It is deeply to bo re^rettod that tho
legislature has not provided a long sen
tence and punishment to characterise of
fences of this kind in different form, and
fix penalties for oach offense committed
in different forms from those which may
bt imposed by our statutes. Public offi
cers who rob tho people by appropriating
public moneys and allow others to do so
through their instrumentality or conniv
ance are, unfortunately, in the state of
our law, not to be adjudged felons or
punished liy imprisonment in tho State
prison, but escape under form* of indict
ment for misdemeanor, subject for ouch
to pay a penalty of <2i0 or a single year
in the penitentiary.
If this was a general verdict thlswoiild
lie all tho court could impo.c, notwith
standing that he took for his own use
more than a million dollars in tho man-
nor described. If there was u general
verdict rendered tho court could only
pass through tho farcical performance of
rendering jndgmont of two hundred and
fifty dollars fine and one year's imprison
ment for the audacious robbery of the
city and county of more tlum n million
dollars. Under the verdict the court bus
larger powers, which it will oxorcUe, and
I hope with prudence nnd duo regard to
the interests of tho public and example
to bo rnndo.
Tweed was then ordered to stand up,
whioh he did slowly, and on tieing asked
if ho had anything to uty why sentence
should not be pronounced, replied almost
inuudibly "nothing," his counsel adding,
ho has sjx.ken through his counsel.
Judge Davis then resumed: "Wm. M.
Tweed, you stand convicted by n verdict
of a jury of twelvo honest men of a large
• number of crimos chargod against you
united in ono indiotment, aud that ver
dict, in tho opinion of the court, could

tion of the oaths which tho jury had
taken an utter disregard of obligntious

faithfully performed your duties to tho
public, to win honor and respect of the
wholo community, you saw fit to pervert
the opportunity you possessed aud powers
with which you were clothed, in a man
ner more wicked, more infamous and
more outrageous than any instance of
like character which the wholo history of
the civilised world contains. Instead of
protecting tho public, you plundered It j
instead of standing where tue law placed
yon. over tho treasury of your county,
you throw that treasury open not merely
to your own rapacity, but also to tho
avarice of your associates under circum
stance which makes it transparent that
you were engaged in concerted conspir
acy to plunder tho treasury of this conn-

"Tho evidence on this subject can leave
no manner of doubt in tho minds of any

entering by you on those duties? as Presi
dent of tho Board of Audit, on the Gth of

that Board had been audited and certi
fied, nnd warrants issued, and money

out a concerted plan to enrich yourself

judgment, would be conclusively estab
