IIM, again, Thai the evidence being that only $800 was received npon tbe note due at twelve months for $1,13(1, and $731 83 waa pali! at maturity, that the difference between $800 and legal Interest for one year, tbe lawful principal of tbo note, and the payment ia the amount duo, with interest, by tbe maker to the indoiwo, and we hold that tbe vordiet is in ex cess of tho amount duo under the ovidence, and ought to have lieen for $134 18, principal with interest from 13th January, 18(18, and direct that the verdict conform to this amount, clue a now trial lie granted to Jano Frank, tbe prin cipal, and M. Frank, the security. JIM, again. Under our Code, juries may find rquitabln verdicts, and that the verdict against Guild, tbe indorser npon the note aned, stands 'affirmed. J.—When npon the trial of a bill filed to restrain tbo collection of nots* given for tbe purchase money of land, both cases, tbe common lav unit and bill being filed together, it waa charged that, by the misrepresentation and fraud of the vendor as to the boundary of tbe land, tbe vendee mado the purchase, and by auch fraud he had been misled into expenses in preparation ao far as making brick, for which purpose bo bought tho land, and which was known to the vendor at the time of tbe aalo and (he court rejected tbe evidence offered by tbe oomplainant, the vendee, to show his damages resulting from the alleged fraud and also as to t le quality of tbe land. //•Id, That thia ruling by (he court was error. IIM again, That it waa error to rule out evidence of the deficiency of the quality of the land under section 3600 of the Code apportion ment of the price as well when the purchase has been by lot as per acre may be bad when deception or mistake amounting to fraud is proven, which is for the jury and not the conrt to determine. Under our opinion wo hold that the whole cave, with the evidence offered, ought to have lieen submitted to thr jury, and let than weigh it under the legal rulea governing evidence.
