Nothing, however, waa done about it until ihe
present session, when the Legislature directs
tbe levy and collection of the tax, involving, of
course, an aocnmnlation of taxes for soeoeasive
years. Tbe press will feel nnder obligations to
tienator Bimmons and others who were.disposed
to pnnne a liberal policy on tbe subject; K "'
whatever may be tbe thought about tbe ;—
ptlety of tbe levy, there onght to be no donbt
of ibo fact that the Legislature should have ex
tended ibe time for the collection of arrearages.
It will bo easily seen that a levy of three or
four years' accouinlaled taxes on toe people —
large npon a few days’ notice, to this financial
pinch, would send too tax-payer* into utmost
universal bankruptcy; and wo ore certainly not
aware that tbe printers, as a class, are above
the average pecuniary condition. Moreover,
Ibe majority of the prlnliog-offices have changed
hands since Ibe lax accumulation began, and
lime should have been allowed to adjust
personal rights and liabilities involved to —
premises, before peremptory levy on tbe prop
erty abonld follow failure of payments n“’
equitably duo from present holders. If it __
not too late tbo manifest equities to this case
should be consulted by extending the time fo*

cation presenting, for my consideration, certain
reasons why, to your judgment, Ibo collection
of tax an printers’presnea, material, etc., should
be auyed nntil tho reassembling of the Legisla
ture in January nrxl, and have to say to reply,
that 1 Lave no authority, nnder the law, to grant
the reqncs*. hrolion 70 of tho Code, vests the
power in Ibo Governor of tbe Stato alone, to
suspend tbe collection of any portion of toe
taxes, and I liavo therefore referred your com
munication lo biro. As tbo Legislature will
again convene at a very early day, I see no mate
rial Injury tbat ean result to the State by grant
ing your request, and I have therefore aaked
•ho lavninblii consideration of the same by the
Governor. I deem it but proper lo state, how
evor, Uiat I soa no reauon presented why toe
decision heretofore luado by this office, that
said materia] is taxable under tbe laws of Ibis
State, should bo disturbed.
