The memboxj of the tonsorial X'ro- feu-iion seem to think they are entitled to a full ilay's ro»t on S:tudjy, as well as other folks. Thomas Franklin plead guilty of sim ple larceny. He was charged with bur glary in the night. He wa* sentenced to twelve months in the chain gang. Peter King, convicted of assault with intent to commit rape upon a little negro giri fdur y*?ar* old, was nentt noed to ten years in tr.e penitentiary. Iliad Alien pleal guilty of larceny from the house of goods worth over §50, and was sentenced to fivo years in penitentiary. All t!.•• above convicts are colored. The Piko case is set down for to-mor row, and will probably be ^commenced. It will occupy several days. The Don Levy trial will follow as speedily possible. There is quite a number of other pris oners in jail, whose cases will probably be fiiiqtoecd of before the court leaves tho criminal docket. THE LATE RAILROAH COLLISION Tlic Conductor and Engineer of the Frelglu Train Tried and Acquitted All the readers of the Telegraph and M CMSENOZB, doubtless, havo a painful re- coll- *c tion of the late collision on the South western railroad, which cost two men their lives and seriously injured three others. It has been generally understood that the blame for this calamity, to considerable extent, rested upon the con durtnr and engineer who were running the freight train. At the instance of the anthor'ties of the rood. Conductor Matthews and En ginoer Frazer were arrested on the chargo of manslaughter, and they had their preliminary examination yesterday in the County Court room, before Justices Caxe. Heath and Adams. The pros ecu tion iras conducted by Messrs. Lyon Irvin and the accused were defended by Cols. Poe, Hall and Wooten. A good doal of testimony wxls heard and the case was ably argued by counsel on both sides. At th*s conclusion of the argument the charge against both of them was dis missed. Brown Jk Co. We call the attention of the trade and the public generally to their advertise ment and to their stock of goods. One of tho pleasantest social affairs that has transpired in Mneon in a long while, took place at tho Jirown House Friday night, on tho occasion of a supper given by Major J. D. Sproull, agent of the Howe Scales Company, to n few of the friends that ho hn. made in Macon. Tho following guests were present: Hon. IV. A. Uuf, Gen. Whi. S. Holt, Col. E. Grier, Messrs. S. M. Farrar, Jno. P. Fort Cha*. la Boss, Jasper F. Greer, Felix Corput, Francis I.ake, S. S. Dunlap, L. \V. Iiasdal, S. G. Bonn and B. C. Smith. Tho iiuppcr, which was gotten up under ho special direction of Billy Brown, would have dono credit to Dclmonico. It as elegant in every particular, and heartily enjoyed by tho guests. llut the feed was not the ultimate end and aini of the party; lienee tho table wns cleared of substantial* to make room for Madame Clicquot. Then tbo fun commenced, and gayety and wit pre vailed until near midnight, and toasts nnd responses followed each other in rapid succession. The first toast was by Maj. Spronll, lioproposed: *'Tho citisons of Macon. -.-Distinguished alike for their coolness of judgment and courtesy to strangers." Mayor IIufT, upon being oakod to re- ipond, t]>oko of the spirit and enterprise of tho IIowc Scales Company’s agent, the Major, who hod contributed so much to tho State Fair, for which, in tho namo of tho city he thanked him ; ho hoped his stay in litem lud been pleasant, and, in conclusion, proposed the health and pros perity of himself and tho company ho presented. Gen. Wm. S. Holt followed in his usual happy vein, saying that ho was callod upon os a railroad man, but railroads were too long to carry out tho idea of the Gov ernor of North Carolina who, upon a cer tain occasion, made an observation regard ing tho length of timo between drinks, and would simply reiterate tho wish of the Mayor- that Mr. Sproull would mako his stay among ns a pleasant one. Col. E. C.-Grier, of GriswoldviHe, said when he heard the “Howo” man wns around hoobaervod that those "machines" w ere in his neighborhood and didn’t worth a cent—didn’t know but that -’Spronlls” was a sewing machine man, till ho asked him in that "closet” at the Fair Ground, and in a quarter of an hour was convinced that if ho was on a committee he would decide in a minute who should have the “blue ribbon.” Had met the Major since, was pleased with him—didn’t know anything about scales, but would bet on ■Sproulls.” Mr. J. F. Greer followed Col. Grier. He said he was no speaker, bat would add his mite by telling a story, which he did with excellent gusto, and "brought down the house.” Mr. S. £. Dunlap said he was Howe’s agent, but feit that it was unnecessary to take charge of the whole family; that the business community l*cd adopted tho representative, Mr. Sprouil, jyid he felt confident to loavo him to "weed his own Thr Mayor’s Court. There were bat two names recorded in his Honor’s book yesterday, and they were George Shager and John West, both of whom were charged with stealing wood." Shager said he had been sent by West for a stick of wood abont 2 o’clock yesterday morning, and was toting it to West when tho officer nabbed him. West went clean back on Shager, and even de nied having any acqnantance with him. As it could not be proven that the wood was actually stolen both negroes were discharged. READING NOTICES. Tlio committee appointed at the last meeting of this company to report upon tho death of our gal lant frit-ml nml f.-llow->oltlier, (*u! m ! T. \V. Maxoiiam. in performing to-night their solemn office, do not think that it comes within the pro vince of that office to make this the occasion of nny extended account of hia life, cither m its pub- or private aspects; but rather believe tbeir purposefbest served by adverting briefly, but with heartfelt emotion, to those traits in his character, and those events in his life which served to cn- aar him so tenderly to this company, to this com munity, and to all who love tho memory of the cause for which he fought and bled. From his earliest manhood he has been Inti mately associated with the business men of Ma con; and, whether as clerk, merchant, qr bank his kind and gentlemanly deportment, his punctuality and faithfulness in business, together with his habits of extraordinary industry, ami his high moral character, gave him a reputation among those men which will remain In their memories bright and spotless, to the end. In the office of cashier he had few equal*, and certainly superiors. We all know how much he had at heart the interests of the bank in which he held that responsible office up to the time of his death* and the strength of the cords which bound him to those with whom ho was there so intimately con- led cannot be measured in words, it can only fdt. But we of the Macon Volunteers, more than all Others, save those stricken ones to whom he was united by family ties, aro called upon to mourn his loss. It was as a member of onr company that first entered f he service of his conntiy; and, though bo soon left its ranks fora higher posi- liis thoughts and affections eicr turned fondly to his old comrades. His subsequent mili tary career is familiar to you alb and it is suffi cient here to state that it only closed when he re ceived tho fearful wound which disabled him for lifts. His sufferings for many months were very great, but he bore them like the soldier that he was—heroic, bravo and true. As a field officer he won well deserved distinction, and but for the hurt of his being compelled to retire from active service, be would undoubtedly have worn the uni form of a general officer before the close of our struggle for independence. * In the reorganization and equipment of our company L»x services hare been invaluable, and for this wo owe him a debt of lasting gratitude. His mind was constantly busy devising some plan for the promotion of our welfare, and though the fell disease which took him from us bad already greatly enfeebled his body, yet we can safely say that he has done more for the company since its reorganization than any other member. As Sec retary and Treasurer, liis duties have been ex ceedingly verajious and onerous, owing to the correspondence and collections made r. by the uniforming of the company. These duties he discharged cheerfully and with an unwavering sea] and fidelity. The commission to which he was entitled in compensation for his services would have amounted to several hundred dollar*, but he generously refused to receive a dollar, thus largest contribution which has ever been ma.te to the funds of tho company. nis attachment to our corps wa* deep and last ing.
