Loyless A Co. Loyless filed a plea of aim r*t /arivia, alleging that the note.< wm* signetl after the dissolution of the partnership and without his authority. Then* was also a count in tho plaint ilf* dtM'Israti«»n for gooils sold and delivered to the defendants as partners h. fore the dirfftotation of the partnership for which it was allegeil the two notes were given. On the trial of the ease the jury found is verdict for tho tlefendants. A motion was mode for n new trial on the ground that the verdict was contrary to tin* evi dence, and without evidence to sustain it. and luvnuse the verdict was rantrory to law, which was overruled, and tho plain tiffs excepted. The firm name of a. H. Loyhws A. Co. was signed by ]Vehli*i, one of the partners to thoso lust named notes. There was no evidence that the plaintiffs kuew of the dissolution of tin* partnership of E. B. Ix>yle«s A Co. at the time the j»artnership name was signed to tho notes by Peebles in Now York, except wliat was contained in the paper signetl by Boot, the plaintiffs, and some of the other creditors of Loylese A Co. for ou extension of time.
