claim* to a homestead on tho land so purchased by him at anefa Sheriff'« sale. The bill alleges that the defendants are fraudulently combining to obtain homestead* on tho land for tbo bene fit of N. F. Walkor, ono of the defendants, the other defendant not being entitled to a home stead nnder the law, and that tho complainant not being a craditor of tbo applicants fora homestead, cannot bo heard in tbo common law courts to object to the granting of the same. The lull waa domnrrcd to for want of equity, and because it was multifarious. Tbo court ■attained the Utter ground of demurrer and amended the former, both parties exoepted. Wo think the court erred on liotb grounds. If there wss equity tn the bill, the chargo of a fraudulent combination between the defendanta to obtain n homestead for one of them would r.ot mako (he bill mnitifariona, bnt would relievo it from that objection on de murrer therefor. Althongh the complainant as a purchaser of tho land at Sheriff's sale ia not a creditor of the applicants for a homestead on tho land so purchased, still, ho derives bis title to tho land nnder the jndgment of a creditor, and may nrgo the same objections in thu Court of Ordinary, or in tho Supreme Court, on an appeal therefrom, aa the creditor could have done nnder whose jndgment and elocution ho derives hla title to the land. In other words, the purchaser of the land nnder a judgment in favor of a creditor nt Sheriff's sale on which a homestead ia claimed, is as much within the reason and apirit of the Act ot 1S«8, aa the creditor nnder whose judgment he derives bis UUe, may bo heard and make the same objec tions to granting tho homestead as the creditor ooutd hnvo done.
