We mentioned yesterday the formal ar
rest of Mr*. Mary Dukes, charged with
being principal in the second degree in
the murder of her husband, Nathan
Dukes. Yesterday afternoon tho prelim
inary investigation was commenced in
the Court-house, before Justices Adams,
Heath and Groce. A. Proudfit conducted
th- investigation<bi the part o* the State,
nn«l the defense was in the hands of Col.
L. N. IVhittle and Judge Jno. B. Weems.
The following is substantially the testi-
VmiKh a» he haJ |j nion y taken:
Mrs. Johanna Werung ft worn.—I know
MV*.' Dukes. (Identifies prisoner.) I
think tho difficulty occurred about nine
{o’clock. Mrs. Dukes said Mr. Dukes had
E tolen sixty cents. He said he Jrndn't
one any such thing. AJlittle while after
Dukes went into his store. I saw
Mr. Don Levy a little while after poos
into the store. I then heard a fuss and
heard Mr, Dukes holler. I stepped in
icud saw Mr. Don Levy have him
beading him. Mr. Don Levy took him
l>y the coat, brought him out and
threw Lira on the sidewalk. Mr. Dukes
lay there two or throe minutes before he
was .-k-nsiblo enough to get up. He
started toward one of tho little tre
front of the store. Ho said he hod
fnongh ; that Don Levy was a young man
nn-1 hg on old man. and ho (Don Leay)
nnd his mother had impos***! on him long
tonough. He turned round from the tree
And. 1 think, he started toward the store
A right smart language passed between
them. All of them were quarreling to
gether. Mr*. Dukes said Mr. Dukes de-
Jerved more than that beating. He had
■nppsed long enough on Jier nnd her son.
M r. Don Levy then went into the store
and Mrs. Dukes said he ought to kill the
Jcoundrel. As soon os she said that Mr.
Don Levy fired, and my old man fell
Two other shots were fired, and Mr.
Dukes ran np on the stoop and fell. He
| fired three times. When my husband fell
! ! didu't see any more. I saw Mr. Dukes
foil on thf stoop. Mrs. Dukes was stand
ing ou her stoop when tho firing took
place. Mrs. Dukes told her son that ho
ought to kill Mr. Dukes, and soon ns she
fciid that he fired. After my husband
fell I was rq scared that I didn't see any
more. They used a great deal of bad
lnngua*ge. She called Mr. Dukes a rob
ber, a l*ad man, a d—d — —, and
inch, Mr. Dukes said he was not much
worse than she was. Just before tho
firing Mrs. Dub's told Don Levy the
Renting was not enongh. He had im
posed long enough on her and her son
:ind he ought to kill him. Don Levy
then commenced firing. At the first shot
my husband fell. There was a great deal
erf lad language used before the killing,
most of it by Mrs. Dukes. Mrs. Dukes
said. ••Cornelius, you ought to kill th
d—d scoundrel.”
CrvM-tzamintd.—I live next doer to
Mrs. Dukes. I keep a shop the same as
she does. I had nothing against her. We
seldom spoke to each other. I had no
Imd feelings against her. I never, said I
would spt-iid money to run her away from
there. I know Marous Lowenthal.
Mrs. II.—Waxelbaum must have had
that Brussels carpeting given to him—he
sells.it so cheap.
Mrs. L.—No, he bought them during
the panic, and paid cash for them. Be
sides, at the New York Store they always
sell goods for less profit than anywhere
else.
Mrs. H.—"Well, I heard so before, but
never believed it. Mrs. E. told me at
the society last Friday she only paid 85
cents for her beautiful prune colored each-
mere at the New York Store, and I paid
Messrs. $1 for my ugly dirt colored
one. It makes me so mad to think about
it. 1*11 buy everything I want at the
New York Store hereafter. oct5 tf
