jury that they might allow interest, or,
withhold it, that the allowance of interest

It is true that the 1497 section of the
Code declares that the surviving part
ner in ca«es of death, has tbe right to
control the assets of the firm to tne ex
clusion of tbe legal representatives of a
deceased partner, and be is primarily
liable to the creditors of the firm for
their d*bU. The statute, however,
gives tbe right to sue tbe representative*
of the deceased partner in tbe same ac
tion with the survivor, without qualifica
tion or rntrictldL If there are any le
gal or equitable grounds why the repre
sentatives of the deoeased partner should
not lie liable for the debt*, he can plead
and prose tbe same at the trial, and the
verdict can be so moulded as to do full
justice to the parties in the same manner
as a decrte-4tL. equity—Code 3604. The
right to join the representative of a.
deceased partner in the same ac
tion w;th the surviving partner
is one thing; what shall be the liability
of the representative of the deceased
partner in *ucb an action so brought, will
depend on the facts, and the law of part
nership applicable thereto, and the ver
dict and judgment should be rendered in
accordance therewith. By allowing the
representative of the deoeas-d partner to
be joined in the same action with the sur
vivor, the statute does not alter or change
the liability of partners as'defined by
law, but on the contrary it assume* that
the representative of thu deceased part
ner will protect himself by pleading any
legal, or equitable defense, tie may have
to such action so brought against him as
the representative of such deceased part
ner. There was no error, in view of the
facts of the case, in the refusal of the
Court to charge as requested in relation
to the question of interest, or in the
charge as given. Code, 2,894.

ing on his right to the $1,000, because he

into court the whole amount raised at the
sale.

ing. it not - appearing that any previous
claim of the same property had been put
in and withdrawn by the claimant.

tains. between Shandakin Centre and
WestkilL county, where snow and
ice can be found at all season* of the

deep hollow, founded on the two sides by
high mountains, with a clear, ioe cold
•tn am of water running down its centre.
Stretching across the head of this hollow
is another mountain somewhat higher
than Ibe others, that make* me think
thta passage" wav had suddenly termi
nated in a sort of de sac. but upon ar
riving at tbe base the rood turns directly
and enters a narrow path hardly fifty feet
in width. On each side the mountain
towers upward a thousand feet from the
roadway, not perpendicular, but oo steep
that when the trees have shed their foli
age the top can be seen by a person
etinding at the foot- There is snow and
ioe during the hottest days of summer a
few feet from tha roadway. There are
large ma*»ca of solid ioe in some caves
not farther than five feet from the road.
Strange as it may oeem, the growth of
vegetation is very rank, the lichens espe
cially covering the rocks profusely,
though animals are very scarcv, it being
too cold for their comfort.
