lUrawiT.—Tho Atlanta Herald, of yesterday,
says :
The down freight train due in Atlanta at 10}
o’clock, drawn by tho engine “ Chieftain,” witn
Conductor Lowe in charge, composed of three
Mock car* and ten coal cars, with Cab, was
thrown from the track two milos above Marietta,
yeaterday, by tho breaking of a tail. The en
gine and stock car—oonuining cattle, pawed
over the rail in safety, bnt tho two next cars,
lo* bni wiih cattle and males and hone*, and
three oara loaded with coal, were thrown vio
lently from the track—aou.e of them turning
completely over, and were amaahed to atoms,
killing three horse* and three mnlee. The escape
of the balance of the stock waa miraculous,
as the cars wore torn to pieces, somo of them
turned bottom upwards, and several mules
and ho net were crushed in the debris. The
injury to the balance of the stock of borses
and cattle in tbe crushed oua waa less
than oonld hare been expected. Save thoee
killed instantly, hut few were even slightly
injured. Tbo oan9e of the accident waa the
breaking of a rail. An examination of this rail
showed that there waa a flaw in it. One-tenth
of it was only aonnj, and it was so manufac
tured. Of oca me, the cifioers of the road ean-
not prevent accidents from faclty rails, but ibe
workmen engaged in repairing the road at the

subject should be investigated and, if necessary,
remedied as soon aa practicable. The lees sus
tained by tbe road for tbe horses and males
killed, wa* adjudged by Mr, W. A. Osborn, of
Kentucky, a dealer in stock, and two of the
railroad iuon, at $350; the damages to those in
jure Mr. Osborn declined to aasoas.
Contrary to aasuraccaa, we have reoeived on
the subject, from persons who ought to know,
the Herald aaya "it ia notorious that the track
of the road is in a wretched condition."
