The court ami counael have found tin

The case can hardly be concluded in

Yesterday waa the oddest day of the
season. In fact it was about- as uncom
fortable as days usually get to be down
in this latitadc. A cold wind was blow
ing all the while, persuading those who
could afford to do so to stay at close to
the fire as possiblo. A few flakes of snow
fell in tho afternoon. About dark the
clouds passed away, but the wind did not
abate, and wo had a dear, oold night.

We hnve information that the storm
did a good deal of damage to timber and
fences in Talbot county. In Tolbotton,
seven booses were blown down, and many
others were l-adly damaged. Our infor
mant avers that a brick building was re
moved two feet from its foundation; but
tbut latter statement we do not recom-
nstud to the credulity of our rentes. Wo
should at least want to sea one brick

ho would taka a bottle of wine. He took

they stood at the counter nearer tho door.
(Witness describes the saloon). Garrett
did not. ray anything to Baer. Bussell
or my brother was next to Baer on one
sido and Hertwig on the other. When
the killing took place, Piko, Boor and
Garrett were five or six steps away from
tho counter. I don't know how Garrett
came to go out there. 1 did not hoar him
called. Bussell and tho others stood
facing mo and I was behind the counter.
They were near together. Pike, Garrett
and Boer were also standing very close
together. I could not hear anything said
between thorn.

They were Pi^o and Garrett. (Describes
tho position of the men in the saloon.)
Garrett asked for two glasses nf beer.
Garrett then invited the whole party.
Piko introduced Garrett to Mr. Baer. Af

been such reports in circulation I would
most certainly have heard them. Mr.
Baer camo here two years ago this fall.
I got him his situation at the railroad,
and after he left there I employed him as
a cotton-shipper and book-keeper. He
had no reputation as a libertine here.

Tho court met at three o’clock and the
defense offered the the following rebat
ting testimony: 3
Mrs. Rachel PiIt, re-introdueeil—When
my son returned to New York and spent
a month, ho stayed with me, his wife and
his hildren. I never heard anything
about a divorce between my son, Lonis
B. Pike, and his wife. My son was never
in the New York penitentiary. I know
that he was never confined in tho State
prison.
In answer lo the Court—When my son
was back in New York he and his' wife
lived as man and wife usually do, and
were all tho time happy together.
Judge John B. U'eems, stcorn—I havo
known Louis B. Piko about three years.
I was general retained counsel for Mr.
Pike. Ho had n case before the Mayor's
Court. After that ho retained me as
counsel. In my intercourse with him in
tho back room of bis store, he frequently
spoke of his wife and children in an affec
tionate and endearin g manner, and showed
me the pictures of his wife and children.
That was long before this occurrence.
Ono interview was tho past summer a
rooragp. That I remember distinctly.
. [ think Pike's failure occurred last spring
—lafo ip the spring Or very early in the
summer.
E. Belcher, sworn—[This witness is
Postmaster at Macon, and the object of
his introduction was to establish the fact
that at various times since 1S70 Pike has
sent various sums of money, by money
order, to bis wife in New York. This
was in substantiation of the testimony of
Mrs. Rachel Pike that her son was the
support of his family.]
_ T. Peyser, nrora—I know John Gilles
pie. I had a conversation with him
abont Pike, a few weeks ago. ono Sunday
morning, in front of Hoff's new building.
We wero in general conversation—Mr.
Isaacs, Mr. Blaomstois, and myself. Mr.
Gillespie camo up, and Mr. Isaacs re
marked that he felt sonry for Pike's
mother. Gillespie said be ought to be
hung, and if the rope was around his
neck he would pul] it; or words to that
effect.
Samvel Blavmstcin, nrora—I know John
Gillespie. I recollect that I was present,

Silk Hats! I My acquaintance was a casual one.
I There were a number of persons in the
1 oar when this conversation was gains on.
I Baton was there on the oppoeite side of
the ear in conversation srith two other
gentlemen. I don’t know who sat behind
or in front ot me. The one behind was
the gentleman who tells ticket* at the
railroad station here. The conversation
occurred while the ears were in motion,
not in a loud voice nor in a very low; but
in a common tone. I am certain I can
not be mistaken Und I heard every word
that I have stated. I first heard of the
killing of Baer through the Tiltoraph
and HB&xa5.1 the .hr after the killing.
I toM Mr. Putter and Mr. W. M. Dixon

of the killing.
